Many establishments which serve alcohol are legally required to have “dram shop liability insurance” (more commonly known as “liquor liability insurance”) and many more have this insurance even if it’s not legally required. It commonly covers physical/psychological damages, assault & battery, property damage, and legal defense costs. But while dram shop liability insurance can help cover costs that might be incurred by the establishment when an intoxicated person causes an accident, it does not automatically release the establishment from legal liability.
Under Illinois state law, a successful claim does not necessarily require that the establishment knew or had reason to know that the alleged intoxicated person (AIP) was already intoxicated when excessive alcohol was served. For example, if the AIP consumed alcohol at multiple bars and then caused an auto accident, the plaintiff (injured victim) may be eligible for compensation from each of those establishments provided that the claim’s basic requirements are satisfied, which are as follows:
- The establishment sold alcohol to the patron;
- The patron caused injuries and damages to the plaintiff;
- The AIP’s intoxication was at least one “major cause” of the plaintiff’s damages;
- The establishment was the “proximate cause” of the patron’s intoxication.
