A premises liability accident is when a person gets injured on another party’s property. When this happens, as long as the injured party is not a trespasser, Illinois law allows the injured party to sue the owner of the property for being responsible for negligence and causing their injury and any damages that occurred. There are various types of responsible parties in premises liability cases. One of them is known as a renter or lessee.
A renter or lessee is similar to a property owner in that they are responsible for the property for a certain time period. Although, depending on the circumstances of the case, the property owner may be liable to some extent. However, a renter or lessee is liable for the surroundings that they have control over to prevent the things that may pose a hazard to affect those that come on to their property. Oftentimes, this can be more clear after looking at the rental or lease agreement. Your attorney will assist you in determining who should be at fault. If any party breached their duty of care owed to invitees or licensees that entered the property, you may sue them for negligence.
