Ocwen Lawsuits

If you want to know just how unhappy consumers are with Ocwen, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by banks and big businesses. While it can be difficult to get a fair chance in arbitration, the good news is we have filed hundreds of credit harassment cases in arbitration, and we know how to aggressively fight these cases against the big banks and businesses even when arbitration is necessary.

Ocwen Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Ocwen violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Ocwen took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Ocwen, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Ocwen continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Ocwen is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide their citizens with an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop Ocwen’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if Ocwen violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. For example, under the FDCPA, you may receive up to $1,000 in damages plus actual damages. The FDCPA also has a fee-shift provision, which means the debt collector will pay your attorneys’ fees and costs. If you have a TCPA case against the agency, we will handle it based on a contingency fee and you won’t pay us a dime unless you win.

THAT’S NOT ALL…

We have helped thousands of consumers stop phone calls.  We know how to stop the harassment and get you money damages. Once again: you will not pay us a dime for our services. We will help you based on a fee-shift provision and/or contingency fee, and the debt collector will pay your attorneys’ fees and costs.

What if Ocwen is on My Credit Report?

Based on our experience, some debt collectors may credit-report, which means one may mark your credit report with the debt they are trying to collect. In addition to or instead of the debt collector, the original creditor may also be on your credit report in a separate entry, and it’s important to properly identify these entities because you will want both to update your credit report if or when you pay off the debt.

THE GOOD NEWS IS…

If Ocwen is on your credit report, we can help you dispute it. Mistakes on your credit report can be very costly: along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or even being a victim of identity theft. If you have a mistake on your credit report, there is a process to dispute it, and my office will help you obtain your credit report and dispute any inaccurate information.

REMEMBER…

If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (FCRA), you may be entitled to statutory damages up to $1,000, and the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision, which means the credit reporting agency will pay your attorneys’ fees and costs. You won’t owe us a dime for our services. We have helped hundreds of consumers fix inaccurate information on their credit reports, and we’re ready to help you, too.

Complaints against Ocwen

If you’re on this page, chances are you are just like the hundreds of consumers out there being harassed by Ocwen. Here are some of the BBB reviews and complaints against Ocwen:

Ocwen became our mortgage servicer immediately upon our purchase of a second home 11 months ago. First we were told to wait 6 months and then send a written request for an Escrow Acct Waiver. We sent our written request after 11 months of on-time payments. Our request was denied. First they said it had to be 12 months, then the escalation manager at Ocwen said Fannie Mae’s policy was 24 months. Well, I called Fannie Mae and their escalation manager told me that the “time needed to have an escrow acct was entirely up to the servicer.” We have no other debt, we have made all of our payments on-time for 11 months, our value-to-loan ratio is very low (about 25% loan), we both have 800+ FICO scores, and our 1st home is mortgage free. What is Ocwen’s problem – is it that they want to hold our money interest-free for another year? Or is it that they have no idea what they are doing? I would rate them “zero” stars if I could…”

“On numerous occasions I have found error with OCWEN on their escrow practices, their knowledge of my loan, and the constant conflicting answers their so-called customer service reps gave on questions regarding my loan. I have proof via emails and letters on the constant mistakes made on my loan servicing by this group. My loan was bought by them, and has been a constant struggle to manage. How did these people ever get a license to start this business, and how are they allowed to stay in business. There is a Cease and Desist order by the District of Columbia regarding escrow accounts and their constant mismanagement. I am currently looking to get out of this loan and also find a lawyer to start a suit.”

“Stay away from Ocwen at all costs! I was lucky and was able to refinance to get away from them. They screw up the escrow and can never give you a straight answer as to what they are doing. I’m in the process of buying a new house now and if I find out that my loan will be sold to Ocwen I will back out of the deal or immediately refinance. There needs to be a class action lawsuit against this crooked company.”

Cases We’ve Handled Against Ocwen

I think you’ll agree when we say that threats and harassment from collection agencies can be pretty intimidating. However, we can stop the harassment and get you money damages under the law, and the collection agency will pay your attorneys’ fees and costs. Here are two cases we’ve handled against Ocwen:

  1. Ryan and Danielle v. Ocwen Loan Servicing – In March 2017, Ryan and Danielle of Brevard County, Florida, filed a claim against Ocwen for violations of the Telephone Consumer Protection Act (TCPA) and Florida Consumer Collection Practices Act (FCCPA). Complaints included harassing phone calls, including robocalls placed to the plaintiffs’ cell phones and continuing after repeated requests that the calls stop.

  2. Mariana v. Ocwen Loan Servicing – In October 2017, Mariana of Cook County, Illinois, filed a claim against Ocwen for violations of the Telephone Consumer Protection Act (TCPA). Complaints included harassing phone calls, including robocalls placed to the plaintiff’s cell phone, all for a debt the plaintiff did not owe.

  3. Linda v. Ocwen Loan Servicing – In May 2017, Linda of Cook County, Illinois, filed a claim against Ocwen for violations of the Telephone Consumer Protection Act (TCPA). Complaints included harassing phone calls, including robocalls placed to the plaintiff’s cell phone after the plaintiff sent a cease-and-desist letter to request that the calls stop.

Can Ocwen Sue Me?

Yes, Ocwen can sue you. Ocwen can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. If you’ve been sued by Ocwen, do not ignore the lawsuit; you may have defenses. If you ignore the lawsuit, the default will be entered and the agency may seek to garnish your wages. If you receive notice of a lawsuit, contact an experienced attorney as soon as possible, even if you intend to represent yourself pro se. If Ocwen has threatened to sue you, contact Mike Agruss Law as soon as possible; we’re here to help.

Can Ocwen Garnish My Wages?

Yes, if Ocwen has a judgment entered against you. If Ocwen is currently garnishing your wages or threatening to do so, contact our office as soon as possible.

Ocwen Settlement

If you want to settle a debt with Ocwen, ask yourself these questions first:

  1. Do I really owe this debt?
  2. Is this debt within the statute of limitations?
  3. Is this debt on my credit report?
  4. If I pay this debt, will Ocwen remove it from my credit report?
  5. If I pay this debt, will the third-party debt collector remove it from my credit report?
  6. If I pay this debt, will I receive written confirmation from Ocwen confirming the payment and settlement terms?

These are not the only things to consider when dealing with debt collectors. We are here to help you answer the questions above, and much more. Whether it’s harassment, settlement, pay-for-delete, or any other legal issue with Ocwen, we at Mike Agruss Law are here to help you.

Top Debt Collection Violations

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt.  Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often to do to violate the law.

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

Frequently Asked Questions

  1. Do I have to pay your fees and costs for helping me with my consumer rights case?  No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee.  That means, either the other side pays your fees and costs, or we take a percentage of your recovery.  Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

  2. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful.  In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide its citizens with an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill.  State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA.  That is, original creditors, such as credit card companies and banks are not bound by the FDCPA.

  6. Are mistakes on credit reports common? Yes! Are you one of the 40 million Americans that have a mistake on their credit report?  Mistakes on your credit report can be very costly. Along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes.  Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or maybe you were a victim of identity theft.

  7. What do I do if I have a mistake on my credit report?  If you have a mistake on your credit report, there is a process to dispute them.  My office will help you pull your credit report and dispute any inaccurate information.  If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (“FCRA”), you may be entitled to statutory damages up to $1,000.00, plus the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision. This means the credit reporting agency pays your attorney’s fees and costs. Therefore, you will not pay me a penny for my time. To speed up the process, please get a free copy of your credit report at www.annualcreditreport.com. You can also learn more about the FCRA and your rights at http://www.agrussconsumerlaw.com/practices/common-credit-report-errors/

I despise Ocwen mortgage company. they are corporate crooks who rake you over the coals to squeeze every last cent they can out of you. Ocwen and Key Bank are both at the top of my evil incorporated list.

Following is a brief history leading up to my situation with OCWEN, the current servicer of my loan: In 1986, my mother, Jean Marie Kelley, purchased a townhome located at 28 Yerba Buena Court, Monterey CA 93940 for $110,000. She lived there until her passing in 2004 after which I became the beneficiary of her Will and inheritor of the property. At the time of her death, the property was unencumbered by mortgages, as she had paid cash for the townhome. I had unpaid taxes and to avoid an IRS lien I took out a loan for $100,000 to resolve those issues. About a year later, the same loan originator contacted me and told me that I could qualify for much more and because my mother had not kept up her property it was in need of many, major repairs. The originator selected a local appraiser, ordered the appraisal, for which I paid, and a value was placed on the townhome of $600,000. Based on that valuation, the originator approved a loan for $340,000. Because my wife and I had moved from Southern California, and are self-employed, the only loan we could qualify for at the time was one with an adjustable rate, starting at 7%. Our plan was to re-establish ourselves in Monterey and refinance the bad loan we were in. Unfortunately, shortly after we relocated the economy collapsed, centered primarily on the real estate and mortgage industry on which our incomes were dependent. As the rate began to adjust up from 7% it became apparent that we were headed towards default. I contacted the holder of the paper, Indymac, and applied for a loan modification. After a year of hoop jumping and stalling, Indymac finally approved my modification, which began with an adjustable 2% negative amortization feature and a $200,000 balloon balance. With our backs against the wall, we reluctantly agreed in order to stay in the home and preserve my mother’s legacy. Ten years later, the balance on our $340,000 loan is approximately $342,000. The rate began adjusting a couple of years ago and now, within a 3 year period my payment will increase by nearly $600/mo. In an effort to forestall this, I reapplied to the OCWEN, now the 3rd servicer, for a re-modification. In the course of providing OCWEN will all off the requested information, I remembered that the property had a 30-year deed restriction on it, as it was part of the City of Monterey’s inclusionary Moderate Income Housing program. I was aware that the City had a first right of refusal on any attempt to sell and I wanted to make sure that this would not cause any problems with my application with OCWEN. In the course of doing my own due diligence, I obtained a copy of the Deed Restriction and discovered that the City had not only the first right of refusal on a purchase, they also controlled the value of the property. The value was determined not by the market, but instead by the California Consumer Price Index as provided by The Bureau of Labor Statistics. Of the two indexes shown in that report, I used the higher “Annual Average for all Urban Consumers” as the calculating factor and it represents the multiplier for the previous year and the highest possible achievable value for the year. Example: In 1985, the property was purchased for $110,000. During that year, the CPI rose by four percent (4%). The factor applied against the purchase price is 1.040, or 104%. Thus, the adjusted value for 1986 was $114,400. Subsequent years were calculated in the same manner, with a final

I took over taking care of my mothers mortgage affairs in March of 2016 and after several calls and 2 investigations on June 2 2016 was told by 3 different employees of Owen on the amount needed to bring my mothers account current which on the 3 of June I made said payment but less than a week later there trying to ad even more unexplained fees increasing the amount due. After several more calls and another investigation from Owen which is still in the process I just recueved the July statement and again there charging fees for another property inspection this when my mothers account is suppose to be current. I have bank statements going back over 4 years and Owen statement going back over a year plus I have recorded every conversation since March of this year for which i have always notified them prior to call info being given. As I said I have 3 employees after the first 2 investigations being completed one of which is a supervisor repeating several times each at my request that my mothers account was current and the amount and due date of next payment this being done by 2 employees including suppervisr on 6/2/2016 and the other by the employee taking the payment on 6/3/2016 yet my next statement was over $200 more than quoted with numerous property inspection fees and other fees and charges in the amount of over $110 with no explanation. Since I've made several more calls all recorded and they have always bin informed I was recording prior to all calls. I just recited July statement of payment due by August 20th and again even though my mothers account is cuur

I receive 3 phone calls per day by what seems to be a computer dialed system. When I answer it, there is always a recording or no one on the line for a few minutes. They call 3 times a day no matter what response I give them on previous calls, They do not care what day of week, or what time of day or night. Every time I speak to them I ask them to make a note that I only pay first week of the month. EVERY MONTH. So it is a waste of time to continue calling me day after day, week after week, month after month

Hi David, Is Ocwen calling you on your cell phone? Did you hear from Ocwen after you filed bankruptcy in 2009? Let's discuss your rights on the phone. If you need help disputing inaccurate information in your credit report, I can help you send a dispute letter. It's common for creditors, loan servicers, etc., to report inaccurate information after bankruptcy. Thanks, Mike.

Hi Donna, You are not the first person who has told me Ocwen harasses them on their cell phone. If you've told Ocwen to stop calling, and the robocalls continue to your cell phone, you have a case based on the Telephone Consumer Protection Act ("TCPA"). Under the TCPA, Ocwen cannot place robocalls to your cell phone after you say stop. The TCPA allows for damages for $500 per call. I will call you so we can discuss your rights further on the phone. Thanks, Mike.

Hi Katie, What you just described sounds like to me Ocwen is calling you with a robocalling system. Robocalls are annoying, and Ocwen cannot place robocalls to your cell phone after you say stop calling. I'm helped several consumers harassed by mortgage servicers like Ocwen Loan Servicing. Let's discuss your situation and rights on the phone. I'll call you. Or, you can always reach me directly at 312-224-4695. Thanks, Mike.

Hi Walter, What a nightmare! Has Ocwen Loan Servicing been calling you during all of this, too? You'd think after months of investigation, and multiple employees and a supervisor looking into things for you, Ocwen would be able to get this figured out. If you could fax or e-mail the documents, statements, etc., to me, I can go through them with you and get to the bottom of this. Thanks, Mike.

I am being charged unauthorized transaction fees and late payment charges each month when I have been paying on time or early. I was told that it was late payments dating back to 2013. Ther were some charges from that time in which I was told they would reverse the charges, but now 3 years later they are showing up. They come to about 60.00$ a month which obviously over time become significant, and I was never informed of the charges until I did the follow up noticing that my balance was not dropping.

We applied for a home modification through ocwen in 2014 explaining that my income had dropped as well as loss of health insurance. If we wanted health insurance we couldn't afford our mortgage, etc. We were denied stating we were not in jeopardy of losing our home but we could short sell it. We recently applied again because I am now the only person working, we have completely depleted our saving and are living on credit cards, etc. And we're denied again because now we don't make enough. I believe we were wrongfully denied for the first modification. We applied for.

Loan thru option one is now with ocwen loan servicing. Filed bankruptcy in 2005 and completed all payments in 2010. Interest on the amount we were behind and additional fees were not allowed by the federal judge. All of the first payments were put toward the interest on the arrears and fees not to principle as ordered. Ocwen is now trying to foreclose on the loan that is paid off if the payments were applied correctly. They have also added fees for all sorts of things. Home inspections once a month or more and servicing fees on top of fees for being in bankruptcy. The interest rate is 14.44 when Pa. only allows 9%. As first time home buyers we were not aware of this or that they could not change the interest from 11% to the 14.44. They have violated every consumer protection law there is.

Ocwen refused a loan modification since March 2016. Since 2011 when loan was transferred from Litton. Ocwen criminally trespass with unlawful/preservation possession and Lock Box on homes doors. Ocwen has tried to sell my home at auction sale since February, June and August 2016. Filed complaints with Maryland Attorney General under the (49) Attorney General and CPFB lawsuit to stop auction sale. Want to bring legal action for Ocwen failure to assist me with interest, non amoritizing predatory loan with (12.1) interest and $80,000 balloon payment.

On 8/19/16. I had water damage to my basement and submitted a claim to my home owner insurance only to find out that OCWEN had not paid my premium which was due 3/27/16. On 8/24/16 I received a letter from from my Homeowner Policy stating that I was not covered during the period of the claim. I have called OCWEN and spoke to every department and still has not received resolution for the damage in my basement. No one has responded to my many inquiries and I have no POC to cover the bills that I have already incurred for the damage in my basement. They paid my insurance on 9/1/16, and keep stating that they received a letter that I was covered from 3/27/16 -3/27/17, which the home insurance company is stating that I am not covered for that time. I have contacted a lawyer to assist with this matter.

Mike, I have tried to find out for 3 years if we have a house. We made a 1st & 2nd loan back in 2005. In 2009, we fell behind for two months. The NC state Mortgage Bank offered help but we were able to pay. At that time...I learned that we have a subprime loan. We were working well in 2005. do not understand. I spent a year trying to get proof of ownership 7 nothing. so in 2015, we paid the january 1 2015 payment on december 14, 2015, yes that did give us late fees. then ocwen adds unknown late fees. they threat us with foreclosure. i ask for a complete pay history of both loans from 2005 until lat payment in 2016. they say they cannot give payments beyond 2011. i later asked for the deed of trust. i think they made it up because the seal was not stamped. I have studied this Mortgage Market since 2010. We still owe late fees but Ocwen will not send the statement separating the late fees from the Mortgage payments.. I wanted the pay history so that they can show me the late charges ...just the ones that I do not know about. They have no older records. If a payment is due sept 1st. & the sheet say I can send it by the 16th without a late charge then I should be able to do that. Then I finally ordered a paper in November. In December...I told them to send me the "ORIGINAL" note. At this time I am waiting. I have been complaining to them since 2010. I asked for my assignments on both loans. I need assignments 1, 2, 3, & 4 in order. I told OCWEN they have no beneficial ownership in the two notes that they are suppose to have on hold but it seem like they only have a few numbers on paper. i told OCWEN long ago they have no legal authority to foreclose b& I am no months behind. Ocwen tried to close on the late fees & i know that is wrong. iread where you are helping a lot of people. How much do you charge. ? I am planning to take my case to a local retired DA. since i have done just about all of the footwork...i now want my house to be paid in full like all of the other people on this complaint list. i feel as though i can represent myself but cannot do the paperwork. since i am being threaten with foreclosure...why not foreclose and get my house early before you start helping..i need bto know how much you will charge? You are in Chicago and that is a long way away. Do you have some Attorneys in North Carolina.? Do not call right away. It is 12:58 am & I shall go to bed now.

Reached 3d settlement agreement for fraud in 2011 They agreed to reduce payments. Payments, per settlement were duly tendered. They have been returned for 5 years. And now bills have increased payment amount. I think the agreement and note are rescinded and told them so.

Hello Ocwen has been a nightmare & thorn in my side. They file foreclosure on me and I did not know my rights. At the hearing I told them (banks) U.S. Bank Nation Association as Trustee for ABFC 2006-HE1 Trust. On Ocwen behalf (a pretender lender). I would leave the property. After the fact i found out Ocwen Fraudulent foreclose on me. i got a securitized done and realized that Ocwen have no standings. my home was suppose to go to auction January 4, 2017 (today) but I stop it by filing Bankruptcy. I really want to sue them for ALL the hell they are putting me through. what can I do? I need help! Can you point me in the right direction?

Owen use to call us on our cell number 4 or 5 times a day until I finally swapped my cell number and gave them a home number to call. Owen also fid not pay or property taxes which cause us to have to file chapter 13 becsüße of that. it wasn't because the money was not there. they had been holding our money in the Esco account. so in 2015 I had to threaten to sue them in order for them to release our money out of the escrow account. they end up sending us over 4000.00 by check because this was suppose to be my property tax money they never paid. I really need to get away from under this nightmsre. I really need help in getting someone to but our list out. Csn we sue them for not paying our property taxes

I fell behind on my mortgage for several reasons. Medical for my daughter with SPECIAL NEEDS and loss of income. I have tried to get a loan modification since the interest rates dropped below 7% or 9 years ago. Since I fell behind OCWEN HOME MORTGAGE SERVICESIČ HAS offered a modification from their staff in INDIA. Very difficult task to say the least. Mis communications and difficult in understanding has made the entire process a NIGHTMARE FOR THE PAST 6 months or more. I have aproximately 300k in equity and I feel that: A) the interest rate had been enjoyed by OCWEN for a very long time. B) the modification process is purposely made difficult in several ways because there is HUGE benefits for them in a foreclosure. The process is a hoax that's played out to satisfy a process required according to federal ruling which prohibits their preying on consumers in trouble. In some correspondence, the office in INDIA takes weeks to reply or give accurate request which had been done purposely (I feel and recorded ) to erode critical time to act on my part. C) I could have resumed payments long ago but have been denied the opportunity to do so when it was possible. Now it's almost impossible because there are several or 10k++ in fees that are being added to the settlement amount. The trustee has set a sale date of Feb 15th and if that sale is allowed my wife, seven children and I will be homeless and robbed of the equity that would otherwise be used to sustain us. Please note OCWEN HAS DONE THIS TO US ABOUT A YEAR AGO AS WELL WHEN MY HARDSHIP STARTED. Denied me a lower interest rate and I was forced to cash in my retirement for $35k to cure the loan. Which also included HEAVILY PADDED FEES AND PENALTIES. I don't know if you can help but I sure hope you can! Regards, Charles B.

Hello, we have Ocwen as our mortgage company, we filed bankruptcy chapter 13 in 05-11, made our payments, last payment was July of 16. We received our discharge paper from the court in Dec. 16. We have tried to contact Ocwen to get statements from then the whole time, and they said we were in active bankruptcy coulee not legally sent them. They sent paperwork in July 2016 saying we qualified to re-modify our loan and that we had trial payments for August September and October. We made those payments , no new statement but we paid the same amount November December and January. Our statement for January shows we are 2 payments behind got a letter saying we no longer qualify for the modifications because we didn't return a final paper, which we never received. But emailed them, several times, and got back we were in active bankruptcy. On December 27 I called the Ocwen person even said that the discharge paper was in my file, but it would take 30-60 days to reconcile our account! Yesterday we received another letter from them I owe 27000...... Can you help

I was working to get my mortgage caught up, made an arrangement to do so, the arrangement wasn't noted, nor did I receive a call indicating the arrangement wasn't in effect. It then sent my account into Foreclosure mode. I had to take out a loan from payday loans, my 401K and family members to catch up my loan to keep my house.

I brought my house in 1978 for about $24,000.00. I missed a few payments and instead of foreclosing on my house the mortgage company at the time help me contact HUD about saving it. I entered into a forbearance agreement with HUD and was advised that I would start making my payments to HUD. I was also told that over time my payments would increase slightly above what the original plan in order to keep everything going to have the house paid off during the 30 year loan. While paying HUD I was responsible for paying my home owners insurance which I did. Then sometime later HUD transferred my loan to Litton Loan Servicing LLC without telling me beforehand. This did not bother me because I figured it was just part of how HUD handled things. I starting sending my payments to Litton and they started paying the insurance payments. I received my monthly billing statements and never paid any attention to anything other than the part that said amount due and sent that payment. Then in 2008 when I was told by HUD my loan would be paid off Litton advised I still owed the basically the full amount of the original loan. I contacted Litton with the help of a gentleman at a small mortgage company and we were advised that I had signed a 120 page document saying that I agreed to the loan being paid in full in 2008 like a balloon payment. We asked for them to send me a copy of the document and they said they would not send me anything. I was advised to contact a lawyer and in the meantime to continue to make payments for any statements Litton sent to me. I continued paying Litton for another 3 years, because I could not find a lawyer the handled this type of case. Then in 2011 Litton transferred my loan to Ocwen Loan LLC again without telling me beforehand. I found out online the Litton was being sued for fraud and that is why some loans were transferred. I tired contacting Ocwen about them sending me statements, but I kept getting told that they would not send any statements they just wanted a full payoff of close to $23,000.00. Ocwen finally sent me a letter that I received on a Wednesday afternoon that said my house was going to be sold at a foreclosure sale the following Monday. I called a friend that knows different types of lawyers and she sent me see a lawyer that handles this type of problem. He was able to stop the foreclosure and did some work trying to see if there was a way to fix the problem. My attorney has made several attempts to see if there is some solution we can agree on in order to save my house. Ocwen again put my house up for foreclosure sell and this time I had to file bankruptcy in order to stop the sell. The bankruptcy plan was denied by the trustee. My attorney says there is paperwork that I signed showing that I may be responsible for the loan. One of the problems I have is I do not have a copy of the original forbearance agreement because in 1987 I had a fire at my house and lost a lot of the documentation. When I contact HUD about getting a copy I am either told they do not know what I am talking about or that my mortgage company has to make all request. We have been doing this so long that Ocwen now says I owe more than $60,000.00 in order to pay off my loan. I believe that this is a complete case of fraud and I am not really getting some of the help I need. I would appreciate anything you could do to help me. I have been told that I may have to sell my house or get a reverse mortgage.

I got behind on my loan by about 3 or payments. They offered me a medication program with 3 trial payments which I made on time. Now they are saying it has to be approved by a judge before they can modify it as promised. They raised the payments from the trial amount which I could not afford. Now I am 2 payments behind again. I have to deal with India and I am so damn frustrated with this people. They have broken my trust and probably the law as well. I want to sue them. Oh, I forgot to mention I am in a Ch. 13 as well.

I have been on a trial payment for 6 months, never late. Now they are saying that the MOD papers that I have been sending back and forth to them for months have been denied. I need assistance because I think they are giving me the run around. have had 5 MOD forms filled out for various reasons, each time they said that it was my error. I had a call with Ocwen, but I had my real estate agent on the phone to assist me. They said they would escalate the issue, but then I just got a letter taped to my door saying to call Ocwen. I am at my wits end and I was wondering if I could sue them for harassment.

I own a rental property on which Ocwen holds the mortgage. It is a 2 apartment house. In mid-December, there was a plumbing leak in the upper apartment. I called Ocwen right away. The adjuster did not arrive to inspect the damage for nearly two weeks. He sent the claim in within a few days. I waited another month before the Claims Co. asked me for copies of the heating bills, which I sent by email right away. On Feb. 15, I received notice that the check had been sent to the lender. Now here it is another month later and no check. I can not afford to make the repairs without the check. Of Course, the tenants had to move out since they had no water. I have lost over $3,000 in rent. I know that is not a lot of money to Ocwen, but I have not been able to make my mortgage payments for 3 months. The lender is charging me late fees due to non-payment. Can we sue to more than the lost rent, plus the insurance check which was 2K? I know it is not a lot of money, but they have the worst customer service and I continue to loss money every month. Thank you

If I can get any help and input from you by mail or email it will be great. How much cost your services? Maybe, as support to local lawyer or even me as PROSE would be appreciated. I am in one of the 5 NYC borough far from you. I am victim of countless misuses as health care provider, as homeowner and individual. I am 62 1/2y.o. and now on disability due DM that needed many insulin inj. around the clock. Often I cannot deal with legal matters or even use computer and must overcome unimaginary odds to defend myself from completely unlawful collections. My ex partner that long ago remarried and on disability too +far away from my home and me was involved in many debts that ended up collecting from me. THESE DEBTS WERE NEVER VALIDATED ON ANYONE AND EVEN THE PRETENDED "CREDITOR" NOT IDENTIFIED OR COUNTLESS TIMES REPLACED WITH COMPLETE STRANGERS FROM ALL OVER USA ALONG WITH RAPIDLY CHANGING DEBT COLLECTORS AND FABRICATED FIN. CLAIMS AND ADDED REPLACED ABSURD DOCUMENT S. MY SIGNATURES COULD NOT EXIST AND EVEN FORGED SIGNATURES NOT FOUND. THE WORST COLLECTIONS IS COLLUSION OF CHAIN OF AGGRAVATED ID THEFTS AND MORTGAGE FRAUD CONFIRMED BY HUD/FHA MRTG FRAUD NUMBER 2014-9171436. tHE HOUSE IS FORECLOSED BY 3RD DEBT COLLECTOR AND AIDING IN CRIME LOCAL JUDGE AND LAND RECORDS STAFF. THE TRUE AND REAL HOMEOWNER-I paid from my wages and income $$$for my home and never needed or could be used in any mortgage at all. My home did not need it either since it was built in 2001. The claim that pretended lender allegedly gave previous homeowner never validated, disclosed or proven rip off mortgage no one proved either. I sent all papers to CFPB and they conducted thorough searches on my home address on any potential borrower and alleged "lender" that was supposed to be WF bank (they sell and resell everything they could issue in 2002-2003) AND NOTHING WAS FOUND ON ANY ALLEGED "DEBTOR" NOT EVEN ON PREVIOUS HOMEOWNER.... I KEPT ASKING FOR DEBT VALIDATION AGAIN AND AGAIN AND WAS TOLD STOP SUBMITTING DUPLICATE REQUESTS. THE COLLECTIONS DID NOT STOP BUT BECAME MORE SECRET AND VICIOUS. THE COLLECTING LAWYERS CHANGED AGAIN AND SECRET JUDGMENT ENTERED BYPASSING HOMEOWNER THAT WAS IN CONTACT WITH LAW ENFORCEMENT THAT DO NOTHING. ALL LAND RECORDS WERE REPLACED AND FABRICATED IN UNIMAGINARY WAY AND i BECAME jOHN DOE or tenant in my own home for which I paid from my income that HUD/FHA called buying home with cash. There is much more in this bank and collections fraud. It is most aggravated ID and property theft that I had very hard time to find legal help to stop. Lawyers in NYC afraid to deal with financial crimes and confront hostile courts milieu. The mortgage fraud infers theft of property and funds. I will try to call you Monday evening. It is too much for email. It does refer to annotated meaning of the term "foreclosure" even on previous homeowner. They have no debt validation on anyone and through complete deception were milking funds from bank accounts on my SSN and ID than hided everything. They misuse my impo ster and this was stopped and controlled when law enf. rescued me from misuse and abuse in health care fraud. As wb nurse i returned to health care 3-4 times more than any alleged mortgage could be and could even buy a new home. I do not part in crimes and the racketeering bank "defaulted" getting paid even from ill gotten health care dollars. They never used alleged or imprinted on papers "debtor" and even modified mortgage with my imposter on fictitious non existing "ability to repay" that no "lender" could ever use. I sent NYPD, FTC and even FBI reports that not only nothing was

Hello Mark. Typically under the law, they have up to 30 days to send a claims adjuster to your home following a disaster. Mortgage lenders commonly hold on to the checks when they are sent, which doesn't help the average consumer. Its unfortunate that you can't get good customer service and that you're losing money every month. I would be happy to see what I can do to get this resolved. Please give me a call at 312-224-4695. Hi Cheryl. It is always devastating when you have to dip into your retirement and ask family for help, especially when you thought you had a solution in place. It always seems convenient to me that debt collectors fail to make note of payment arrangements and blame the consumer for following something they reportedly never agreed to. Ocwen isn't alone in doing this, unfortunately. But, the good news is that you could have options. I am going to give you a call to talk about this further and see if we can help. Thanks, Mike

Hi Catherine. Sometimes the behavior of debt collectors really surprises me, especially when they're making the consumer jump through hoops, giving them a glimmer of hope, then bringing it all crashing down. Hello Allison. I would be happy to help you in dealing with the unscrupulous behavior that Ocwen is demonstrating. If you can please send me any documentation you have from dealing with Ocwen, I will review it and determine what you can do. My email address is [email protected]. I will also be in touch. Thanks, Mike

Hi Donna. Do you have the name and contact information of the person who agreed to the terms of payment? It isn't uncommon for these representatives to state one thing but then change the terms afterwards or they don't have the power to authorize something like this, but they do, causing consumers to struggle in the end. I will be in contact with you to discuss how you can possibly deal with this. Thanks, Mike

Hello Bessie. I will contact you during the day to discuss the many, many years of you trying to deal with Ocwen. If you have a case against them, they may be liable for your damages and my fees. We can talk about this in depth when I call. Thanks, Mike

Hi April. I'm sorry that you've lost your home, I'm sure that wasn't easy. Sometimes these types of debt collectors and lenders will go out of their way to make money, including taking your most prized possession: your home. I would like to see how I can help you. I will call you to discuss this matter in more detail. Thanks, Mike
