Law 510 ILCS 5/16 states:

If a dog or other animal, without provocation, attacks, attempts to attack, or injures any person who is peaceably conducting himself or herself in any place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages to such person for the full amount of the injury proximately caused thereby.

This means that to prove that the owner of a dog, or other animal, that has bitten is liable for the bite, the injured party must prove three things:

  • The dog or other animal attempted to attack, attacked, or injured the victim.
  • The victim had the legal right to be in the place where the attack occurred.
  • The dog or other animal was not in any way provoked into attacking.

3 Common Ways Dog Bites Can Cause Disability

  • Infection – Mouths are ripe with infection and dog’s mouths are no different. A dog bite exposes an open wound to these potentially harmful bacteria which can cause secondary infections and complications, which can be life-threatening.

Types of Disabilities

Following a dog bite attack, you may suffer from a disability. There are three types of disabilities, each with its own value in a settlement or jury verdict.

The three types of disabilities include:

  • Temporary Disability – Temporary disabilities are the most common type of disability after a dog bite. These are minor injuries that will eventually heal, but still impair you for a short period of time.
