A wrecker, commonly known as a tow truck, moves vehicles when they are improperly parked, in need of help, and simply must be moved from where it is. What kind of accidents or injuries can result?

A wrecker accident can occur due to defects that cause malfunctions during use. These defects can cause the wrecker to not properly secure the vehicle being towed or for the brakes to fail while driving. An accident may also occur from failure to obey traffic laws or driver negligence, which may be distracted or drunk driving. The driver of a wrecker must be properly trained and qualified to drive and handle it since it is a larger car with the ability to tow another car. It is easier for wreckers to get in a rollover accident simply from making a sharp turn, due to their heavyweight. Who is liable?

These cases are based on negligence, which is determined by finding if the other party owed you a duty of care, breached that duty of care, your injuries directly resulted from their actions, and you suffered actual damages and losses.

A wrecker accident due to a defect or malfunction is typically the fault of the company that owns the wrecker or the company that manufactured it. It would be the company’s fault in the event that it was improperly or irregularly maintained or inspected. The company has a duty to its workers to provide them a safe working environment and equipment. By failing to regularly and properly inspect and maintain the wrecker for safety, they are acting negligently. The manufacturer would be at fault under product liability laws if the defect was inherent in the design and construction of the machine itself. Product liability laws aim to protect consumers from products that pose harm to those who use it. If a wrecker causes a serious accident that causes injury to someone due to a design defect, then the victim or loved ones can sue the manufacturer of that yarder.

If the accident was due to driver negligence or inexperience, the company that owns the vehicle can likely be found liable for the damages. This would be due to negligent hiring; the company negligently hired an individual who was unqualified for the job to carry out their task.
