Ability Recovery Services Complaints

The Fair Debt Collection Practices Act (FDCPA) is a federal law which applies to everyone in the United States. In other words, everyone is protected under the FDCPA, and this Act is a laundry list of what debt collectors can and cannot do while collecting a debt, as well as things they must do while collecting debt. If Ability Recovery Services is harassing you over a debt, you have rights under the FDCPA.The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Ability Recovery Services violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Ability Recovery Services took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Ability Recovery Services, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. If Ability Recovery Services is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.Several states also have laws to provide its citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. If you live in North Carolina and are being harassed by a debt collector, you have leverage to obtain a great settlement.

They also said that they would notify the bureaus of my paid-in-full account and send me a letter stating that they’ve done that and they haven’t!!! The bills I’ve paid in full to other agencies, they’ve sent me both of those and they are already off my credit score, but this one is not.”
  2. “Got a call saying I owed a bill for $310. So I paid it and they said it would come off within a month. That was the end of March. Now it’s the end of July and it’s still in my credit report. So I disputed it saying it was paid but these clowns sent back to Equifax that they were reporting the correct balance even though I should no longer have a balance. So I call the number on my report that says to contact with further questions. No one picks up. I go to their website and call the number there. No one answers. Are you kidding me? I’m trying get my report straightened out to buy a house and they’re messing with that while I’m stuck here waiting with no alternative on what to do.”

Called today to see about working towards removing the debt and the girl was rude, patronizing and simply told me she doesn’t know who I spoke to before, but she can’t help me with my credit report until the debt is paid off. Then hung up on me! This is not a credit card debt that I ran up through my own fault…it is a mystery medical debt that even the hospital cannot find!! Probably a scam…just really wanted to wipe it from my credit score. Just don’t let them get ahold of your debit card information…mail your payments instead!”

Can Ability Recovery Services Sue Me?

Although anyone can sue anyone for any reason, we have not seen Ability Recovery Services sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. If Ability Recovery Services has threatened to sue you, contact Mike Agruss Law as soon as possible.

Can Ability Recovery Services Garnish my Wages?

No, unless they have a judgment. If Ability Recovery Services has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above. If Ability Recovery Services has threatened to garnish your wages, contact our office right away.

Hello! The Account Recovery Services stated they had no account in my name. Now, they have an account; an alleged online bill of $1,820.00. The school dictated a(n) 50% discount; I did decline. Time decay, the Account Recovery Services offered $500.00 by me online with the erasure and deletion of the account; the monies accepted, but, the erasure never arrived; but, a deduction of the total in the $500.00 amount. The memo and the statement of ledger also dictate the offer that was accepted; but, the erasure is yet to be received. I want a refund of the entire $500.00, or, an agreement of the erasure as offered. Not a a deduction of the $1,300 offer of the telephone conversation either. Common sense in business etiquette. Ability Recovery Service has 2 submissions on my credit report. When I contacted them in October, they were supposed to send me a letter on the exact debt owed. I never received it. Now it is February and this is slowing my mortgage loan approval so contacted ARS again requesting a payment plan (in which I have no choice in order to be approved for mortgage with a new company). I made the 1st payment of $100 and requested a letter stating payment arrangement which they refuse to provide. Last week they were supposed to at least send a letter stating a debt owed again. I have yet to receive it.

Ability recovery says I agreed to pay an amount towards a debt that was already paid off. Had hospital email, but still being harassed.

Hi Kathryn. Once your debt is assigned to a debt collection law firm, you will typically receive a letter requesting that you pay your debt. You're not being sued yet, you will usually have 30 days to respond and/or dispute the debt or show that the debt has inaccuracies. If the letter is correct, you have a few options including disputing the repayment request, negotiating a settlement, or filing for bankruptcy. They called me and said they could not tell me what the matter was about without confirming it was me so I said yes it is and demanded to know what the matter was about- next he asked me for the last 2 digits of my social security number and I told him I was not providing another thing without more information and I hung up. I just paid all but one collection accounts off except for one on my credit report which is NOT with them I\'ve already confirmed so I am about to just block the number they called from and any further they try to. I usually don\'t answer the phone anyways and I\'m on the do not call list but I feel like I\'m getting scammed. I filed bankruptcy in 2017 and all was discharged. I disputed and won a half dozen items on my report, paid the rest, and have one left to pay and its not with them. Wouldn\'t it be on my credit report? And if it\'s not I could give a crap about it and I\'d never give this joke of a company any payment information or trust them from the reviews.

A claim showed up on my credit report from ability service recovery for $1,049 for hospital visit on July 20,2023 I wasn’t at the hospital that day I contacted original creditor they have no idea what this is! An can a collection agency call everyday?

I have received over 7,000 worth of bills from this creditor from the ambulance company here in Kansas City. I let the ambulance company know I needed proof of these bills and they told me they do not have proof and sent the debt to Ability Recovery for ambulance bills I\'m not responsible for. I\'ve written this company and have disputed these bills and they will not show proof or take these off of my credit report!
