Bicycle accidents often result in serious, and sometimes deadly, injuries. Similar to motor vehicle accidents, bicycle accidents involve many of the same issues, and often liability in the accident comes down to a negligent driver. Negligence can take on a variety of forms, but any type of negligent driving puts others at risk, especially cyclists.

At Mike Agruss Law, we represent clients in Illinois who have suffered personal injuries from a bicycle accident, as well as family members who have lost a loved one in a road accident caused by the negligent or reckless conduct of another person. We know that when a bicycle collides with a vehicle weighing at least 2,000 pounds, the odds are not in the cyclist’s favor and the results can be tragic.

Negligence and Bicycle Accidents

In order to receive compensation in a bicycle accident or wrongful death claim, it must be proven that the driver’s negligent conduct caused the accident. Driver negligence is responsible for more than half of cycling accidents on Illinois roadways and can include:

  • Speeding
  • Running a stop sign
  • Drifting into bike lanes
  • Drunk or drugged driving
  • Road rage
  • Distracted driving
  • Dooring

When a cyclist is attempting to recover damages following a bicycle accident, the outcome will depend on two questions:

  1. Did negligence or recklessness on the part of the driver cause the accident and resulting injuries to the cyclist?
  2. Did any actions of the cyclist cause or contribute to the accident?

Both cyclists and drivers are required to follow the rules of the road and they have a duty to exercise ordinary care for their own safety and the safety of others on the road. In a claim involving driver negligence, the cyclist must show that the driver violated that basic care of duty that they owe to others on the roadway.

Cyclist Negligence

On occasion, a cyclist may be responsible for a bicycle accident. If evidence should find that the cyclist is responsible for the accident, it is possible that the cyclist will not receive compensation for any damages or injuries due to contributory or comparative negligence.

If the actions of the cyclist caused injuries or damages to the driver or anyone else involved in the accident, the cyclist may be found liable for the accident, and then would be responsible for those injuries and damages.

Bicycle accidents can be serious. An experienced personal injury lawyer can review your case to determine if you have a case against a negligent driver and help you recover the compensation you deserve.

It’s important to consult with an experienced Chicago bicycle accident attorney as soon as possible to protect your rights and determine if you have a valid personal injury claim or wrongful death claim against a reckless or negligent driver.
