According to Section E [1.5] of the Illinois Dramshop Practice Act handbook issued by the Illinois Institute for Continuing Legal Education (IICLE):
“The amount of compensation that can be recovered pursuant to the Dramshop Act is limited by statute. Subsection (a) of the Dramshop Act mandates that the State Comptroller determine each year the liability limits for causes of action brought under the Act in accordance with the Consumer Price Index-U during the preceding 12-month calendar year. 235 ILCS 5/621(a). The 2015 Dramshop Act liability limits reflected a 0.76 percent increase in the amount that can be recovered pursuant to the Act based on the Consumer Price Index-U increase published by the United States Department of Labor.
The liability limits for causes of action involving persons injured, killed, or incurring property damage on or after January 20, 2014, shall not exceed $65,511.99 for each person incurring damages. For causes of action under the Dramshop Act for either loss of means of support or loss of society resulting from the death or injury of a person on or after January 20, 2014, the judgment or recovery shall not exceed $80,070.21. The liability limits are adjusted on January 20 of each year.”
