They repossessed my car during the COVID19 pandemic. I'm paying 2 times the amount for the car. The car had to have the thermostat replaced, it has recalls on it. They sold the car cheap, but sold it to me high as hell. They are ripping off people who really need help. I have no job I have no income why are they calling me harassing me. Tell me to borrow money from family to pay them off. The nerve of them in this lockdown. This company needs to be stopped with these unfair practicing..

Westlake Financial is beyond a nuisance collector and harass me beginning day 31 of a missed payment. On average, they call me anywhere between 8 and 12 times a day, from always different, always random, local And toll free numbers. Upon answering, If you do, your hung up on and then contacted back within 30 seconds. They won’t get off the phone until a payment arrangement is secured. They call 7 days week week, sometimes before 8 am and a lot of times after 9 pm. Sometimes I’m charged fees for the arrangements put in place per their “policy” and other times I’m left with no fees to setup the arrangements. Is all of this harassment and robo Calling allowed???

Westlake financial repossessed my vehicle. They never sent me a letter for me to get my personal belongings. I was only given an 800 number to call after I repeatedly called them. I was never able to get anyone from the 800 number to call me back. I ran a search on the number and it came back to repo management company. They told me they didn’t have to give me the wrecker company name and that my personal items were not available. I told them I wasn’t notified and didn’t know how to retrieve them. They told me that was on me and not them. I had a lot of personal belongings that i never got back. I need help.

Westlake Financial repossessed my car they hired Benchmark who towed the car and put it in the garage where almost all my belongings disappeared from inside my car, cameras, lenses, ipod, connection cables, toolbox, soccer balls, they still forced my car to open the engine, denting the entire hood of the car, and also smeared the car seats with paraffin. This theft happened after I paid the 2 installments in arrears and 1 installment for the month of July. I tried to get the car back the next day, but the Benchmark garage only allowed me to get the car a week later claiming that they didn\'t have the time or appointment to return my car. I stayed a week without a car and everything was already paid for, my loss on my work material that was in the car was something around 3000 dollars, apart from the time that I didn\'t have the car to work. Thank you very much Westlake Financial and Benchmark because in the company\'s garage my work material was stolen by Benchmark\'s own employees, really we are the people. Now in addition to all the damage they did they are charging me for the next month U$ 1329.56, but my monthly installment is U$ 579.56.
In July I paid Westlake US$ 1279.00 with the interest of 2x por late payments plus the installment for the month of July which was exactly US$ 579.56. My car is a 2017 Toyota Prius and I\'m paying it like the price of a Mercedes. Can you from America’s Consumer Lawyer can help me.

Westlake Financial harrasses me every month the day after my payment is do even when i had surgery (a hysterectomy) and had to be off of work for to months and asked for a deferred payment thay required me to tell them why i needed it and i was embarrassed for having to divulge sick personal information.

Westlake portfolio calls me after 1 day of late/ missed car payment. When I do try to make payment arrangements due to my pay dates they tell me that won\'t work, and that they will not document the call and will continue to call and they do. ALL day long. They clog up my voice mail and it is an extreme headache.

Westlake Financial calls me 7-10 times a day from multiple numbers. When I told them they were harassing me, they stopped for a couple of days, but then started up again. I\'ve asked what other payment options I have and they won\'t give me any help. I\'ve also asked to refinance to lower my payment and they say they can\'t do that either.

This company calls me an average of 6 to 8 times and leaves multiple voicemails everyday. And this info is based on the phone numbers but that registered to them. I get numerous calls from other numbers labeled \"High Risk\". I feel confident the majority of those calls are from this company as well. These calls disrupt my entire life. They come at all hours of the day. A lot of times I am at work and I use my personal phone as a business phone as well. The are contacting me regarding a balance that originated with Byte. They insist I owe for dental aligners that were guaranteed. However, I have recieved 2 half sets of aligners and neither set has fit correctly so they have been useless to me. The first aligner in the second set I received was so tight, it broke one of my teeth when I attempted to remove it. So I am being harrassed beyond belief for a debt I do not owe for a product that caused damage to the very thing it was supposed to improve.

I was in a accident. It was clearly the other person\'s fault, but no body was cited. My insurance paid about 60 percent of the value of the car and assured me that the other party\'s insurance would kick in. It never did. I didn\'t have a job for many months. They were relentless calling 7-10 times a day. I made payments as I could but they didn\'t make a dent in the amount as they just charged more interest. Their agents are aggressive and rude and continue to harass me day and night. I\'m happy to come to some reasonable arrangement, but reasonable doesn\'t seem to be in Westlakes vocabulary.

Westlake is calling several times a day. When I answer their calls, they insist I must verify who I am. THEY called ME! I am set up on auto pay at my bank. I pay early AND more than the minimum. When I call in, it shows there are no problems with either of the accounts I have with them.

Westlake Financial is my car loan note holder. When i get late on payments they start blowing up my phone. Sometimes they will call me 3 times in a row, sometimes 6 times a day. On average they call me 40 times a week from various numbers with various names on the caller ID, Even if i have a payment arrangement set up, they will still call me over and over again.

Hello I am having an issue with Westlake calling me 9-12 times a day on my phone and I\'ve expressed to them repeatedly that the dealership I purchased the vehicle from sold me a lemon and a warranty that doesn\'t cover anything that turned out to be wrong with the vehicle. I am currently about to lose my home from putting so much into the car to get it fixed so that I can get back and forth from work and they do not understand. The dealership told me I should either just keep paying the note and get the car fixed myself or let it go and let it ruin my credit.

Westlake Financial repossessed our car and I\'ve proven to them with letters from the bank and my full bank statements that payments were made. They stated they must have been credited to wrong loan / account but still haven\'t released my car and are demanding I pay the the balance of my entire car loan off before they\'ll release my car to me which is $16,900 plus their repossession fees and storge impound fees. This had noting to do with me I lived up to my contractual agreement, they wrongly repossessed my car .

I got a car loan through west lake. My payment date was changed not by me now its due the 2nd I have asked many times to change it back they wont. They start calling the day it is due over 20 calls a day. I have paid over 15,000 in interest alone and i am not even sure that allowed. Its a lot more than i can put in this box.

I received 4 to 6 calls a day, equalling 205 calls in 54 days from Westlake Financial. I was NOT a party to the debt. They did not have permission to use my number to talk to my adult son who had his own phone and they had that information. They masked the phone numbers (16 unique phone numbers), trying to call me. I have screenshots of the calls. I reported them to the CFPB, and Westlake immediately responded and said even though I wasn\'t a party to the debt, they legally called me. I have the letter they submitted. I have made a complaint to: CFPB, CA and ID Attorney general\'s offices. I have submitted letter to Westlake and nothing has been done and there has been no response since the initial letter.

**Potential Consumer Protection / Wrong-Party Collection Case – Westlake Financial**
I am seeking an attorney experienced in consumer protection litigation, including the Telephone Consumer Protection Act (TCPA), debt collection practices, privacy claims, and related Idaho consumer protection laws.
### Summary of Events
Between approximately **June 20, 2024, and August 13, 2024**, I received **206 telephone calls** from **16 different phone numbers** associated with Westlake Financial while they were attempting to collect a debt owed by my adult son.
I was **never the borrower, co-borrower, guarantor, or signer on the loan**, and I had no contractual obligation or financial responsibility for the account.
My son had his own telephone number and had already been communicating directly with Westlake regarding voluntarily surrendering the vehicle.
My only involvement was attempting to help him coordinate the voluntary return of the vehicle during a difficult financial period. I never signed any documents, never assumed responsibility for the loan, and never agreed to become Westlake\'s collection contact.
### Nature of the Calls
During the calling period:
* I received approximately **206 calls in less than two months**.
* Many days involved **4–6 calls**.
* Calls came from **16 different originating numbers**.
* Every call I answered began with a noticeable pause before a representative came on the line, which caused me to believe the calls may have been initiated through an automated or predictive dialing system. I cannot state whether every unanswered call was handled the same way.
* When representatives came on the line, they asked for my son.
I repeatedly informed Westlake representatives that:
* They had the wrong person.
* This was not my son\'s phone number.
* I was not responsible for the debt.
* They needed to stop calling me.
On multiple occasions, representatives disconnected the call while I was attempting to explain that they had the wrong person and before I could finish asking them to stop calling. They would not discuss the debt collection calls with me; therefore, I was NOT a party to the debt.
Despite my repeated requests during the calls I answered, the calls continued.
### Documentation
I possess documentation including:
* Screenshots of approximately **206 calls**.
* Records showing the dates and times of the calls.
* Documentation of the **16 originating phone numbers**.
* Screenshots saved shortly after the events occurred.
* Written correspondence from Westlake acknowledging that I was **not a party to the loan**.
I also verified that the telephone numbers used to contact me route back to Westlake Financial when called.
### Impact
The repeated calls significantly affected me.
I receive **Social Security Disability Insurance (SSDI)** due to a diagnosed mental health condition. During the period of repeated calls, I experienced increased anxiety, difficulty sleeping, panic attacks, social withdrawal, and fear of answering my telephone because I did not know whether another Westlake call would be waiting.
### Company Response
After I submitted formal complaints, Westlake disputed aspects of my allegations and asserted that I consented to being contacted.
I dispute that position.
While I voluntarily contacted Westlake on my son\'s behalf to assist with arranging surrender of the vehicle, I did not become a borrower, guarantor, co-obligor, or collection contact by doing so. I never signed loan documents or any written agreement authorizing repeated collection calls directed to me.

### Legal Issues I Would Like Evaluated
I am seeking an attorney to evaluate whether these facts support claims under applicable federal and Idaho law, including but not limited to:
* Telephone Consumer Protection Act (TCPA)
* Fair Debt Collection Practices Act (to the extent applicable)
* Idaho Consumer Protection Act
* Invasion of privacy / intrusion upon seclusion
* Other state or federal consumer protection claims that may apply
I would also like an attorney to evaluate whether my disability status under SSDI has any impact on available remedies under Idaho law.
I understand they are a first-party debt collector, but they are still bound by laws that prevent harassment and calling 3rd party non-related people for debt collection.
Westlake also denies that they use an auto-dialing system but at the same time, deny calling me 4 to 6 times a day which I have screenshots of the calls in question and called each one of the numbers and verified they were in fact from Westlake Financial.
I have preserved extensive documentation and can provide call logs, screenshots, written correspondence, agency complaints, and Westlake\'s written responses for review.
