Fire and Smoke Alarm Failure

People rely on fire and smoke alarm detectors to keep us safe in the event of an emergency. That is the literal purpose of these mechanisms. When the duty to its users is breached, failing to detect a fire or smoke, and it causes you or a loved one injury, then you may consider filing a premises liability lawsuit.

Premises liability laws essentially say that you are able to sue the property owner of a place if you are injured on their property. A fire or smoke alarm failure accident occurs when the detector fails to detect what it is meant to. In this case, a fire may slowly take over a home in the middle of the night while they’re all asleep, causing much more damage and injury than if the detector had worked. Or, perhaps there is fire traveling from the upper level to the basement, where the family is at the time. This may cause great damage all over the house and unbeknownst to the family as they can possibly be trapped downstairs!

From these types of unexpected failures, the residents will find out that there is a fire or smoke only when it is too late. This can cause them to suffer from smoke inhalation, which can block your airways and lead to respiratory failure in severe cases. Or, if there is an undetected fire, residents can suffer from harsh burns throughout several layers of your skin. These tragic injuries may put you out of work for an extended period of time. With a premises liability lawsuit, we will fight for you to recover those losses and be appropriately compensated for them, as well.

Many of these fire and smoke alarm failure accidents occur in residential buildings, such as apartments or condos. In these cases, you can possibly sue the landlord. Fire and smoke alarms should be regularly and periodically inspected to see that they are properly operating and functional. Often times, these fail to work due to malfunctions or improper installation. You also have the option of suing the manufacturer of the alarms, since they failed to live up to their duty. If a certain type of alarm is used that is later recalled, but building contractors still use or keep them, they may also be held accountable.
