The Occupational Safety and Health Administration, or OSHA, is responsible for enforcing health and safety regulations in American workplaces. Workers, employers, and manufacturers are required to comply with the standards set up by OSHA to ensure that work environments remain safe for everyone. Unfortunately, when these important regulations are ignored and violations occur, the consequences can be fatal.

If you have been injured in an accident, contact Mike Agruss Law for a free consultation. We are a Chicago-based injury law firm representing individuals (and their families) who have suffered an injury in an accident. We will handle your case quickly and advise you every step of the way, and we will not hesitate to go to trial for you. Lastly, Mike Agruss Law is not paid attorneys’ fees unless we win your case. Our no-fee promise is that simple. You have nothing to risk when you hire us – only the opportunity to seek justice.

Types of OSHA Violations

There are four (4) types of OSHA violations that can occur. These include:

  • Willful-An OSHA regulation is intentionally ignored.
  • Serious-A workplace hazard could cause a serious or fatal injury or accident.
  • Repeated-A workplace has been repeatedly cited for OSHA violations.
  • Other-than-serious-A condition exists on the worksite that could affect safety or health, but does not have the potential to be fatal.

Most employers are required to display prominently OSHA posters informing workers of their rights and obligations, as well as any current citations issued by OSHA inspectors. Employers are not required to report every workplace injury to OSHA; however, they must report to OSHA any work-related death, eye loss, amputation, or hospitalization.

Common OSHA Violations

The most frequent OSHA violations are in the industrial/construction industries. The most common violations seen on the worksite include:

  • Falls
  • Scaffolding
  • Ladders
  • Machine guards
  • Powered industrial trucks

Not only does OSHA set and enforce the workplace standards to prevent violations, they will also impose penalties for non-compliance, which will vary with the type of violation.

If you or a loved one has suffered injuries due to negligence on the job site or a defective product, an experienced personal injury lawyer can review your claim and determine if there were unsafe working conditions, potential OSHA violations, and other hazards that may have existed at the time of your accident. They will also determine who may be liable for your injuries and damages and what compensation you may be entitled to.

We at Mike Agruss Law are proud to serve our fellow citizens in personal injury cases, especially when you or a loved one has been injured, and we are fully committed to protecting your rights and ensuring that the other party is held legally accountable when negligence occurs.
