I'm not sure if this falls under the FDCPA but I was contacted today by Crawley & Bergman for a Syncrony Bank debt. The caller said he picked my account because it looked like I had tried to make payments but then stopped so I must have just fell on hard times and that he went to his bosses and told them this so they wouldn't sue me. I explained that our hours had been cut back and that yes we were trying to keep everything current but we had to focus on not losing our house first and we are trying to pay what we owe. He explained that he could go to management and make a great deal for me so I wouldn't get sued for the total balance and it would only be 1000 paid in full today I said we wouldn't be able to because we only had $700 in our bank account. He said he would go to his boss and see if they could split the payment. I asked him to send it to me in writing via e-mail. He did and I discussed with my husband and we realized we couldn't afford to spend all $700 and have nothing until I get paid next Saturday. I called back and tried to explain this and I said maybe $400 today and $400 on the 28th so he said no they probably won't approve that but maybe I can try. They won't do two payments. He put me on hold and came back and explained how they said no but he tslked them into 3 payments of $400, $400 and $200. I explained I still was unsure if we could do it and I wanted to talk with my husband so that we could agree to something that we can really afford to do and he started saying that I was playing games and that he couldn't take any more requests to management because they would know I wasn't serious about paying so they would take the next steps and he would suggest they sue me. I tried to explain that I'm just trying to negotiate a payment plan that would work and he said well now we are talking about monthly payments for the full amount and you don't qualify for the deal. It was just very aggressive, and I asked him to please just send me the 3 payment option in writing and left it at that. It just felt very aggressive and high pressure with the intent that I pay this today or get sued tomorrow. I'm not sure if this is allowed but I've never had an experience like this before.

Cawley & Bergmann keeps harassing me about debt when I have zero debt. All my stuff is paid off but they keep trying to scam some money out of me. I despise debt collectors.

So I just answered a call from they started off by saying is this Eli avila. I asked him what is this in regards to he stated it’s an important business matter I can’t tell you until you verify your name. I responded with its agaisnt the law if you are a credit debt collector to call and not state who you are or you are collecting a debt you can’t not just ask who I am with out telling me who you are. The guy gets an attitude saying how can you tell me how to do my job or the law when I’ve done this job for 18 years. He got all aggressive and with an attitude so I just hanged up because I am a disabled veteran with ptsd and I don’t need their spam calls or harassment from ruining my day with my son.

I have been receiving harassing phone calls from Cawley and Bergmann over a settlement from a case regarding ZeekRewards. They initially called me in 2020 once the pandemic hit and had no care about my loss of income at the time and have been harassing me since, via phone calls. Upon reading reviews it appeared as if they were a scam so I ignored them and eventually had to block their calls. They then sent my \"debt\" to a collection agency and had an Oregon based law firm reach out to me to collect the debt.; however that law firm said they couldn\'t receive payments on behalf of Cawley and Bergmann and I had to deal with them directly. They informed me that my debt was already in collections and I couldn\'t refinance my house (to be able to make payments) because of a lien they have on my home; later on he told me to refinance if I needed to - that was skeptical to me. Shortly after that call, I reviewed my. credit/debt history and do not see anything owed and I do not have a lien on my home. I\'m mentally and emotionally exhausted and am hoping that you can help. I look forward to hearing from you.

Cawley and Bergmann called me today and was very pushy in trying to get me to pay on an account that I cannot find on my credit report. It may be there but I cannot find it. They wanted me to pay a lump sum and I told them I could not but could pay at least 20 a month to try and get it paid. She said that is not enough and said the minimum I could pay is 75.67 and if I did not do something today that they were going to push this to litigation and I would be going to court. I told her I did not have the money to pay and she said well you used the card and spent the money. I am with Americor trying to pay down all my expenses due to work got slow during COVID and extra expenses taking care of my elderly parents. She was very persistent that I pay today or by Friday they were sending me to litigation. They have called several times and would never leave a message and when I answered did not say they were a debt collector just that this was important business matter. I am in need of help with this situation and hope to hear back from you.
