Who is SmileDirectClub?

SmileDirectClub is a “teledentistry” service based in Nashville, Tennessee, which helps customers to straighten their teeth from home. Founded in 2014, it has been accredited by the Better Business Bureau (BBB) since that year. SmileDirectClub maintains nearly 400 physical locations and is backed by “Camelot Venture Group.”

The BBB has received over 2,600 complaints from consumers in the past three years about SmileDirect Club. According to the BBB:

“Specifically, consumers allege being given a timeline in which they will have a certain ‘smile’ and the results they see do not meet their expectations. Consumers allege being given a timeline in which they should expect a response, refund or delivery of a promised item that does not arrive within the stated SmileDirectClub given timeframe. Consumers report dissatisfaction regarding their experience and as such request a refund from SmileDirectClub and report having difficulties reaching a resolution. Additionally, consumers report issues with their payments being reflected on their account and in some cases, consumers allege SmileDirectClub lost their check payment on multiple occasions.”

SmileDirectClub Lawsuits

If you want to know just how unhappy consumers are with SmileDirectClub, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. SmileDirectClub Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if SmileDirectClub violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If SmileDirectClub took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. SmileDirectClub, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did SmileDirectClub continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If SmileDirectClub is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens with an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. I used smiledirectclub during 2022 for what was supposed to be 6 months turned into about 8 months. It ended up shifting my jaw to the left and now it clicks, sometimes painfully. There are times where if I am to move my jaw wrong, it feels like it\'s going to dislocate. When I bite, my teeth are not flush with one another, so that puts more pressure on other teeth. With the jaw pain, it sometimes swells and causes extreme neck pain and headaches. It also didnt fix one crooked tooth on the bottom, even with extra trays. I had received 3 weeks worth of mis-made trays, some of the teeth were missing in the mold. I would go so long without a new tray for weeks, as their processing always took 4-6 weeks. Because of the long wait i would be stuck in the same trays for up to 4 weeks, they cracked a lot and were barely usable by the end. I\'ve had to resort to an orthodontic practice that does invisaline to fix my bite.

Hi, I need an attorney to represent me in Michigan. I was behind in my healthcare finance direct payment. I got caught up. HFD continued to go into my account and take $25 + my monthly payment. I disputed the additional monthly payments because I didn\'t agree to it. They\'re adding late fees to my account because I disputed them going into my account and taking out extra money every month. The manager rudely told me that he could go into my account whenever he wanted because of the contract I signed. He said I had to pay them back for disputing the monthly amount.

SDC ruined my bite and did not fix my teeth. They sent me aligners that did not fit and encouraged that I still used them. I stopped paying because they did not fix my teeth. They sent my account to a collection agency and harassed me for months. Tehy never submitted my case for a refund back in december 2022

I would like a pay for deletion or to possibly be compensated due to the amount of calls and text messages I\'ve received over the years and they are making it extremely hard to pay it off or even get more info. I have been trying to cancel my Smile Direct Club for over a month. They constantly tell me to wait 4-6 days but no one ever calls. I notified my credit card, they reversed charges not the 3rd party financing says I am overdue. They put me in a 30 day hold. I need help canceling my membership and preventing this from damaging my credit. I have not used the aligners and are happy to return them. The company has so many barriers I cannot get through to my account manager. It has been 6 weeks of me trying.

I have been trying to cancel my Smile Direct Club for over a month. They constantly tell me to wait 4-6 days but no one ever calls. Smile direct club will be sending my case to a judge for me not making payment when I told them “representative “ to cancel my smile direct club. When I first sign up they sold me a story that their liners would fix my teeth. After noticing for a while that it only closed my gap which wasn’t a big deal it was my side teeth that was the problem. After noticing not a big change I then contacted another representative and he tells no that it won’t fix my side teeth so basically I was sold a dream . Even the 3D model was a lie. I stop making payments after trying to cancel differ occasions. They didn’t return calls but mange to get in contact about a payment.

I started my treatment with Smile Direct with a lifetime guarantee for services and outcome of treatment. I have had issues repeatedly with proper fitting retainers, poor doctor care/oversight of treatment. I have had very little doctor to patient communication or check ins although I have reached out several times. Now, the company has filed bankruptcy and are expecting continued payment for services that were incomplete. Not to mention, I found out I was being over seen by a dental provider that was at risk of losing his licensing in the state of California. I would like to see what options I have to sue the providers who failed to provide adequate and safe dental treatment, for damages and the upcoming treatment I will need to undergo to start with a new dental provider to correct/continue this ongoing fiasco.

Hello, since SmileDirectClub went bankrupt, they have still been requesting the monthly payments (even though I never got my final aligners and was not even close to being done). I paid off my SmileDirectClub balance in full Feb 4 but the creditor, HFD, keeps contacting me saying the payments didn’t go through despite my bank saying they took the money. They tried taking money from my account since I’ve paid it off and the balance I “owe” is increasing with interest. I have sent them proof of payment and proof that the account showed 100% paid, to no avail. They still want more money.

SmileDirectClub went out of business, and while I did receive the plastic retainers/trays, I was left without access to an orthodontist to check my teeth. I SIGNED UP WITH SMILE DIRECT CLUB IN OCTOBER 2023 FOR MY DAUGHTER\'S ALIGNERS AND ENTERED A PAYMENT PLAN. THEY CLOSED AND FILED FOR BANKRUPTCY IN DECEMBER 2023. NOW HFD INSISTS THAT WE CONTINUE PAYING EVEN THOUGH SMILE DIRECT CLUB IS NO LONGER PROVIDING THE SERVICES THEY PROMISED. WE ALREADY PAID OVER $1,000 FOR THE ALIGNERS BUT ARE NOT RECEIVING ANY SUPPOT NOR SERVICE AS PROMISED. I DON\'T THINK WE SHOULD CONTINUE PAYING FOR SERVICES THAT ARE NO LONGER BEING PROVIDED. PLEASE HELP ME PUT A STOP ON HFD\'s HARASSMENT. HFD SHOULD GO AFTER SMNILE DIRECT CLUB AND NOT THE CUSTOMERS THAT WERE FOOLED.

My spouse and I both got Smile Direct Club with the guarantee and then they shut down. I wrote certified letters to them to use the guarantee and cancel our contracts. They said they no longer honor the guarantee and I\'m stuck paying for services they no longer provide. How can I felt out of these contracts without being sued and without harming our credit?

I am actually from Canada and financed my treatment with SmikeDirect and didn’t get the retainers and my teeth have shifted. My “Retail Installment Contract” states the credit is provided by Smile Direct and HFD is the payment processor. I talked to HFD and they said they are the financer and that if I don’t continue to pay, I will be taken to collections. Need to find out if I can legally stop paying HFD.

Smile direct club never sent me my new aligners before they went bankrupt. I have been making payments to HFD. I told HFD to stop taking payments since they take random amounts without my permission. My account was almost paid for or is paid for. They won’t send me what I owe. My bank had to step in.

I received a phone call from a debt collector from smilesdirectclub that I am being sued for $1000, and if payment was not collected they would garnish my wages and freeze my bank account. However, I was not satisfied with services and tried to cancel numerous times, and was never contacted back on how to go about canceling. I last used their services in 2019.
