Under the Occupational Safety and Health Act of 1970 (OSH Act), employers are required to provide a hazard-free work environment for their employees through a comprehensive set of standards. In 1971, the Occupational Safety and Health Administration (OSHA) was created to uphold these standards in all 50 states.

Most private sector employees are covered by OSHA standards, however, there are exemptions. These include self-employed individuals, farms with only family members as employees, domestic services employees, businesses that do not engage in interstate commerce, churches, federal and state governments, and their political subdivisions, and businesses regulated by different federal statutes such as mining and nuclear power industries.

Businesses with more than 10 employees must maintain OSHA illness and injury records unless the business is determined by OSHA as partially exempt. If a business has 10 or fewer employees within the year, or the Bureau of Labor Statistics and/or OSHA says otherwise, you do not need to keep these records. Also, low-hazard industries, such as insurance, real estate, retail, and finance are typically considered partially exempt. However, all employers must report to OSHA any workplace event that results in the hospitalization or death of three (3) or more workers.

Employers that violate OSHA standards can face extensive fines. Intentional and repeated violations can result in fines of $70,000 per violation, with a minimum of $5,000. An employer who receives a citation for serious breaching of OSHA standards can face a penalty of $7,000 per violation. An employer that makes false statements to OSHA or presents false records can face imprisonment of up to six (6) months and a fine of up to $10,000.
