If, within the past 36 months

More than 60 days following the enforcement of your auto insurance policy, your auto insurance carrier may cancel your coverage if, within the past 36 months:

  • You or anyone living in your household or customarily using your vehicle has been addicted to narcotics or other drugs; and
  • You or anyone living in your household or customarily using your vehicle has been convicted or forfeited bail for:
    • Any felony;
    • Driving under the influence (DUI) of drugs or alcohol;
    • Criminal negligence leading to death, homicide, or assault of occurring out of the use of the vehicle;
    • Intoxicated while in or about to use the vehicle or having it in custody;
    • Fleeing the scene of an accident without reporting the incident, theft, or any unlawful seizing of the vehicle; and
    • Making false statements while applying for an operator or chauffeur’s license.
According to the Illinois Department of Transportation (IDOT), “Effective January 1, 2003, an insurer is prohibited from canceling your Auto policy solely on the basis that one or more claims have been made against any policy during the preceding 60 months for a loss that is the result of a hate crime committed against the person or property insured if the insured provides evidence to the insurer that the act causing the loss is identified as a hate crime on a police report.
