If within 30 days of the cash settlement you are unable to find a replacement vehicle similar to yours, for the price determined by your insurer, your auto insurance policy may still give you additional rights. If you’ve found a vehicle that costs more than the settlement, you may opt for one of the following:
- Your insurer may pay you the difference between the original settlement and the substantially similar vehicle you’ve found or try to purchase the vehicle for you;
- Your insurer may try to find a comparable vehicle for the market value of original settlement; or,
- Your insurer may invoke the Appraisal Clause of your policy.
Your auto insurance carrier must provide you a written notice of the procedure once your vehicle is deemed as a total loss. A chart provided by the Illinois Department of Insurance, under the Total Loss Auto Claims with Your Insurance Company, Rights of Recourse should help you determine the average cost of an auto. The value may depend if parts are not listed in the guidebook or due to old, unrepaired damage or excessive wear and tear.
