Do you have problems with over a debt?  You are protected under various state and federal laws.  For example, you have rights under the Telephone Consumer Protection Act (TCPA), the Electronic Fund Transfer Act (EFTA), and the Fair Credit Reporting Act (FCRA).

  • The TCPA has been around since 1991 and protects people from unwanted solicitation calls, robocalls, faxes, and text messages. Under the TCPA, you may receive between $500 and $1,500 for each illegal robocall, text, and fax.
  • The EFTA was established in 1978 and works to protect consumers who use electronic methods of managing finances. Under the EFTA, written permission must be given in order for a company to take an electronic payment from your bank account.
  • The FCRA was established in 1970 and protects the information in your credit report, among other things. If your credit report contains inaccurate information, the FCRA gives you leverage and rights to dispute the inaccurate information in your credit report.

Back in September of 2017 I was offered a forbearance program based on hurricanes. It was explained to me that this program simply added time to the loan and I would essentially just continue my normal payments after the forbearance ended. This was not the case and I clearly was blind sighted. After several frustrating calls which took a number of months I finally received notice that they were raising my APR and payments for the life of the loan. If I knew that this was the case and the program would have been explained I would have never agreed to this. Can they do this!

I have 3 late payments in my cenlar account impacting my credit report. Execpt that I have had this mortgage with Citi for 15 years. It was on autodraft. There was an issue when Cenlar took over, there was no attempt to collect the debt, any communication was being sent to my old address. As a result my credit score was impacted. I can't get them to clear the items 3X 307 dollars.

We are currently trying to refinance our mortgage to payoff a balloon payment from Cenlar that matured Oct 2020. We called to inform them that we are refinancing the mortgage. They told us to keep paying our regular loan payment. When we tried to pay it the payment bounced back. When we called they said the first representative was incorrect that we needed to pay the whole balloon payment. We have kept them updated though out our refinancing process and was assured that they would not report our account as late. Through this process they have called us, my husband and I, once or twice a day. They have also reported our account. We are in the closing process if they run our credit report we might lose our refinance.

I paid off a Cenlar loan years ago, and it still shows up as delinquent on my credit report. I've contacted them multiple times, although never in writing. The last time I was told some nonsense about my loan being so old it wasn't in the system, yet it was still on the report. I'm trying to call them now, and nobody is answering. I'm trying to take out another loan now with a different bank, and this is showing up as a major issue.

Went on forebearance in February, ended September. Immediately put me in mortgage default and threatened me with foreclosure I paid all back payments by September 14. Continually threatened by Cenlar and on October 7th removed money from my account saying it had been misapplied which put me past due again. And deposited money in a “suspense” account and never notified me. Charged me for house appraisal and property inspection after I had paid all back payments. I’m still missing money from my account,

Hi Luciana. It seems like once a mortgage is sold to a new company, it tends to cause some big problems for the consumer. I don't know why these issues arise, but it certainly can hurt your credit, as it already has in your case. I would like to talk with you about this further and I will reach out so we can have a free, no-obligation consultation. Thanks, Mike

Hi Alain. I would need to speak with you about the new parameters of your mortgage to determine if what they did was a violation of your rights. Do you have a contract with them that I could look over? If you do, please send it to my office at [email protected]. I will review it and be in touch to discuss your options. Thanks, Mike
