Proving a Sexual Assault Case in Civil Court
Proving a sexual assault case in civil court is comparatively easier. This is because in civil cases, the standard of proof is lower as opposed to criminal cases where the defendant must be proved to be guilty beyond a reasonable doubt. In a civil lawsuit, your legal counsel need only prove that the defendant, more likely than not, committed the crime.
In a civil sexual assault case, however, time is of the essence. While the Illinois Senate abolished the “statute of limitations for all felony child sexual abuse and assault crimes,” civil cases still have limitations depending on the age of the victim. If you have been assaulted past 18 years old, you may only file a civil case two years following the incident. After the said timeline, you may be barred from collecting damages. If you have been abused as a child, you may file for a civil lawsuit against your offender within 20 years following your 18th birthday or the time you discovered you were abused as a child.
