By Illinois State Law, an auto insurance company must give you proper forms to proceed with filing your claim within 15 working days upon request. Additionally, the other party’s insurer must give you a written explanation for delays with your property damage liability coverage claim exceeding 60 days following the first notification.

If you’re filing to your own auto insurer, the state laws require them to reach out to your 21 working days after you’ve informed them of the accident. Following notification, the insurance company will investigate the claim. You may want to prepare the following to ensure and, possibly, expedite the processing of your claim:

  • Report the incident to the police as some insurers may reject your claim without a police report.
  • Get photos of your injuries and the damages to your property before getting repairs.
  • Get names and contact information of witnesses.
  • Keep all receipts of repair and medical care.
  • Make sure your property is free from further damage following the accident as your insurer may refuse coverage for the additional damage.
  • If the claim is against your insurer, review the “Conditions” and “Duties After Loss” of your policy to ensure you’ve provided all requirements for the claim
  • Cooperate during the investigation.
