Who is Discover Financial Services?

Discover Financial Services is the world’s fifth-largest credit card brand, behind Visa, MasterCard, Chase, and American Express, and is headquartered in Riverwoods, Illinois. Discover Lawsuits

If you want to know just how unhappy consumers are with Discover, take a look at the number of lawsuits filed against the agency on the Public Access to Court Electronic Records (“PACER”). PACER lists over 5,400 lawsuits filed against Discover in the United States, and there are also likely hundreds of claims filed through the American Arbitration Association. Nowadays, most credit card companies have arbitration clauses, which mean that if you have a complaint with a credit card company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. While it can be difficult to get a fair chance in arbitration, but the good news is we have filed hundreds of credit harassment cases in arbitration, and we know how to aggressively fight these cases against the big banks and businesses even when arbitration is necessary.

Discover Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Discover violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Discover took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Discover, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Discover continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and potential case under the EFTA.The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Discover is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.Several states also have laws to provide its citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have leverage to obtain a great settlement.

Complaints against Discover

  1. “Discover first approved a credit card to someone that was NOT me. Discover then proceeded to tell me that I was responsible for their mistake they had made from the beginning (letting someone else open a card in my name) so I have to pay for the fraudulent balance even though I filed a police report. To top it off, I got notified that I am late on making payments on the card they opened in my name, without my permission, AND they have yet to send me a bill in the mail.”
  2. “I made a purchase from a furniture company for $190.40 and charged it to my Discover card. Discover card overcharged me by $521 although the furniture company clearly stated that I owed them $190.40 and not $711.40. Basically Discover would profit $521. I have been trying to have the $521 charge removed from my account for six months now. Every time I call Discover after 30 minutes of conversation and research the representative tells me that the $521 will be refunded within 72 hours, but it either never shows up on my account or they charge it back. Then I call them again and go through the same cycle. I never dealt with such a bunch of incompetent people like those at Discover Card.”
  3. “I have set up automatic payments for my credit card as of Aug. 2016. On the 5th of every month my bill is automatically taken out of my checking account. Even though these payments are made I receive a notice of late payments and an increase in my payment amount. I have spoken with Discover customer service many times but this issue has not been resolved. I cannot have this affecting my credit negatively but Discover does not seem to help with the problem. I will be calling them again to attempt to solve this problem again.”

  1. “This is one of the worst credit card companies I have ever dealt with!  Don’t waste your time.  They are great until you have a problem.  And when you determine the issue was on Discover’s end, they never even apologized.  They missed posted my payments (2) and sent me all kinds of threatening letters.  I sent them my statement and my checking accounts verifying these were mis-posted, they simply said “make sure you call us right away next time and let us know we made a mistake!”  Huh???”
  2. “Terrible company. I made consistent and on-time payments for two and a half years. Out of the blue they decided to close my account, no call, no email, no letter of the change. I had to find out through my credit report that it was closed.”
  3. “I wish I could give 0 stars. I have had this card since 1999, it was my favorite card…I had an issue with a merchant who charged my account. I tried to resolve it with them with no resolve so I disputed the purchase. I sent in the proof of delivery emails showing the purchase was not valid. I can’t believe after 14 years how Discover treated me so poorly…they kept charging it back on my account after numerous calls & emails telling me it was resolved. I requested by fax my account closed and received email confirmation that it was closed. They could care less, they just closed the account, never emailed me…I always paid my bill so they never get any interest fees so I guess paying your bill is not the customer they want.  So very upset to have to close this account but they don’t even care, didn’t bother to email to confirm the closure and how I’m going to get my cash-back bonus that’s on the account. I’m going to contact the BBB as well, don’t know if that will matter, but it is insulting how they treat a longtime customer.”

  1. Debra P. v. Discover Financial Services – In March 2017, Debra of Milwaukee, Wisconsin, pursued a claim against Discover for violations of the Telephone Consumer Protection Act (TCPA). When Debra was struggling to make payments, Discover began harassing her and making illegal robocalls to her cell phone; the calls continued after two formal requests to Discover that they stop, and then Debra contacted us to end the harassment. The case was resolved in June 2017 and Debra was thrilled we stopped the calls and resolved her case.
  2. Edward C. v. Discover Financial Services – In January 2013, Edward of Clay County, Florida, pursued a claim against Discover for violations of the Florida Consumer Collection Practices Act (FCCPA). Complaints consisted primarily of unlawfully attempting to enforce an illegitimate debt and asserting the right to do so when the defendant knew the right did not exist. The case was resolved in March 2013 and Edward was happy with the results.

Can Discover Sue Me?

Yes, Discover can sue you. Discover can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. I've been receiving 3 to 4 calls a day from 623-643-2547, even on a Sunday! I don't have any late payments and am current on all my payments. I called Discover to inquire why I was being harassed, and they have no clue. However, they promised to put my phone number in their No Solicitation database. But, I'm still receiving calls from them!

Discover Finance has been calling me several times a day. They have called before 8:00 AM and after 9:00 PM and also on Sunday. They were notified that I had filed for bankruptcy with my attorney's information for contact and I requested they only contact the attorney from the date of receipt.

Hi - I need your help!I've been inundated with calls from 800-347-4779 (Discover) and I can't get them to stop. My account is up to date (I've never missed any payments or paid late on any credit card ever), but the balance is approaching my credit limit, so I've apparently been placed on an internal list for some sort of offer or collection effort. They never say anything when I pick up, and leave no message (auto-dialed calls). I've received at least two and sometimes three calls per day from this number every day of the week except Sunday for the past couple of weeks, and it's driving me and my wife crazy. I tried to get them to stop via onine chat (I saved the transcripts) on May 9, and even extracting a confirmation that the number belonged to Discover was difficult at best. The agent confirmed that I was already on their Do-Not-Call list, and said I shouldn't be receiving any calls. I tried again on the morning of May 13, and got nowhere with another agent, who insisted I call another department to make them stop, which I refused to do. My Do-Not-Call status applies to the whole of Discover, and I shouldn't have to contact each department in their organization to not receive calls. I used their secure message system to try again in the early afternoon on May 13, and received a corporate boilerplate assurance that they'd stop. Since then, I received another call later on May 13, two more yesterday, and already one more this morning. I'm continuing to contact them via their message system each time I get another call, and at this point, I've demanded a settlement payment from them of $1,000 per unwanted call for each one I've received since May 9, the date of my first stop-calling-me chat. Of course, I don't expect them to pay me a penny without a court fight, and what I really want is for the calls to stop. If I can make them pay for violating the TCA, which if I'm not mistaken, can cost them up to $1,500 per call, maybe they'll stop harassing me and others that I'm sure are in the same situation.Can you help?I look forward to your email response. Even though I sent a payment over a month ago (see letter below), they continue to call but now there is never anyone on the line to complain to. It is as if they just want to harass me.

I owe 11k which im about 3 months behind. Discovercard calls me 4-5 times a day. I have already tried to negotiate with them to no avail on a lower payment plan!

However, the FDCPA does not typically cover debt collection practices by the original creditor. Discover is notorious for keeping its debts in-house and not only continuously attempting to collect on them, but also suing for them. Hi Mirmohammad. It is common for Discovery representatives to say you're on their "Do Not Call" list but you keep receiving calls. Have you notified them in writing that you want the calls to stop? I am co signed on my wife's loans. They made her pay out of state tuition when she met the requirements for in state rates. She has since graduated and they are calling me multiple times per day on my cell and at work. I have told them in writing not to call my work, they continue to do so.

Discover is about to sue me for a 6000.00 debt. I have nothing. No house No car and No Job. I didn't even know you could sue a homeless person. This is extremely stressful. This all feel apart during the pandemic. What can I do??

FIRST: I am interested only in assistance for which Discover will be responsible for your fees. You need not respond to our inquiry if your services require a payment from me - either up front or later. THE SITUATION: Discover posted a charge to my card (approx Jan 2023) that I did not place nor otherwise authorize. I promptly reported it to them and they removed the charge from my account. They subsequently re-billed me for it. I sent a detailed letter telling them that I did not place the charge and have never received goods (tangible, digital or otherwise) or services from the business who posted the charge to my account. I sent this letter to the address discover provided, and obtained a signature proving receipt of the letter. Discover ignored the letter and began a pattern of daily phone calls. I followed up with a more extensive letter (signature obtained again) demanding that they stop the harassing calls, that they refrain from making a false (bad) credit report, and that they immediately initiate a claim in the Ocean County NJ Superior Court for the money they want if they will not voluntarily remove the charges from my account. They ignored this letter as well and to date have made more than 100 phone calls, and have filed a damaging credit report. Please - I don\'t not want a sales call. On the other hand, if you can truly provide relief at Discover\'s expense, I would like to hear from you.

Discover has been harassing me. I’ve asked them to stop calling and they continue to call, I block them and they call from another number. My account was found to have fraud charges, most of the charges were online fraud and discover found it to be fraud but still added interest and fees. My balance went up hundreds of dollars with no new charges.
