Who is PHH Mortgage?

PHH Mortgage is a mortgage banker and third-party debt collection agency based in Mount Laurel, New Jersey. Founded in 1977, PHH Mortgage recently merged with Ocwen, taking on customers of Homeward Residential in the process, and is not accredited by the Better Business Bureau.

PHH Mortgage Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if PHH Mortgage violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If PHH Mortgage took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. PHH Mortgage, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did PHH Mortgage continue to take electronic payments after you told them to stop? The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If PHH Mortgage is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. How do we Use the Law to Help You?

We will use state and federal laws to immediately stop PHH Mortgage’s debt collection. Can PHH Mortgage Sue Me?

  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

Frequently Asked Questions

  1. Do I have to pay your fees and costs for helping me with my consumer rights case?  No.  We handle consumer rights cases based on a fee-shift provision and/or a contingency fee.  That means, either the other side pays your fees and costs, or we take a percentage of your recovery.  Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful.  In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes!  Several states also have laws that provide its citizens an additional layer of protection.  For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts.  For example, money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill.  State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies?  No.  Only third-party debt collectors are bound by the FDCPA.  That is, original creditors, such as credit card companies and banks are not bound by the FDCPA.

We are looking for assistance. Our mortgage was sold from Ocwen loan to PHH mortgage during a trial modification. We made all three trial payments and signed and returned the permanent modification agreement however PHH failed to update our account therefore refusing our payments as the account was not updated with the permanent modification for over a month. By PHH not updating our account and not accepting payments we became past due and we received a foreclosure notice from PHH thus making us apply for another modification. PHH has also charged exuberant fees.

Hi. In June of 2019 my husband was furloughed from his job. We had just purchased our home in April of 2019. With that said, our budget was cut 800.00 a month. After just moving, and into our home, turning on utilities and such, our savings were deleted. I did manage to save enough for an extra month of mortgage that got us through July 2019. We called PHH to file hardship and a loan modification. It only got worse from there. I offered to send in partial payments but was advised by PHH mortgage representative not too, that I could use that money elsewhere. We were given a loan Officer but only in black and white. We tried to call her, email her as well as leaving her messages to contact us because we never received paperwork till after three month of our delinquency. Of course that was for strategic reasonings. Now we were three months behind and PHH started foreclose procedures. They lied to us, never at this point started any type of modification or help for us. They called us constantly. Even after we told them each time we were waiting on hearing about modification or what have you. The calls continued along with mail stating they couldn't read the paperwork that we "SCANNED and emailed. They couldn't reas my husband salary, they asked for the same paperwork and or items more times than I can count With much frustration In Jan 2020, I contacted THE MORTGAGE PEOPLE. We have been paying our mortgage to them since Jan 2020. PHH. PHH denied us because they said my husband pay of 50,000.a year along with my disability taking our annual income to 59,636.00 We have less than 5000,00 in Credit card debt/car loan The purchased price for our house was approx 182,000.00. Our current mortgage payment is 1371.00 then 5000.00 on a second mortgage that was for help at settlement. Payment on that is approx 80.00 mtb. We have had zero issue in paying this. I have eliminated some of our debt so our payment are affordable. I just don't feel from what I have read that it should be taking, at this point, 12 months for PHH to help us. I figure they are hoping during COVID-19 my husband would lose is his job, or something tragically that we couldn't no longer afford our home. I am 57 on disability due to issue from my diabetes. My husband is 57. This is our last chance on trying to have a home we are buying instead of wasting money on renting. The mortgage people has told us they will fight till they win. That's great, but what PHH has put us through has created more health issues with me because of the stress of PHH jerking us around for so long. Obviously we can afford to pay for a retainer for a good attorney. Can you help us or is this not worthy of attention. Thank you for your time, Deborah

Back in 2015 I filed a chapter 13 bankruptcy. In 2018 I applied for a loan modification with my lender which was Ocwen at the time. I was told by my lender if I was eligible for the loan mod it would take the house out of the bankruptcy plan, and I could pay outside the plan. I then successfully completed all (3) three trial payments as needed for the modification in the amount of $764.97. Ocwen mailed me a congratulations letter on 12/14/2018 and said I was approved for the modification which I still have documentation of. When I received the letter I called Ocwen to see what’s my new payment since those were trial payments only. The representative at Ocwen told me she couldn’t tell me the amount that I needed to pay, and to have my bankruptcy attorney call to give permission. I called back after permission was granted, and the mortgage company told me first, my ex husband who quick claim the deed to me didn’t sign the modification. Keep in mind I have a congratulations letter in my hand, not to mention I had a loan modification back around 2012 in bankruptcy case number that he did NOT sign, and I have that original documentation still showing he didn’t sign. When I brought this to Ocwen’s attention the story changed quickly, next they said I didn’t send my signature of acceptance back in time, but they were lying because I did send it, and I called to make sure they got it. So my response to Ocwen was If I didn’t send my signature back on time why in the world would you send me a congratulations letter. Well the phone mysteriously hung up more than once on me: Then they said oh yes you sent it back on time, but your ex husband didn’t sign the modification. They gave me the run arounds and sold my loan to PHH mortgage which made it even more complicated to talk with someone familiar enough with my case. Now because the house was taking out of bankruptcy for me to pay outside the plan the amount was steady increasing, and they knew I can’t make payments outside the plan, because they told me they would return they payment if I did. I also had applied for the Covid relief through Phh mortgage ; in which I have documentation my daughter actually had COVID and they stopped the payment for that assistance not even a month when it as supposed to stop the accrual of payments immediately for 3 months. I called Phh mortgage, and do you know the customer representative lied, and told me my attorney called to stop the payment on November the 18th, 2020. I called my attorney at the time and he said “they are lying to you, and I did not call to stop anything. He said “I would not jeopardize any help.“ This company has strategically put me in this situation so I can loose my house for them to sell to someone else, and now I owe $20,000. They have caused me stress, and flat out lied too many times! Since I brought this house is 2006 it has been nothing, but shadiness from every lender that buys the debt. The first lender tried to make me pay $5,000 under the table with a promissory note! I need help now because I’m not trying to go through another bankruptcy over something they strategically done to loose my house for their benefit.

I know I can not get any help with my loan and I have exhausted all my help with a loan modification, because I failed on my last one. I did not want to do that and wanted really badly to save my home. I did not intend on getting sick and being off work in November and December. I did reach out and was told I had to make my three trial payments on time or I was done with help and no longer eligible for help. I had someone trying to help me save my home, because I knew I could not get and more help from phh on my own, and I got scammed. My husband has been off work since dec 1 and his short term disibilty has finally came through and he also may go back to work soon. I guess now I am waiting on a sale date? Is what I am being told, our mail box was hit and we had to get it fixed, and I went to pick up my mail and seen I have exhausted all help and a forclosure sale is set? When is the sale and what do I do start moving now.? I do not think my house will sell for much there is a lot wrong with it, and being off work we could not do to much to fix things. I wanted to save it and had every intention of going through with the modification and never thought in a million years both myself and my husband would get sick again. I have tried dealing with Ocwen aka PHH aka New Rez, requesting a modification on my loan, three separate times. This has been since 2017. I was unable to work and was disabled in October of said year. I notified them as becoming disabled induced slicing my income in half. My disability modification requests have been denied, claimed not received, etc. I am considering legal action, as they are predatory fraudulent and lying jackal's. I am a month in arrears at this point and have attempted to pay slightly more on my $1600 in order to eventually get caught up but they refuse to place it in my account and placed in their "suspense account". Please advise

I am trying to find an attorney or team to help me with as law suit against Ocwen & PHH. I have been filing complaints, writting letters, countless phone calls and still have nothing resolved. I am not past due in fact I am ahead but it is impossible to make sense of a loan that opened at 125k in 2005 and the 1098 I got for 2020 said 143k principle balance. Ive never added on never did refi. In fact I paid 25k in 2010 leaving me a balance of less than 100k. Now there is zero records or payment history of my loan from 2005 to 2014. They have payments they didn't post at all or waited almost 2yrs to post. Unexplained fee's added to my loan sometimes more than once a month but always at least once for 37.50 for inspection and certified mail fee. Yet Ive never had either of them done or received any certified mail. When ocwen changed to PHH nothing changed I didn't think anyone could be worse then ocwen but I was wrong. I had been sending 500 every other week for 2yrs in efforts to knock down my balance faster but when phh took over i got a past due notice but I was really 2 payments ahead, the customer service rep told me to save my 500 until the 1st of the month because it is doing me no good and it will go to fees or principle becasue it isn't the full payment..WHAT? then tried to tell me the loan wasn't simple interest. OMG what a joke.. Well new issue I am having most recent is the loan I got in 2005 for 125k for the purchase of my house. Well in 2019 both ocwen and phh sent me 1098 with principle balance as 106k & the other 105k due to both of them having my loan half the year. Now in 2020 my 1098 from PHH states principle balance of 143k, that is 20k more than i paid for the house in 2005 yet i never added on nothing. How is this legal and how the hell do i get help with these crooks? There is so many other things they have done to mention as few. Sent Bill pay payment back becasue they claimed it wasn't guarenteed funds but it took almost 35 days to get that money back the 2 payments they rejected. When Ocwen took over my loan they just put what ever balance they wanted and opened my escrow in the rears over -14,000 (impossible) and with over 4k in fees yet couldn't explain for what. They sold my home in forclosure and transfered title into their names back in 2014 while I was making modification payments and charged me forclosure fee's because they dropped the ball and never canceled the forclosure. it took me almost 3yrs to get the deed back into my name. There are so many unexplained transactions and reversals.. there are payments they reverse and reposted 3-6 times each.. my loan is a nightmare and I can find someone to help me with these issues or go against these crooked mortgage lender or processers.

I currently have a mortgage with PHH. I did a Covid Forbearance last May '20 and skipped 3 payments Jun-Aug. Notified PHH in August was ready to make regular payments. They said my Forbearance was extended to December. I said I didn't want it and sent in my regular payment. They set me up on a 3 month trial of payments through Oct-Nov. In December they sent paperwork for loan mod with new payment info. I signed, returned and made 1st payment on Dec 29 for Jan. They reported my payment late for Jan to credit bureaus and said they received it on Jan 20th. I have made all my payments this year, they just told me my loan was in forbearance again, not requested by me, canceled my autograft and reported to credit. I want to refinance to get out from PHH but everytime I get back close to 620 they knock me down. What did they do with the money they collected for the trial for 3 months. Just charged me for escrow advancement and have never applied the 3 payments of $1400 anywhere. Cannot get anywhere on the phone with these people. Please help. Thank you

I had phh & ocwen as my lenders. I got screwed by them. I did a modification on my home after my husband passed and they too 30k and put it somewhere I don't know where. Was told it was going back into my loan but never did. When I sold my home was told I have to pay 30k on top of the loan I already had. I bought my home for 80k and ended up paying 130k owed to phh. I'm not sure if this is making sense but this did not add up to me. Would love to get some type of an answer on this. I believe they did me wrong. Thank you

Deceptive fee practices to make profit with processing fees taking away equity. Multiple fees were added to my balance for property inspection, extra title work, foreclosure fees, BPO fees, and fees for two different law firms added cost. Instead of a Repayment Plan to catch-up on past due payments. I fulfilled the payments under a modification plan, but could not accept going back to thirty years with a balloon payment added also for over $22,000.00 due at age 93. A copy of fees listed in Chapter 13 Case Number 18-04955-jw Claim 5 Filed 11/27/18, in the District of South Carolina, US Bankruptcy Court. We have been with Ocwen (now PPH) for years. In those years they have added on fees, had people come take pictures of our home trying to foreclose on our home. We have had to borrow money from friends, family, just so we would not lose home. Now, we have been trying to pay it off. We started talking to them in May, now it’s end of October and have gotten no where. They set up appointment on phone, someone calls that knows nothing about our case. This has happened 5 times now. They each tell us something different, tell us the last (case worker as they all it) did not say that… we (My husband and I) both heard the same thing, I grant them, their English is not great, but we can understand them. We only owe $3,347.26 outstanding balance. But over the last 20 years, they have tacked on fees, so now… which is constantly going up. It’s total, $10,440.01. We have been with them since the Ocwen lawsuit, we received $20 each, we are both on mortgage. What a joke, but they still want all these fees. They told us they would settle for the $3500, we has to send proof of funds, and we’re ready to send in, then the next person we talked to, said they didn’t say that. The calls are all recorded. 3 calls later, amount going up we say $6000, they had to have proof of funds… we send 2 days later. The next phone appointment they say it was denied, because we didn’t send proof of funds in time. We say we did, he checks, oh yes I see now. WHAT? My husband has already has one stroke, and now has pace making, I am afraid he is going to have another. They are truly driving is crazy. He says, I am sending the $3347.26, and getting a lawyer. So here we are, what would you suggest?

although we have reported identity theft and mortgage fraud against Option One Mortgage for a 2004 adjustable rate liber which i was totally confused about, and then my note was stolen and sold, after learning this lender did not even have a lending license and while instead of recording a satisfaction this company OCWEN schemed to create subsidiaries to hide the obligation to record the satisfaction in the county recorder..... all of a sudden this loan appeared on my credit report in 2006 as Homeward Residential fora 338,000 mortgage loan with a different loan account number, after further disputes all of a sudden the Ocwen Corporation appeared on my credit report in 2015 with the same mortgage loan under a different account number, and after further disputes and criminal charges filed against Ocwen Corporation by the US Attorney (*see In 2012, the CFPB and the attorneys general of 49 states and the District of Columbia sued Ocwen.) and again after further disputes all of a sudden this same loan appears on my credit report with a different account number under another Ocwen company PHH Mortgage; and now even though we have paidoff the mortgage several times, PHH Mortgage claims the mortgage balance $337,000 but the at the same time home is owned by Wells Fargo Bank REO in violation of state law. the lawfirm MillSap & Singer, LLC have caused the county sheriff to lock us out of our house foreclosure while we appeal and complain in federal court where silence from all respondents for the last 4 months pro se missouri eastern district 4:21-cv-01313-HEA. we have been living in hotel since december and have requested entry of default by clerk.

Hello, I am the successor trustee for a property in San Francisco that had a reverse mortgage via PHH. The decedent passed away in late 2019, and the beneficiaries asked me to pause the sale of the property until they were able to tour the property and its contents, which was severely forestalled by COVID. Eventually the property moved to foreclosure, at which point the beneficiaries approved me to move forward with the sale. The estate attorneys I was working with advised me that I should have been able to sell the property for as much as possible, which is not in great condition, and would just repay the bank the delta between expenses and sale price, even if the sale price was below the amount of the debt. However, we received an offer for just shy of the outstanding amount, and the bank blocked the sale, claiming they would not accept a short sale because they believe there is still equity in the property. I secured a last minute COVID extension on the foreclosure sale of the property in January, but a real estate agent representing the bank went ahead and listed the property, accepted an offer BELOW the one they blocked, and did not respond to my emails but finally quietly canceled the sale after a few attempts to follow up with them to find out what is going on. Now when I call I am having a hard time gathering simple information. I suspect they are making it difficult for me to pursue this in an effort to wear me down. What are my options? Can they block a short sale/offer I secure for the same amount they accepted given the above? Thank you, Gabrielle

Hi Gabrielle. You don't need the bank's permission to seek a buyer that's interested in a short sale arrangement, but you do need the bank to approve you for the short sale before it can move forward. Banks can also be very close-lipped when they are dealing with the possible loss of their money. Fighting PHH over property inspections fees since 2014 i just found out because they are not in your statements and they are done 1-2-3 times a month at a rate of 13.25 each. they say its a drive by to make sure the house is still occupied. well if im making payments its occupied but why 2-34 times a month . second they are not giving me the last credit of 45K on my loan modification. I have made all my payments and in aug -oct they changed their mailing address from florida to texas. so i mailed my cashier checks to them and in November i get a letter stating that they hadnt received any payments. I immediately found my receipts and tracking number and the bank said none of them were cashed so we resent them all in November. Now it was 4 months before my last forgiveness amount of 45K. so i think they held the checks so that i would be late. I have sent in to the CFPB attorney general , office of Ombudsman proof 3-4 times and they still say they dont have prof. I now need legal help .

I called PHH Mortgage Services on March 17, 2022 at 2:27pm and did a deed in Lieu but evidently they lied to me because they keep adding charges that is showing on my credit report. I have tried to contact them about this but my emails are always returned and when i call as soon as i give my information my call is disconnected.

PHH-Appears to be dual tracking, sale of home while paying modification, the loan is predatory and noted the loan amount from disclosures varies what is recorded, the term on credit reporting reflects 372 months yet the loan is 360. The credit reporting does not reflect the payments made for trial payments, the credit report reflects an amount of original of $532K, but TILA Disclosure $523, the loan was not supposed to be prepay, and now looking has a fine prepayment clause.

I used to be a customer of Ocwen loan, during that time I was behind on my payments and they refused to grant me a payment plan to catch up (3 months behind and would not accept a payment unless I could pay the full balance). I kept filing out paperwork for mortgage assistance and I was denied each time (2018-2019). Ocwen in the midst of my request, transferred my servicer to PHH which sent me foreclosure papers. They also denied me a workout plan at that point as I was showing 18,000 behind and told my the balance must be paid in full as well. I had no choice but to file for bankruptcy in 2020. I then filed for a modification in August 2020 and was given the run around until 2022 when they finally approved my modification request. PHH then transferred my loan to Rushmore LLC, but did not transfer the final modification approval documents. I send everything I have to Rushmore LLC and I am still trying to get my modification approved. Meanwhile, Rushmore is reporting my loan as past due instead of current. HELP!!!!! I have my attempted communication with PHH, Rushmore and some of Ocwen.

I was told on the telephone that I had a forbearance from august 1, 2022 until November 1-2022. I explained that I would be paying off other debts to open my budget. My account was current. after I spent money in August, I think get a phone call that I had to make a payment or my credit would be affected. Office of ombudsman admitted they pulled the phone call, heard the rep say it, then apologized. I have written so many emails and made 20+ phones for a week even to Director CEO and only offer a modification. I was set up to fail, and PHH knows it. I just do not know what to do or what my rights are. I received a letter stating their standards weren't met. But I had to put my account in the negative, my husband had a family member murder during the chaos of this, I couldn't even offer my father in law to come to our house in town, because lack of extra money for groceries, and now as this month goes on, the can't correct it. So, I have had to pawn stuff for extra money. So what am I suffering for their mistake? I just don't know my own rights. I mean I am married to disabled veteran who is own 16+ medications a day, and this upset isn't good for him either. Like how can they tell me I wouldn't have a payment, wait until I spent the money, then decide they were wrong, and I still have to go forth? I paid off three smaller debts 11 days after that calls, and paid 1961.00 two days ago like I said I was going to.

We have been dealing with Ocwen/PHH/NewRaz for approximately 20 years. We were struggling financially due to a medical condition. Ocwen reached out and said they could help. Not reading the fine print, we signed into a shared appreciation contract. Ocwen didn’t explain this to us. Over the years, we’ve had to pay 20.00 to make a house payment. Charged us fees without explanation. Although we’ve asked multiple times. We decided that we had all we could take and decided that we would sell our home to get out from under them. When we called for the payoff they repeatedly told us that they couldn’t give us a payoff quote because of the shared appreciation cost. 25% of the increased value of the home. That we would need to request in writing and we would have to pay for it. And they would send a person to inspect the property, that we would pay for, to give us a complete payoff quote. We took the contract to a mortgage broker and he explained that we would pay 25% of the increased value of the home not to exceed 19,000. Not one time did Ocwen/PHH/NewRaz explain this. We didn’t think selling our home would be possible. Recently, we decided to move. We closed on our house 11/9/2022. The attorney that handled our closing overnight them a check. They received the check on 11/11/2022. Ocwen/Phh/NewRaz claim that they didn’t receive the check. Our attorney sent the paper trail saying that they received it and signed for it. Our attorney had to stop payment on the check and wire the money. Now Ocwen/PHH/NewRaz are saying the payoff was only good until November 15 and are trying to make us pay interest and sending us bills saying that our loan is in default and that they will be paying for insurance due to us canceling the insurance on the house that we no longer own. As of now, this hasn’t been completely resolved and has been almost a month. During this time, I called PHH to see when I would be receiving a check for my escrow account. I was informed that my escrow account was in the negative over 100 dollars. They said that they paid the taxes on November 15 and that I didn’t have enough money in my escrow account for the taxes. I had to show documents that I had paid the taxes. Praying that I can get the money owed to me.

My mother passed in january of 2021 she had the mortgage on the house my father and I are living in. Her and my father had a deed that gave the house to him in the event of her passing, I hired an attorney and they did a loan modification placing me and my father on the mortgage. I find it disturbing how much more we owe them and the fact they have not taken it out of my mothers name on their site so I can register to make payments as they promised me on the 14th of this month. My relationship manager told me while going through the process that I wouldn\'t get foreclosed on my property. I found out that a foreclosure has been started, while under review (dual tracking). Good morning, My name is Lynn Gordon and I live in the Fort Lauderdale area. I have been \"dicked\" around for years by PHH, Ocwen, whatever they call themselves these days. I have a condo in Florida and did a loan modification about ten years ago and have been paying interest only for the last ten years. Then a few months ago, I noticed that they they have added $120,000 at the end of my loan. I paid $344,500 for it in 2008 and put $70,000 down. I mortgaged about $275K and during the housing crisis, I did a loan modification and was paying interest only for 10 years. Now, I still owe $260k on the condo plus the $120,000 at the end of the loan. After living here 15 years, I will actually owe more than I paid for the condo, not to mention the money I have paid toward my mortgage. My name is Lynne M George, I am a 66 year old black woman living in Houma, Louisiana. 1. I began my real estate journey in 2017 when I purchased 2 houses with a storage shed between them on 210 and 208 Marietta Place, Gray La. I invested $37,000 in 208 and about 2 years later $79 went into 210 Marietta place. Both houses on Section 8 $1000 for 210 and 208 $800 per month. 2. USAA Insurance them both. 210 for $192,000 and 208 for $191,000. 3. Now time to purchase one more property.. It was May, 2021 I was pre-approved for $650,000 at 5.4% interest. I looked at apartments here in Houma but was above my approve amount. So I ventured out to less then a 2 hour radius and came upon a portfolio of 13 houses in Lafayette La. 1 and a half hours away. I had a great guy who helped me since 2017 work on all my properties. 4. 13 house portfolio loan $658,000 I put my 20% down and closing. Taxes were escrow Paid out of pocket the $10,970 appraisal fee $12,047 insurance premium to George Roane Insurance Lafayette, La The downpayment was $3000 with $947 a month note EFFECTIVE DATE August 27, 2021-2022. 13 houses all insured for $50,000 each with the exception of 231 Dear St for $58,000 5. Closing on the Lafayette Properties was suppose to be in the month of August but because of Hurricane IDA hitting Louisiana we closed October 21 2021. No problem insurance was already done 6. My mortgage had to be in 2 loans 8 houses on 1 loan and 5 houses on the other loan because they could not place 13 houses on 1 loan PHH Mortgage Loan # 8016196993 for 111 Chester St has 8 houses $400,000 $374.54 interest $1326.95 interest $140.52 tax $29.58 city tax Total note $1871.59 PHH MortgageLoan #8016201926 for 203 Ile de Copales has 5 houses $258,000 $235.69 principal $861.77 interest $108.99 taxes 22.95 city tax Total note $1229.40 Insurance monthly payment $949.00 Total for everything per month $4049.99 Collecting $6400 in rent so this is allowing me $2400 to work on the houses a month 7, Because of Hurricane IDA all losses all the insurance companies pull out of Louisiana. Lender Placed Insurance had to be placed. This is where the problem begins. I began to notice that my monthly payments were over $2000 above cost January 2023. That was a problem, What Happened! I soon discovered that yes there were Lender Placed policy on loan #80162019326 and another on #801616993. (I used to own an insurance agency so I know how to read the declaration page.) I called them to bring it to their attention that there were 2 policies of $658,000 coverage on each. They didn\'t seem to understand what I was talking about. I had to break it down plainly to them that my monthly payments reflected a problem. Many recorded messages of me getting nowhere. I knew that my credit would be impacted if I didn\'t pay because it would be hard to explain to the credit bureau about the overpayment of insurance. So several times a month, every month from January through August I was calling asking for my refund of the duplicate policy to be canceled. They were insuring me for $1,316,000 over insuring me and in Louisiana this is against the law. June came and still nothing every month they are working on it they are working on it. I had to write to the Office of Financial Institutions to get involved because I was getting NOWHERE. Every month I\'m still calling. I am just collecting to pay notes, not to work on my property. I was glad August was coming and thought yes they fill fix this and refund me my $10196.00 and late charges on each note. September 2023 is here, Now my note is $3000 over the amount. What is going on! They are working on it. I want my refund! WHERE IS IT! I get a letter dated September 22, 2023. See Attached. This letter states that \"We sincerely apologize for the inconvenience this may cause to Lynne George/BALAA Investment LLC (Remember no letters of knowledge of what was going on) They said they canceled both policies in April ( yet they still have me paying the crazy payments) and refunded the escrow accounts. They purchased a Lender Placed Insurance policy August 2023 (coincidence that is when my insurance expires) and dated (back dated it with an effective date of August 27, 2022-2023. See attached listed properties and coverages. PREMIUM of backdated policy $15,253 Also where is my refund? You\'re not getting a refund. we applied it to your escrow account there is a positive amount of $6000 but you have a shortage of $9908.97 The $6000 will be applied to you escrow policy you owe of $15,253 and also we are charging you $15,253 for your current policy. So that is a backdated policy of $15,253 then NO REFUND then $30,464 to be collected for 2023-2024 so that is like $45,717 plus I never received any refund. So for 1 year I am just forced to make payments and not work on houses. Instead of 12 rented now only 7 rented. Also the stress and depression had me wanting to check out of life by the end of the year. I I cried out to God. After my son died 10 years ago I have been getting the shingles every 6 months. But because of the stress level I have been getting them once or even twice a month. I did not want to leave my 90 year old mom, 91 year old dad and 21 year old autistic grandson. God they will be devastated. God started to talk to me. God said you can fight this legally. That is when I contacted some attorney\'s I was up at 3am couldn\'t sleep from JUST ANSWER and they said that RESPA and Antitrust laws are violated and the PHH is currently involved in an ANTI- Trust litigation Now. They read the letters. They told me to contact a bankruptcy attorney and a RESPA ANTITRUST Lawyer. I am now contacting you for your advice and next steps on this matter. I received a call from my property manager stating that 2 houses need plumbing $5000 They have my money. I can’t pay a note of almost $6000 and do plumbing of $5000. I just can go on. I am going into foreclosure the end of the month because I just can\'t go on I have no more money for the last year they have taken over $25,000 in unexpected money from me my life savings gone. I\'m just tired it keeps me up at nights even though I have sleeping pills. I am just tired I received a letter mid November dated Nov 2 that said that they were removing late charges but I\'m not getting a refund because it is going to my escrow.
