Aqua Finance Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Aqua Finance violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Aqua Finance took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Aqua Finance, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Aqua Finance continue to take electronic payments after you told them to stop? The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Aqua Finance is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop Aqua Finance’s debt collection. Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often to do to violate the law. 

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery.   2. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

I financed a water system for 10k through Aqua Finance. It has not worked since I got it. I've filed complaints through the BBB and they refuse to take this system back. I just want it out of my house and the payments to stop. I've been dealing with this for over a year now.

A lien was placed on our house and we had no idea. We were told it was on closing documents and it is not. Went to refinance house to find this lien. The said we had to pay $100 for a temporary removal. Would like to know our rights.

We were lied to by a salesman that we were getting a whole house water filter/softner. He also lied about the two years supply of products that came with it, Now, we have a lien on our home. Aqua finance closed their account on our credit report two years ago but continues to report us as late on payments to negatively affect our score.

Aqua financing has been pulling some shady business dealing . They won’t stop calling me 2 time a day every day. They have raise my monthly payment from $83.00 to $335.00 . I pay them $225. In Dec 22,2020 which caught me up , so I thought, then this bill now $335. , after research this company been charging me higher payment each month for the pass year. First of all they never live up to what they’ve promised in my home. The water is bad my commodes are completely stained when this house is only three years old. They said my toilets would never stained , if , I put this water system in it’s ridiculous looking. They don’t stand behind what they sold me , and I never agreed on a 3 rd party financing I thought I was financing through aqua water. Please call they are harassing every day.

I'm not currently behind on payments to Aqua finance but was wondering if you could negotiate a less than balance payoff? I really want to get away from Aqua so many horrible reviews I was pressured to take the deal on the spot didn't get chance to do my research

I just got aqua fiance as my loan company. After finding out all the complaints about them I am scare that they will hurt my credit or put lean against my house. I will pay my bill on time through mail sending my check but I just can't trust them after learning about them. I found your web and gave me some peace of mind. I have a loan with Aqua finance I needed to get my basement waterproofed. When I signed the contract I was working and had a decent income. I also did read the contract completely before signing. I am now on a fixed income and having difficulty paying this loan. I did miss payments and the called and told me they will place a lien against my home and they could have me evicted as they would own my home. Unfortunately the payments are high as is the interest I financed 16000.00 and will end up paying 27000.00 they take money every month from my bank account I never receive a receipt or a balance left to pay. They are very rude and when I ask for this to be sent they say they don’t do this. I don’t know if you can help me to get rid of them but I sure would like to do something the original date of the loan was in 2018. Thank you

Hi Nancy. Aqua Finance is not above the law and if you request a debt validation letter, they are required to provide it. They also cannot just tell you there is a lien against you without taking you to court and receiving a judgment against you. I am sure you're frustrated and I would definitely be as well. Hi Zach. It sounds like you're paying towards the interest rate instead of the principal. This is common as these types of lenders want to get their payday first, thus applying your payments towards the interest instead of the principal, which would essentially result in you quickly paying back the exact amount you borrowed instead of the lender getting their "share". Even though it makes sense, it doesn't always mean it is done fairly, especially if the interest rates are sky-high. I moved my house and tried to trade in my equipment or give it back and they wouldn’t allow. Then I tried to mitigate the debt after I lost my job and they wouldn’t work with my debt consolidation company. While I was paying, they took more money than was explained to me, the online portal wasn’t working and they called my cell phone repeatedly telling me I was pass do when I wasn’t.

Aqua finance has been harassing me for a long time now, I have told them I can no longer pay them, they have continued to call me, took payment from my account and left me many messages without disclosing who they were, I also disputed it on my credit report and they never marked it as disputed

We signed up for a water filtration system back in 2018. The sales man told us we would pay $86 per month and on the paperwork that was signed thats the amount it says. When our first bill comes its $150. We called and told them thats not what the paperwork says and they would not work with us on payments. We never sent in any payments due to not being able to afford $150. And would get collection calls. When we tried to makes partial payments i was told I couldn\'t do that and the full amount needed to be paid. Now we are receiving calls saying they have a lien on our property but we were never notified about this or we were not aware or told this was a secured agreement. Aqua Finance Keeps calling me (daily) after I have requested to not be called anymore. They are doing robo calls and won\'t stop. They will not tell me why they are calling without me verifying a bunch of information first.

Aqua Finance has put a lien on the house. I got no notice and now I’m digging around for the contract to see this policy in black and white that they claim in policy. We’ve had the system since 2018. We’re all up to date. We got divorced about 6 months ago. The former spouse lives in the house and apart of our separation agreement is that she will buy me out and together we will split the remaining balance of aqua and pay the balance off first. I received this notice that the lien is on my home. It was in legal terminology so I did not understand and I immediately called the company. The supervisor Leonard Jenkins told me basically that there is nothing the can do, it’s policy and that the only way to remove the lien is if we pay it off in full. He said we could also refinance the water system. We are not able to refinance anything at this point in the divorce if she’s going to refinance the house she can’t take any hits on her credit. She has til Jan 2024 to refinance. I am not able to refinance because I left the house and took the financial burden of whatever I was left with and I also need to be able to buy a house when she buys me out. I feel like Aqua is forcing me to do something I am not able to do and causing me more hardship. This is out of left field and so hurtful right now in the process. Former spouse literally just got back from a deployment (Army) from Kuwait. I am also full time army. This all seems so wrong and they are very hung up on paying the full amount to remove the lien.

I was sucked in by a Hyla vacuum sakes crew and traded them a vintage arcade game for the demo unit. As part of the swap I agreed they could run my credit and set up a zero interest zero payment purchase so they got their commission on the sale (yes I feel pretty dumb). 6 months in Aqua finance starts calling me telling me my 6mo no payment period is almost up and I need to start paying. I explained the deal and why my contract had no payment amount and they just upped the amount. They have now used Aqua, Conexus and Bay Finance to ruin my credit which was stellar up to then. I have filed disputes with the credit agencies only to have them closed even though they all say different amounts and dates. I had to freeze my credit to stop them from doing hard pulls every couple months as well. I was threatened with a ucc lien at one point by one company while being threatened with garnishment by another at the same time. I did file a cfpb complaint which went unanswered and was added to their file but had no impact. These people are deliberately ruining my life and costing me thousands in additional insurance premiums and interest. I’m about to give in and just pay the extortion to stop the fraudulent reporting on my credit. I’d never heard of Aqua Finance and since I wasn’t financing anything I didn’t look them up. I feel like the (unfindable) sales crew let a thief into my home. There’s a lot more, Robocalls, shifting balances, etc but this is the gist of my saga and the hold they’ve had on my credit since 2020.

Hello my son was approached to purchase a softener set up in 2019 soon after moving into his used home. The salesman made statements sounding like he represented the local water utilities company. He was charged $6400 for the set up Has received no supplies or service over the last 4 years. The payoff as of 9/23/23 is $2866.89 so you can see he this company and their shoty business practices are taking him to the cleaners . We have read many other reviews of this company and are wondering if you are able to help in any way? Please let me know if you can . In todays economy my son is struggling to stay afloat and this company is trash!!! Thank you very much

I bought my first house In 2021 with my ex partner and got a water system in 2021. Our water smelled really bad and even after the water system there was no difference in the smell. It had a bad egg smell. I was the co signer on the loan and when we sold the house in July of 2023, my ex partner took the tank with him since we couldn’t send it back and it can’t even be used anymore. He took over the payments for a while and. Now it seem like he isn’t paying for it anymore and I cannot afford to pay for this loan that is not in use anymore and never worked in the first place ! I have been paying over my monthly payment and they have not applied a single penny to my interest. I just made my monthly payment and then today went to pay another $200 and it still should I had $185 of interest to pay that my extra payment would have went to.

Aqua release funds to a pool builder when the pool has not been completed, the builders have not completed project and aqua will not stop calling me, my work place, after informing them i could not take personal calls at work/

I was paying aqua finance from 2019 to 2023 I a as paying on time but I kept getting calls about being late. I was threatened to be sued for over $7000, even after payments of $90 a month for over 4 years.

Last year, Aqua Finance marked my debt on my credit report as delinquent while I was making payments. Shortly, after that I became unemployed and informed them I wouldn’t be able to make payments at the moment, they kept calling me and calling me. Called me at work and late into the evening. Earlier this week, I answered a call and it was them saying I needed to resume making payments despite it showing charged off and in collections on my credit report. They also said not paying them would prevent me from selling my house. I agreed to start making payments if I received something in writing from them stating what we discussed about paying and today I was charged $83 and have not received anything in writing.

In 2020 I was approached by salesmen selling a Hyla vacuum. I was told I could take a credit on my taxes for the air purifier effects of the vacuum and that it would pay for itself in tax credits by year 3. I was not sure I’d owe enough taxes to make that possible so I offered to trade them a vintage arcade game (deer hunter) in exchange instead. The two salesmen discussed and said that they’d trade if they still got the commission from the finance company, Aqua finance. I agreed to let them run the credit check and set up the financing with the understanding that there would be no interest or any other remaining amount due after the financing was approved. I was given a sales contract saying the vacuum was paid for and a financing agreement that said $0 for payments and approved for a line of credit up to $4000. I considered I might be using the credit line in the future and didn’t think much else of it. I was never given the financing and payment agreement that Bay Finance/Aqua Finance finally provided in January of 24 that I swear I did not sign. I got a call about my “loan” about 6 months later and tried to confirm there was no interest or payment due and when it didn’t seem like what I expected I tried to get in touch with the salesmen who left no contact info other than Aqua finance. For a year or so I got frequent calls from Aqua finance or Bay Finance or Connexus Credit Union (where I never signed for an account). They have reported on my credit under all three names at times, threatened me with a lien against my home, and continue to push the legal process to the limit to cause the most possible harm to my credit. I worked with a law firm last year to remove duplicate reporting so they now alternate between Aqua finance and Bay finance reporting a bad debt one month and a charge off the next. Back and forth and they are in fact the same company. Call either number and they forget which one they claimed to be. I also have letters from the same person under both entities. If you complain about collection they are the lender and about the lender they are just a collector. I have reported them to cfpb, bbb and the state attorney general, all of which they answered late and with untruths before further retaliation. I would pay them off to save my credit but they are unscrupulous and I seem to have ticked someone off so I doubt it would help.
