Despite the protection that designated crosswalks are meant to provide, thousands of pedestrians per year are injured or killed by vehicles in accidents at crosswalks and these drivers must be held accountable for their negligence. The Illinois Vehicle Code formally defines a crosswalk as: “That part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the traversable roadway, and in the absence of a sidewalk on one side of the highway, that part of the highway included within the extension of the lateral line of the existing sidewalk to the side of the highway without the sidewalk, with such extension forming a right angle to the centerline of the highway.”

Pedestrians typically have the right-of-way at crosswalks, and the Vehicle Code also states that: 1) When traffic controls are malfunctioning, a driver must yield for a pedestrian at or approaching the crosswalk on the driver’s side of the road; 2) A vehicle cannot legally pass another vehicle which is stopped for a pedestrian at a crosswalk; and 3) A driver must yield the right-of-way to pedestrians at any marked crosswalk, stop sign, or flashing red signal (Section 11-904).
