Being under compliance with the Occupational Safety and Health Administration (OSHA) means that employers are adhering to all applicable regulations that have been developed by the Federal agency. This includes following a list of standards that are intended to keep the workplace safe and reduce the number of illnesses and injuries to most private, and some public sector employees.

According to OSHA, for a company to be in compliance, they must do the following:

An employer must provide a workplace that is free from serious hazards as recognized by OSHA and effectively complies with standards, rules, and regulations that the OSH Act has issued;

  • Provide workers with personal protection equipment (PPE), at no cost to the worker, that fits and offers appropriate protection;
  • Use color codes, safety signs, labels, and posters that alert workers of any and all potential hazards;
  • Have tools and equipment in the facility that are safe and properly maintained;
  • Post the OSHA poster in a prominent area, in a language, the workers can understand, within the workplace to ensure workers understand their rights to safe workplace;
  • Under whistleblower protections, employers may not retaliate, punish, or discriminate against employees who file complaints;
  • Following an inspection with a compliance officer, employers must remedy the violations found in a timely manner or be subject to further citations and fines;
  • When citations are issued from inspectors, these citations must be posted at or around the area that is in violation;
  • Employees have the right to access the Log of Work-Related Injuries and Illnesses;
  • Safety training must be provided in a language and vocabulary that employees can understand;
  • Develop, implement, and establish operating procedures and effectively communicate the requirements to workers.

While it is not a requirement, OSHA also strongly recommends that employers adopt and enforce an Injury and Illness Protection Program. These types of programs can significantly reduce the severity and number of illnesses and injuries in the workplace, keeping workers safer.

If you or a loved one has suffered injuries due to negligence on the job site or a defective product, an experienced personal injury lawyer can review your claim and determine if there were unsafe working conditions, potential OSHA violations, and other hazards that may have existed at the time of your accident. They will also determine who may be liable for your injuries and damages and what compensation you may be entitled to.
