Civil Claims and Damages Based on Sexual Assault

Victims and survivors of sexual assault may pursue legal action against their perpetrators. In a civil lawsuit, a private individual sues another private individual, business, institution, organization, or even a government entity. A plaintiff may only sue for damages (monetary compensation) in this type of lawsuit as opposed to a criminal case which entails fines, jail time, or other sanctions.

In a civil lawsuit based on sexual assault, the damages will take into consideration your pain and suffering, medical expenses, lost wages, emotional distress, and other applicable coverages. In some cases, this may include an injunction. An injunction is an order for the defendant to do something or refrain from doing something.

A civil lawsuit may be resolved before a trial through a settlement where the parties agree on the compensation. If you win the lawsuit, the defendant will be ordered to compensate for the damages. This may come from a form of liability insurance; however, most insurance carriers don’t cover intentional acts. If this is the case, the defendant will have to use personal assets to compensate you.
