Who is Contract Callers?

Contract Callers is a debt-collection agency based in Augusta, Georgia. The company is not accredited with the Better Business Bureau and has received over 120 complaints via the BBB in the past three years, almost all of which are for billing/collection problems.Consumers allege frequent robocalls, attempts to collect fraudulent debt, harming consumers’ credit reports by reporting already-paid debt, inaccurate documentation, and failure to provide debt-validation.

Contract Callers Lawsuits

If you want to know just how unhappy consumers are with Contract Callers, take a look at the number of lawsuits filed against the agency on the Public Access to Court Electronic Records (“PACER”). PACER is the U.S.’s federal docket which lists federal complaints filed against a wide range of companies. A search for Contract Callers will display over 50 lawsuits filed against the agency, 14 of which originated here in Illinois. Most of these lawsuits involve violations of consumers’ rights and/or the Fair Debt Collection Practices Act (FDCPA).

Contract Callers Complaints

The Fair Debt Collection Practices Act (FDCPA) is a federal law which applies to everyone in the United States. In other words, everyone is protected under the FDCPA, and this Act is a laundry list of what debt collectors can and cannot do while collecting a debt, as well as things they must do while collecting debt. If Contract Callers is harassing you over a debt, you have rights under the FDCPA.

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a rob call because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Contract Callers violates the TCPA. Have you received a message from Contract Callers that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against Contract Callers.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Contract Callers took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Contract Callers, like most collection agencies, wants to set up reoccurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Contract Callers continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Contract Callers is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide its citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC, and you’re harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop Contract Callers’ debt collection. We will send a cease-and-desist letter to stop the harassment today, and if Contract Callers violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages.   1. “I have already paid a different bill collector for the same amount, yet an account in collections is open under my credit report.  I had an unpaid $683.88 **** bill that went into collections a while back, and it was sold to a third party bill collector, ********************. I paid them in full on April 21, 2017. On May 8, 2017, the same bill is back in collections on my credit report but with another third party bill collector called . I cannot get a hold of anyone at their company and they need to remove this debt from collections as I have already paid it off in full.”
  2. “Contract Callers is coming after me for a fraudulent charge from a fraudulent company called TRS Limited. About a month ago I received a collection notice from (CCI). It said I owed $139.97 for goods received from a company called TRS Limited. I never purchased such goods and was never billed for such goods. I have let CCI know this in writing and advised them to look up TRS Limited and they will find it is a scam. CCI now calls me harassing me to pay the bill which I do not owe. I believe they are in on the scam. They are threatening me to mark it on my credit score. This company is either committing fraud or is very ignorant in not knowing who they are collecting for.”
  3. “I have a false debt on my credit report. 10-14-15 I didn’t have an account with national fuel. Or notified of this debt. I received all 3 of my credit reports and they had that I owed 935.00 to a collection agency named CONTRACT CALLERS INC. They claim they were trying to collect a debt for a company by the name of 10 ******************************.they claim I opened this account Oct 14, 2015.Which is totally false at this time period I was residing in Buffalo, New York. This company failed to verify and validate this debt. This company also failed to verify if they were licensed to collect in the state of New York. This company threatened legal action which is a direct violation of the FDCPA.”

Can Contract Callers Sue Me?

Although anyone can sue anyone for any reason, we have not seen Contract Callers sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. If Contract Callers has threatened to sue you, contact Mike Agruss Law as soon as possible.

Can Contract Callers Garnish my Wages?

No, unless they have a judgment. If Contract Callers has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above. Got a call from Contract Callers inc, had my address and last tour social said I owe $1000 to a bank, I've been ripped off for that amount before I owe no one anything not even the IRS I don't know any more than that, never heard of them or the bank City Bank either!

This company keeps on calling 7 or 8 times a day and I think they This company calls me 7 or 8 times a day and I think they call from different numbers at it started with a company name CHE INC were me and my wife to finish off paying a debt of 229.00 and we pay all but 95.00 which we was going to pay which would have been the last payment but they reported to the credit bureau before we made that payment and I dispute and they took it off my credit report but the bad part about it that CBE INC turn it over to CONTRACT CALLERS INC now they are on my credit report of owing $95 they are a rip off and they keep calling day and night

This collection company keeps putting a collect on my credit and I have no idea where it’s coming from— it said that I opened an account with T-Mobile in June of 2019 but I have proof I have been with sprint for the last 18 months.
