I received a debt collection notice from Nelson & Kennard for an alleged Capital One debt. I disputed the debt and requested validation, but they ignored my requests for months. Then, they aggressively attempted to serve me a lawsuit summons at my home, unlawfully entering my secured building multiple times. However, when I contacted the court, I found out no lawsuit was actually filed.
Later, they sent another debt notice with a higher balance, adding a $65 “personal service” fee—despite never filing a lawsuit. When they finally responded to my validation request, they only provided old credit card statements and a ledger but no proof that they have the legal right to collect this debt (no contract or assignment agreement from Capital One).
I believe Nelson & Kennard violated the FDCPA by failing to properly validate the debt, misrepresenting legal action, and charging an improper fee. I am seeking legal help to get the debt dismissed and potentially take action against them for their violations.
