What if the deceased person survived for a period of time after sustaining injuries?

When some people think of wrongful death, they may assume that the individual died just after the accident occurred. This is not always the case, though. There may be a period of time that the deceased person survived after an accident. In this situation, the family of the deceased may still have a valid wrongful death claim. It does not have to be instant death to be valid.

For example, a car accident may involve the victim to be bedridden and on medical support for weeks or months after the car accident. If the doctors have done everything they can to help the patient yet they still die as a result of the accident’s injuries and/or complications, there can still be a valid wrongful death claim. Notice that the death must be attributable to the consequent injuries and/or complications from the accident. The key idea is that this death must be traced to someone’s negligent or intentional actions that caused it.
