Westlake Portfolio Management Complaints

The Fair Debt Collection Practices Act (FDCPA) is a federal law that applies to everyone in the United States. In other words, everyone is protected under the FDCPA, and this Act is a laundry list of what debt collectors can and cannot do while collecting a debt, as well as things they must do while collecting debt. If Westlake Portfolio Management is harassing you over a debt, you have rights under the FDCPA.

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Westlake Portfolio Management violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. Can Westlake Portfolio Management Sue Me?

Although anyone can sue anyone for any reason, we have not seen Westlake Portfolio Management sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. Can Westlake Portfolio Management Garnish my Wages?

No, unless they have a judgment. If Westlake Portfolio Management has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above.   1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee.   4. What type of debt is covered under the Fair Debt Collection Practices Act? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. The FDCPA does not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. Original creditors, such as banks and credit card companies, are not bound by the FDCPA.

  6. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens with an additional layer of protection. If you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, or Wisconsin, you have additional state-law rights.

I've been receiving correspondence from Westlake Portfolio Management LLC demanding repayment on a loan . This loan was discharged through a bankruptcy court July of 2021 of this year . I have an auto loan that was taking out through a complete different company then one day they sale to WPM, I’ve been out of work for a year due to family and have not been able to keep up with the high payment amount. It’s a title loan so I’m nervous they will take my car.

ACC gave no notice of closing. Westlake never contacted me until today. Westlake can not provide a contract. Westlake has not sent out a wet letter. Westlake has sent a bogus letter with ACC name on it.. Westlake is the eating to take my car. I need help

I purchased a vehicle from ACC(AMERICAN CAR CENTER) on feb 13 2023 in nashville on bell road. March 14 2023 i went to my Rutherford county clerks office to obtain my real tags. The lady told me that my car is not registered. West link keeps calling me about a payment. I dont have a contract with nor have i signed any papers from them. They are a debt collector but i dont owe them anything. They keep calling about a payment but can give me any info of where is my title

American Car Center/ American Financial closed abruptly with no notice and has filled bankruptcy. Westlake has been harassing me calling from multiple phone numbers a day about a “debt” that’s not a debt and to pay them more then what is left on my balance. I haven’t received any contact, validation of debt in writing from them just constant calls.

I leased a vehicle through American Car Center. When Westlake Portfolio took over ACC accounts, I had one payment left which I paid to them. The only remaining amount due was the balloon at the end if I wanted to keep the car vs. turning it back over to them. I originally was told by Westlake that the balloon was $4700, my ACC contract says $3900. I was then told they did not actually have the contracts in hand and then changed the amount to $4498. Although this is different from my contract, I just wanted to be done with this company and secure the investment that I paid on for almost 4 years. I obtained funding to pay the balloon and only needed a 10 day payoff letter, copy of title if applicable, and address for lender to mail the payment faxed to the lender. I obtained this funding on 04/07/23 and have made these requests both by phone and email. I have sent 5 emails with 3 going to the supervisor I was instructed to send them to by a customer representative. They call once a week stating I am 72 days late when my last payment was in the middle of March. The amount they want me to pay is to \"rent\" my vehicle until the balloon is paid. If they would send the info then it would already have been paid off without a monthly rental. This stress has resulted in my health being affected. I would appreciate any guidance. I do not know what to do at this point. I am not a collections client and just want to pay this vehicle off.

Hi, my name is Ashley Clark I am writing this because I purchased a 2016 Dodge Journey from US Auto Gainesville, Fl. on 2/25/2023. The process was very long even though I was pre-approved. The dealership was having issues the salesman Jack stated they were experiencing issues being able to print things. When I finally received the vehicle and I didn’t say anything then because I was exhausted from rushing the day to get to the dealership and then the long process of obtaining the car and I needed to get back home to Lake City, Fl and my children because I had to pick my son up from work. When I received the vehicle it was filthy they had not washed it before my taking possession nor did they fill the gas tank, it had less than a quarter of a tank, and I had to stop and put gas in it before I got on the highway or I wouldn’t have made it home with what was in the tank. As a customer and someone who has worked in the customer service industry for over 25 years receiving multiple recognitions and appreciation for the service I provide always doing my very best to solve the problem, so this is very disappointing. I proceeded to drive the car as I would and 3/1/23 was the first time it left me sitting and the push button start wouldn’t work. I tried to start it again a few times and out of nowhere it started. I was hoping it was just a fluke, but that was very much not the case. The car left me sitting again on 3/3/23, 3/6/23, 3/7/23,  and 3/9/23 on all these days it eventually started but the length of time it would take till the car started continually increased with each occurrence till on 3/11/23 it left me in the grocery store parking lot with groceries melting in the car and wouldn’t start. It was over 12 hours till the car finally started and that is when I drove it to the local Lake City Dodge Dealership I was told when I purchased the car I can take it anywhere and I knew wherever I took it there was no guarantee it would start again. The car was left at the dealership late on 3/12/23 about 10:30 pm. At this same time, I was to have started a second position to advance my career, unfortunately, I now had unreliable transportation and couldn’t be in Gainesville on time and had to inform them of my situation. They had to pass on me starting and that they would be in contact when an opening came again. The entire reason I purchased this car was to take this opportunity and still allow my husband (who hasn’t worked in 2 years from having a major heart attack and his heart Ejection fraction rate not increasing above 30% and now has CHF. We’ve been trying for disability but nothing yet as to approval or denial) a vehicle to get our children to their job, soccer, and dance. This has caused a major inconvenience in my life as well as now a financial struggle and hardship. I put 1,700 dollars down on this car to have it for a total of 13 days till it ended at the dealership, 3 days I had of a fully operational vehicle till it started giving me issues and left me stranded on multiple occasions, losing money, time at my already full-time job, making me late to work, loosing a job opportunity. I contacted the warranty company and started a claim, letting them know what was going on. Joe, the man I spoke with sent me a list of approved auto shops. The car was already at Lake City Dodge, but after looking at the list, all the approved shops were in Gainesville, which was not conducive as I live in Lake City. So the car was staying at Dodge. I then started speaking with Hannah at Lake City Dodge who informed me they think it’s the key fob battery and they’ll switch it out and I’ll be good to go. I let her know it would not be that simple but go ahead and do the check. That was not the problem and they were now going to check the battery, again not the problem, at this time she asked if they could do a full diagnostic on the car and would get back to me. Here it was the GPS tracking system placed by US Auto, by one of their technicians stating there were broken wires and connectors. So the fault fully lies on US Auto. DOWC has already paid the bill at Lake City Dodge on 4/2/23 and I finally received the car back. They informed me at DOWC they had to get approval for this but was deemed to be on US Auto and was paid. I also had to do all the leg work on this keeping everyone informed because they don’t talk or do what needed to be done because every time I called anyone no one knew what was going on. This has just been a huge inconvenience to me and my family. I needed to be compensated for this. It is wrong and not the way to conduct business. I had spoken to a multitude of representatives most have passed the buck as most do these days because that’s what is taught. Companies care more about the quantity of calls taken over the resolution and quality of each call taken. Real customer service is almost dead you don’t see the exemplary service I and some others still give to every patient, guest, or customer we come in contact with. I asked in writing on 4/5/23 per their request for an pushed out date of my 1st payment which was scheduled to be due on 4/1/23. At this time I still did not have possession of the car. I asked the payment to be deferred 1 month from the day in which I received the car back 4/2/23. Making my first payment, not due till 4/30/23. I believed that I should’ve been further compensated, but at this time I needed the vehicle to be able to work, see if the position was still available so I could pay for the vehicle. Had I originally received a properly running vehicle at the time of purchase I would not be writing this nor would I have endured what I have.  Included was the copy of the bill from Lake City Dodege clearly stating the problem and other supporting documentation. I hoped that they’d come to the right, just, and ethical decision. Instead I heard nothing. No return phone call, no email, no snail mail, absolutely nothing. I was required to give them time to make their decision and they had not locked the device (turning the car off and unusable) till they came to a decision. So I contact them and the representative informed me that they made their decision and only pushed it 2 weeks making it due 4/14/23, it was 4/12/23 on the day of the call so again I am in the same position. I continued contacting them and trying to get someone to help me. I contacted the corporate office and spoke to a secretary who took my message and stated someone would be in contact with me. I called them on Monday 4/17/23 to find they’ve gone out of business. So I’m calling all the numbers I have because I’ve received no communication from them. I get a hold of a representative who informs me that they are temporarily closed on the sales end but still taking payments. I explained to her my situation and she stated there was nothing that could be done. I’m sorry what! What’s going on? She had no further information and if I wasn’t making a payment that she couldn’t assist me with any other issues. At this point I didn’t know what to do because I didn’t have the money to pay this payment and all my other expenses as I planned buying the car to my first paycheck with my new employer, but US Auto set me up for failure from the gate. So I continued to contact them explaining that I’m not dodging and I honestly want to pay but I need time. Continuing to call my calls now we’re going through all the promos but then would get the double beep and it would hang up for days till on 5/9/23 I am at work and a tow truck comes and takes my car and belongings. So I get time to step away and make a phone call calling 3 times till it finally gave me a person. This person was rude and not helpful at all. She sets I was behind on my payments, and I explained to her and stated it should all be in my account I call you almost daily to keep contact so this wouldn’t happen. I was just starting to repair my credit and I absolutely couldn’t have this. She stated she could do nothing for me but stated that I needed to contact JMAC Towing at 978-674-8300 as to how to get my vehicle or belongings. To get my vehicle back I had to pay the back payment of 578.33 (which my payment was 476.42 so I guess late fees of 101.91) and additional 300 towing fee to US Auto for a total of $878.33 and then an additional 150 to the towing company to return my car once they have been notified by US Auto it’s ok to release the car. I asked her where this place is located as my belongings are in the car and I need them back. She was very rude and told me “I don’t know call the number”. I obviously do not have this money so I went home that day and had a letter in the mail telling me the car was to be auctioned off on 5/23/23 I can show up to buy it back or retrieve my belongings. So I contacted the number given which leads me to a repeating message to go to a website to make an appointment. Which again gives no information about where this place is or how to speak to a person. Instead you have to just make an appointment to go there, but where? So it texted me stating it received my request but it didn’t send anything additional so today 5/23/23 I had to take time off work and after google searching the number and name she gave it seemed it was a company based mainly in the Northeastern United States but had one location in Jacksonville, Florida. Drive the hour there for them to tell me the car has been in Lake City the entire time and again for the hundredth time I am inconvenienced. I as well the other day received an email from Westlake Portfolio Management stating that they have my new payment date and to contact them. From what I have read and understand US Auto is out of business and Westlake Portfolio Management has taken over the debt. I called to speak with someone about what was happening and I was harassed by Irving treated and spoken to in a manner that is disrespectful and inappropriate. He is apparently a supervisor and telling me that it’s my fault that I’m behind in the car, and that I am lying about what’s happened to me. I told him I have all the documentation and I can send them everything if they didn’t acquire it from US Auto. He then told me to stop yelling at him at which I said if you were treated like this wouldn’t you be upset and this isn’t yelling sir. You would know if I was yelling at you. I proceeded to ask questions about things I have read on online groups and chats about this entire mess and how US Auto and now Westlake is screwing over thousands of people and got him to admit that they are not honoring any of the warranties on the vehicles which was an additional cost on the price of the vehicle for each person who purchased the additional warranties. I also got him to admit that they are the debt collation part of Westlake and we are paying on US Autos debt not our actual loans back to a bank. And now they call daily, have called my work several times, and have started harassing my mother in law, sister and friend! I know that all of what US Auto has done and now what Westlake is doing is completely unethical, wrong, horrifyingly bad business, and must be a breach of contract or something. i would like to know why i recieved a call from you guys when my car has been totaled by my insurance company back in october i have not drove my car used my car my jeep compass i am not paying you anything my car was through us auto and they have all the documents when i called them told them there was the insurance company they needed to talk to i had a open case with us auto and the gap insurance and they have since closed so my claim is in thin air now i have emails with the dealership my call logs and everything even the towing company even tried to reach us auto to no evail this is crazy someone needs to pick up the slack and take care of this matter since it was us auto employee that messed with the pass time device and boom car went up in flames

I Purchased a vehicle from US auto sales located at 2752 Laurens Rd, Greenville, SC 29607 . I have not missed a single payment or deferred anything. My Loan was 100% in good standing! Us Auto from my understanding has went bankrupt. In turn, has caused my loan to show as \"closed\" on my credit report. Now has been picked up by Westlake portfolio management? I am very upset because it is reflecting as if I allow my account to charge off and be sent into collections. I am reaching out for legal help and options on what to do!

American Car Center/ American Financial closed abruptly with no notice and has filled bankruptcy. Westlake has been harassing me calling from multiple phone numbers a day about a “debt” that’s not a debt and to pay them more then what is left on my balance. I haven’t received any contact, validation of debt in writing from them just constant calls.

I’m living a nightmare with Westlake Portfolio. The company I purchased my car through (Us Auto Sales) abruptly shut down and sent my account to WPM, without my consent! I’ve made payments that are not reflecting on my account. They have taken away my payoff amount, so I don’t know how much I owe. My account is reflecting delinquent and my anxiety is through the roof! I’m scared to make any more payments cause I’m not sure where it’s going? If I don’t make any payments, I’m afraid they’ll repossess my car and reflect bad on my credit report. I’m a single mother with a disabled child, I just can’t afford unnecessary stress. Please help!

I purchased a vehicle from US Auto sales in Jacksonville Florida in October 2022. This is one of the accounts that westlake portfolio management has taken over. Since then, my account with US Auto Sales has been closed on my credit, but Westlake has not reported any of my payments which have all been on time. I would like someone to review this and verify whether or not I will be able to get the title to my car once it is paid off or if I should take different action to ensure my payments are reported correctly and any further action I should take

Purchased a vehicle from US Auto sales in March of 23 In May I started receiving call emails and regular mail from WMP. When made aware of what had happened. I requested a copy of my contract I’ve still to this day never received the information. They have reported to the credit bureau that I owe 20,645.00 for a car that is in operable when Us Auto Sales Reported right before they shut down that I had a zero balance . With them. I have 6 voice makes from WMP . On July 25 they picked up my car and the have no legal bearing to the vehicles. They will not provide any paperwork when ask. I’m still waiting on paperwork that states that WMP is my lien holder. But nothing as of yet.

US Auto Sales went out of business and Westlake Portfolio Managment has taken over servicing of my account. They have been unable to provide me with a valid contract for my account and what they have sent me pertains to a car that I never purchased. the Interest rate they have in place is not what was originally agreed to when I purchased the car. They are currently reporting to the credit bureaus and if something isn\'t done it could negatively impact my reports I have ceased payment until they provide me with the correct contract and fix the account. After several calls nothing yet has been done. I would like for the debt to be null and void, for them to take the car and immediately remove any remnants of their existence on my credit history so that I may go purchase a car from a reputable business.

I paid my car off with Westlake, that took the loan over from American Car center. I paid the final payment 08/18/2023. I have yet to receive a Car title. Each time I call they state it\'s in the mail. No one can give me a tracking number for said letter in the mail. I need to know what my options are. I either need my title or a full refund for said vehicle.

I purchased a vehicle through USAuto signed a contract with usauto for the 2016 Toyota Camry around October 2022, I have made on time payments since signing the contract with them they went out of business this year 2023 around June July loan was then given to Westlake portfolio mangement it to was making on time payments up until I switched jobs end of June my pay period was still every 2 weeks but was like a 2 weeks different they charge 8.08 a day in interest for late payments I’ve called them several time even at the time of changing jobs to let them know my pay period was different and if they could up date that in the systems bc with the $8 interest thst it’s not paid with what they have in the system I’m falling into a whole and it’s not like I’m not paying my $257.41 car payments I was told no they can’t update it i them started to shop for a new car bc as a single parent that being my only car I claimant afford for them to come repo my car. I have all receipts emailed of on time payments my car was repossessed 9/20 I still receive calls in ref to making payments on a car they have ingot a certified letter stating they was going to sell the car 10/08 I think but on my credit it’s reporting reposed and I have a out standing balance of 3,000+ I don’t think this is fair to consumers that have signed contracts with USA auto to be out in this situation of repossession bad credit reporting and some stuck with out getting a car my dad had to Co-sign with me and my credit is all screwed now due to this ordeal please help me or point me I’m right direction it’s a night mare and stressfull

On August 31st 2023 I paid $1236.05 for a car that was repossessed 4days earlier on that previous Saturday. I spoke to a Representative by the Name of Alejandro Suarez which works in the repo department on September 15th. I called in regards to my car still being in the possession of the car that I already paid the $1236.05 to be able to get it back. That day he informed me that he sent out the release already previously but he will send it out again. Just to give it a few days and someone will be calling me to set up an appt to pick up my car. Called multiple times to not only the repo company that had my car but Westlake portfolio management as well and they continued to tell me that they sent the release and to just give a few days over and over again. Finally called again 3 weeks ago when I spoke again to Alejandro and informed him that I have yet to get my car and he said “that’s weird yeah you were supposed to get your car back. Let me take down your info and I’ll call you back once I figure why you haven’t gotten it back.” I call back on October 31st 2023 2 months to the date just to see if there was an update and he informed me that my car was sold on October 28th at auction…. Long story now I have a repossession under my name and can’t get a car anywhere now, but paid for a car that I never got back and lost out on $1236.05… Account is under review but a supervisor Breanna Briones said that even if they sold the car at auction and they are at fault I’m still liable for the car even though I paid to get my car back.

I purchased a car from American Financial 5 years ago. I made all my payments on time and then Westlake Portfolio took all and it has been hell.. First off I was always correcting and going back and forth with American Financial for their poor booking keeping, saying I owed when I already paid, and having different amounts. I thought things would get better because I only had 2 months before I could pay the car off in full which would have been June 2023. Westlake was pressuring me for a payment but their website wasn\'t up at that time and I could not see my total to ensure we were on the same page. I made my payment in good faith and that\'s when the harassment started. I spoke to the first lady and asked for my pay off and she said it was over $8000.. I was so shocked.. I just knew she had the wrong account. I explained to her that could not be right and even did the moth over the phone with her telling her that I only had $4000 left to pay. She was very rude and didn\'t care and told me that was my new balance. I asked to speak to a manager and she said\" tell me where the car is\" I told her my address hadn\'t changed. She told me if I didn\'t pay they would repossess my car. I asked her how if I was not 3 months behind, she said because I\'m voicing that I am refusing to pay the new amount. I feel so helpless, I can never speak to a supervisor, or anyone who will listen from that company. They call me every day 4 times a day I asked them to stop calling me unless it is an account manager or someone who will help. They told me to send them my info via email. I did several times and they stated they never got it. This is so crazy and underhanded, now reading these stories that sound just like mine, I know that they did this on purpose!! What can we do.. Do we have enough for a class action lawsuit?

Westlake continues to leave me voicemails about a former US Auto Sales debt. However ive paid over $9,000 for this car and my credit report still reflects $19,000 . Im just confused as to where all my electronic payments went to. They even sent a repo truck to try and take the car last month. Police were called but they threaten to return again.

Ive been dealing with West Lake Portfolio, who repossessed my car due to non payment during the months we were in \"lock down\" due to Covid, ive disputed the debt a number of times with the 3 major CRA\'s & also the CFPB and each time cited multiple violations I believe were appropriate & have even asked them to validate the debt. However they continue to be able to report this debt with the same \"payment history\" document. The original creditor was Summit Financial who out of the blue sold the account to West Lake Port. It is the only thing on my credit report and severely impacts my ability to do anything credit wise. Any and all assistance is greatly appreciated, Thank You

I had a car with US Autosales and it was transferred to Westlake. They have repoed it twice. This last time I just gave up. I can\'t get anyone to speak to me about how to fix the problem. I have emails where they have repeatedly closed my ticket around 20 times instead of helping. They have ruined my credit and I haven\'t been able to come to a resolution with this company. However, I get calls from random numbers from them and it is nonstop, I have had to block these numbers. Not to mention the papers in the mail.

They call me everyday, multiple times a day, regardless of my payment status. They leave voicemails all the time that consist of silence. I was enrolled in Bytepay for aligners. They switched to Westlake Portfolio Management. I have been set up with auto-pay for months and each month it does not auto-pay. So, despite being enrolled in auto-pay, their service has never done this, causing me to miss or make late payments. Recently, it did not auto-pay, which resulted in a late payment. They reported it making my credit score go down substantially. I am not the only person who has had this issue with their reoccurring payment system, causing people to have to pay late fees or ruining their credit scores by reporting late payments from their faulty payment system. My credit went from over 750 and is now down to 690\'s.

I had a car with American car center, when they went bankruptcy, Westlake brought out the contracts, My car start having engines problems, when I was still under the contract with America car center, I had a warranty with America car center, but Westlake did not honor, the warranty, but I did not keep the car and told them that I will not sign anything with them and the lady told me to take out a loan, in get it fix. So know they keep putting on the credit report the I\'m late with the payment, because they can not put repo, when I didn\'t sign anything with that company, and they have the car, a week after they brought out the contracts. What can I do? They are doing on purpose.
