Can OSHA shut down a business?

 

Each year, the Occupational Safety and Health Administration (OSHA), conducts approximately 40,000 inspections. It is a common misconception that OSHA has the authority to shut down a business. In fact, only a court order can completely shut down a business, and that typically only occurs in extreme situations.

However, in the event that an OSHA inspector determines that a hazard poses an imminent danger to a business’ employees, such as a risk of serious physical harm or death, they will request that the workers be removed from the hazard until the situation is resolved. If the employer refuses to follow the recommendations of the OSHA inspector, OSHA has a right to ask a federal court to order the employer to remove the imminent danger.

To prevent bad OSHA inspections, it is best to take an offensive approach and prevent hazards before they can start. This includes establishing and enforcing a safety program within the workplace and making safety a priority every day.
