Slip and falls regarding snow and ice are tricky. In these cases, liability can be nonexistent or complicated to determine. Due to a rule in Illinois regarding “natural accumulations” such as snow or ice, property owners are not obligated to remove natural accumulations on their property and they are not liable if someone slips on it since they did not place it there. If the snow or ice has naturally collected in the area that you fell, it is not likely or sure that you have a strong case, since that eliminates the first requirement of proving negligence.

There are times when you may actually have a case. If the property owner decides that they want to clean up after the property’s snow and ice that has collected, and they clean up negligently, they may be held liable. If they attempt to clean it, create an artificial accumulation as a result, and you slip on that, then they may be liable. Or, if an artificial accumulation has formed due to a condition and/or nature of the property, then they must completely and sufficiently clean that up; if you fall in this case, the property owner may be liable. On a more unrelated note, if snow or ice is tracked into the inside of a property, these rules do not apply, since there is no natural accumulation; it is a matter of the actual property now where no natural accumulations form.
