Who is Wells Fargo?

Wells Fargo is a major banking and financial services company based in San Francisco, California. It is the world’s 10th-largest bank by total assets and 3rd-largest in the United States, and is considered one of the U.S.’s “Big Four” banks along with (in no particular order) Bank of America, Citigroup, and JPMorgan Chase.Despite its major standing and 150+ years of history in the banking industry, Wells Fargo is not accredited by the Better Business Bureau and has arguably tarnished its reputation in the 21st century by engaging in a wide range of deceptive, fraudulent, and otherwise-unlawful practices which have victimized millions of American consumers, not the least of which was an egregious scandal involving “illegal enrollment of consumers in unauthorized deposit and credit card accounts without their knowledge or consent,” which resulted in a $100 million fine from the Consumer Financial Protection Bureau (CFPB) in September 2016. Wells Fargo has also received nearly 4,000 consumer complaints via the BBB in the past three years, most of which are for product/service problems (2,100+) and billing/collection problems (900+).

Wells Fargo Lawsuits

If you want to know just how unhappy consumers are with Wells Fargo, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. Wells Fargo Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Wells Fargo violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Wells Fargo took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Wells Fargo, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Wells Fargo continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Wells Fargo is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide its citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. This is also after they somehow opened a fraudulent account under my name and charged me for fees associated with opening the account. Seriously never seen a bank ran this poorly.”

Most of these comments are complaints about the company because there is nowhere their customers can be heard. In fact, of all the BBB reviews on Wells Fargo 96% of them are negative. That says everything you need to know about them. My personal experience perfectly aligns with their abysmal customer satisfaction on the BBB website. A bug in their system caused them to issue multiple payments consecutively to my bank account (more than 3 to be exact). This resulted in multiple overdraft fees and I had to pay to issue a stop payment because their payment attempts would not stop. I called customer support countless times and they were rude, unapologetic, and would do nothing to remedy the costs I incurred or the issues I was experiencing. I continue to have issues due to that one bug and customer support has predictably been anything but helpful. Given the amount of negative reviews they have and my personal experience it is clear that Wells Fargo could care less about their customers. Actions speak louder than words. They claim they care about their customers but their actions scream otherwise. Wells Fargo foreclosed and Auctioned off my home. Had $30k in equity. Was told that I had to stop making payments before they could help with refi . While they were workigon the refi, they started forclosure procedings without telling me. Found out from a realtor. House was locked up before we could get everything out of it. I am in the Army Reserve and lost several job opportunities when that happen because we didn't have a local place to stay. We still have not recovered from that ordeal. Can anything be done at this point?

I started getting these robocalls. 90% of the time I did not get to talk to an actual person. And anytime I did I explained to them this special credit card payment agreement and asked not to be contacted anymore. The calls have since continued and they have gotten so horribly bothersome I had to forcefully put their number on the reject list. I still get notifications of their calls and they constantly fill my voice mail. For curiosity sake I found out the reason for their repeated calls is by their system error which should have been corrected when they entered into the special credit card agreement. I was behind on payment by less the $50.

I am receiving phone calls from Wells Fargo. I had a second mortgage with them and I could no longer make my mortgage payments. Would not work with me for a repayment structure. By hey threatened to foreclose and then I told them to foreclose. They did not. I also told my first lien holder to foreclose as they would not work with me either. The first mortgage was Wells Fargo and the second was Wells Fargo financial. This has been over two years now. I am now retired and it is not my fault the second Leon holder did not want to foreckosr. I am out of town now and will not return until next week. Will you please forward a name and address to me to call next week. You may text me. This is my cell phone and will not answer unknown callers. Wells fargo will not quit calling me after I asked them to stop. they are calling me 5 - 10 times a day for a mortgage. If I can make them suffer, please tell me how, as I hate them.

Hello Claire I came across this site. And I need help. Today I recieved a phone call from an unknown number saying that I was served like legally and that person said he was with a deputy he gave me a number to call and like a "claim number. I had like years back I would say 2012 took out a payday loan of $300 dollars so when I had called that number with the "claim number" they told me if I pay $700 dollars that all this would be ok!

I am being harrassed by wells Fargo. they are constantly calling me throughout the day and night. I am only 2 payments behind on my home. I have asked them in person at bank branches about refinancing and other options and they want exuberant amounts of money. I've been dealing with the city of bellmead about a next door neighbor where I've had to foot the bill for cleaning up his junk when it floats down to my yard!

My son n law bought a truck from University Dodge in Rome , Ga they called me and ask in I would sign with Him as a cosigner. They said all I had to do was drop by and sign a paper. The next thing I knew was I got a letter from Wells Fargo saying that I had bought a truck and that they were looking forward to having me as a customer. Fast forward my son n inlaw quit his job and lost insurance on the truck, Mean while I am getting calls every week about payments. so I went and got the truck and turned it in to Well Fargo, they sold it for nearly nothing and again started calline me about the balance owed on truck so I started paying $100 a month and then My wife passed and I called them and said that I could only pay $50 amonth. Well the last 3 weeks every week they ( Well fargo ) have called me and ask if they reduced the amount owed could I pay it off first time I told them no I could not next time same thing canyou borrow the money from a friend and pay this off. Today *-23-18 they called and ask me again could I pay this off I said no she said if I would agree to a reduced amount the payments would only be $271.00 a month I again told her no I did not have that Kind of money and I ask her to please stop calling me that they could except the $50 amonth or that is all that I can do. She then ask me what day of the mohth I could male payment I told her the third Wednesday is when I get my check she then ask can you make a payment earlier that that so I hung up on Her!

I would like some legal advise. I cannot get my HELOC administrator to properly acknowledge the death of Primary on loan. Purchased duplex with stepfather, obtained HELOC in 2005. Stepfather passed away Nov 15, 2008. I notified Mortgage and EQ line Servicers. Mortgage servicer professional-ie no mistakes; EQ servicer kept deseased listed as primary, when acct became delinquent, they would call and ask for deseased stepfather. I would inform them he is deceased, they would call back two days later and ask to speak to my deceased stepfather, I would inform them he is deceased. They would call back two days later and ask to speak to my deceased stepfather, I would inform them he is deceased, they would call back two days later and ask to speak to my deceased stepfather. This went on for years. I have more info than I can provide here. I believe I have a case of possible harassment with the HELOC servicer. Approved for loan modification in Feb 2017. Things were going good until the Home Preservation Specialist I was working with transferred out. Was told mod would remove stepfather from mortgage and EQ line. My stepfather was removed from mortgage but not EQ line. Initial payment to EQ during trial period I made 5/9/2017- They sent notification to my deceased stepfather thanking him for using the electronic draft service and attempted to payment from acct that they associated with him. I really need some legal advise. I do believe I have good evidence of HELOC servicers failure to properly identify the person they have listed as primary as deceased. This has made attempting to manage this acct an absolute nightmare!

"I do need to speak to someone who will listen and understand what has happened with my home I have been dealing with this since 2015 and can't seem to find help my house had a 2nd line of credit for 100,000. The lender went out of business. the loan had been sold many times throughout the years. a company named trinity financial bought the 2nd and never contacted me. They foreclosed on the house and bought the house their selves the first time I heard from this company was from their lawyers to get out they wanted their property. I kept wells Fargo informed that I was getting strange mail from people trying to save my home. I asked Wells Fargo if there were a problem on my home I called them daily and they always said I was current which I was. I was court ordered out of my house by Trinity and moved 2 years ago. I kept wells Fargo informed that someone else, Trinity owned the property. I was not at that address anymore. they still told me there was no problem with the property. I stopped paying wells Fargo 10/20115. and have not paid since. Of course, I am in default with Wells Fargo. Trinity sends wells Fargo money when they are going to sell the property I have been sent money by Wells Fargo when trinity does not pay the full amount Wells Fargo is asking for. I have written to the CEO of Wells Fargo about this problem and they send a standard letter not addressing the problem. I get requests from Wells Fargo if they can give information to people that want to know about my loan I never give them permission but they give out information anyway. I have been living a nightmare for several years I am a 68-year-old woman who takes care of my children and grandchildren I feel like I have been taken advantage of. Trinity could have contacted me and asked for payments and Wells Fargo could have looked into the problem but chose to turn their head!

I borrowed money from Wells Fargo to buy a home in July 2000. Several years later I had file bankruptcy but I continued making payments to WellsFargo however my bankruptcy lawyer did not reaffirm the loan with Wells Fargo. I’ve been through divorce and I’m 60 years old and the floor fell through in house. I moved into apartment and had stop making payments because could no longer afford to live in the home and pay for apartment. I’ve been trying to sale the home and work with Wells Fargo. I was told by Wells Fargo loan officer that because I had not reaffirmed my loan with them in bankruptcy that they where not able to harass me or turn me into credit reporting agencies. In fact every conversation we had for months Wells Fargo always said this is not attempt to collect a debt you can end this call at anytime. Today I received a letter from Wells Fargo lawyers saying they are suing me for 28,000 dollars. I called Wells Fargo now they are saying they have no bankruptcy on my file. I have done everything in my power to do right by the house I am exhausted and stressed to max. I have proof that I filed bankruptcy and did not reaffirm the loan with Wells Fargo. Please contact me. I had a Wells Fargo credit card which I stopped making payments on because I am not working (currently staying home with 3 small children). They sued me and I received advice from a lawyer stating I’m judgement proof because I have no income and no assets or wages. So I did not go to court date and they won the lawsuit against me. Last week, I received my tax return and deposited it into my bank account and Wells Fargo confiscated the money saying it was recovery asset. I am on food stamps and was planning on surviving off that federal tax return for next six months. I called Wells Fargo and spoke with 3 representatives that say it’s legal to garnish a federal tax refund to pay the debt from the credit card. When I google it, it says this is illegal. Is there any way to get my $3000.00 back? Thank you.

Wells Fargo would not allow me to pay a debt, referring me to attorneys who referred me back to them. After weeks of this run around they disappeared and would not contact me. Now they have suddenly filed a motion in court for the old debt which I had attempted to pay.

Good morning. On Tuesday I had a event occur after a phone call with the Des Moines Iowa office of Wells Fargo Bank. I had called and spoken with a loan officer about reducing our current mortgage payment temporarily. The call was successful. During this call I told a couple of harmless jokes. One was about the coronavirus and the other a hunting joke. An hour later the police showed up at my door. They had been called by Wells Fargo and asked to do a mental wellness check on me. I live in rural Virginia. I am 71 yrs old, married for almost 40 years. Having the police show up like they did is a alarming. This is a matter of public record now and I have never had any legal issues. I do not understand why I was harassed by this bank. For the record, I have never had an issue with the bank, the loan is in good standing. My wife just happens to be a mental health/substance abuse counselor. At the very least I feel a complaint of some kind needs to be made against Wells Fargo . I would like to know if you think I have grounds for an harassment case against them. Although I am 71 I do intend to work when I can. This incident could be detrimental given I do consulting work. Thank you for your time.

A debt collector of yours SLC, UT text me a pic of my personal judgement of another company. Also, text me, "I know where you work." It's a federal offense for him to have an opened piece of my personal mail. If this man is a debt collector and represents your company. He has broken the law and I'm sure company policy. If your federal income tax return was directly deposited into your bank account, and Wells Fargo had a judgement against you with a lien on your bank account, then any monies in your account are fair game for garnishment. However, under the law, they cannot take more than 25% of your disposable income--if they do so, you can take it to local court. You can also file for financial hardship relief. Hi Larry. I'm sorry about the passing of your wife and the stress of dealing with Wells Fargo as a co-signer on a loan for your son-in-law. As a co-signer, you are legally responsible for the loan as if you had taken it out for yourself. Unfortunately, this puts your credit at risk. Has your son-in-law been contacted about this by Wells Fargo at all? Has he offered to help in payments? You could ask Wells Fargo for a co-signer release, however this is never guaranteed. In March of 2019, I received an offer letter from Wells Fargo Bank regarding a Mortgage Consultant Position. The offer letter and application was escalted and submitted to the Financial Fitness Review Team which is a separate entity and I was told it's part of the application process. The Financial Fitness review team requested a Letter of explanation regarding credit and outstanding balance. Unfortunately, the Financial Fitness Review Team declined and rejected the position at Wells Fargo Home Mortgage and did not provide me with any legal documentation regarding the declinantion. They also performed a background check and questioned Eco Home Improvememnt, LLC. which was initially opened in 2015. I never received my background results as well. As of today, they have yet to provide me with any legal documentation specifying the declination of the Mortgage Consultant position. I am hoping you can further assist me. I also contacted the 877-HR- Wells and as of today no one was able to provide me with the declination letter. Here is some information that may be useful; Worked at Wells Fargo since October 2004 Obtained Several Positions within Wells Fargo Company Resigned as a Wells Fargo Mortgage Consultant in Dec 2010 Employee ID# Work Email Address @wellsfargo.com At the tkme of the application applied as Jasmine but was legally married and name was changed to Jasmine. I was told to leave the name as is (Jasmine) due to not having a drivers license that reflects Jasmine and fingerprints and background searches were easier to access information in NMSLR Portal. Offered a Mortgage Loan Officer Position at: White Plains, NY Branch Manager: Michael Area Mananager: Lorraine Regional Manager: Ed Financial Review Team Requestor: @wellsfargo.com As of today, after requesting for the letter of declination, copy of credit report and background results. I never received a legitimate Wells Fargo declinantion letter and since my email address was compromised I no longer have a copy of the initial offer letter I received during the application process. Wells Fargo withdrew a total of $28k from my business and person checking accounts to pay a delinquent business credit card. COVID caused me to nearly go out of business, so I hadn\'t made a payment in almost a year. I called them last week to try to make a payment of a few thousand dollars, after getting some work into the business. They told me I needed to pay the debt in full or they would be pursuing legal action (mentioned that I had signed a personal guarantee). I told them I could not make payment in full and that I would have to wait until additional money came into the business. The same week they clear my business account of over $18k and my personal of over $8k. I needed that money to fulfill work for my client and cover personal living expenses. I\'m now overdrafted and zero dollars to maintain my business.

Wells Fargo sued me without me receiving any type of law suit notices and are now garnishing my paychecks. I looked into the law suit they filed and the default judgement against me and the debt they are claiming I owe I do NOT owe because the debt is as due to a stolen credit card and unauthorized charges on my Wells Fargo credit card account.
