North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. Can Premiere Credit of North America Sue Me?

Although anyone can sue anyone for any reason, we have not seen Premiere Credit of North America sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. Can Premiere Credit of North America Garnish my Wages?

No, unless they have a judgment. If Premiere Credit of North America has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above.   6. Disclosed to a third-party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said to stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery. Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

  2. What are the damages I can get under the Fair Debt Collection Practices Act? If a collection agency violates any section of the FDCPA, you are entitled to damages up to $1,000.00. You may also be entitled to actual damages if the violation caused you out-of-pocket expenses. For example, if a collection agency threatens you with legal action to induce you to pay the debt, you may be able to get your payment back as actual damages.

  3. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, Defendants often pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  4. What type of debt is covered under the Fair Debt Collection Practices Act? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. The FDCPA does not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No.  Only third-party debt collectors are bound by the FDCPA. Original creditors, such as banks and credit card companies, are not bound by the FDCPA.

  6. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. If you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, or Wisconsin, you have additional state-law rights.

It sounds like Premiere Credit of North America violated the Fair Debt Collection Practices Acts ("FDCPA"). If so, you are entitled to money damages up to $1,000.00. Just received a phone call from Premier Credit about an Indiana state tax debt owed. They said I needed to pay the debt immediately or my bank account would be levied. I asked for documentation of the debt and they said they would send it, but I still needed to pay something by the end of the month to avoid "adverse actions" on my account. I thought I had 30 days from when I received documentation of the debt to respond before they moved forward with levies, etc. The person on the phone told me since it was a state tax debt I didn't have the protection of the FDCPA. That didn't seem accurate. They kept changing their story too. First they wanted the whole amount, then they wanted half now and half in a month, then a third now and two more payments of a third each, then 10% by the end of the month followed by three monthly payments. The whole conversation seemed really weird. Are they lying about the FDCPA? Thanks

Premiere Credit of north america has collected money from my mother ( who needs a translator ) for over 10 years. They keep on adding to the amount. They will call numerous times a day and week after we have asked them not too. My mother shouldn't even been grated this beauty school loan in the first place as she doesn't understand english nor does she have a high school diploma or ged? This loan is a scam in the beginning!! How do we stop these scammers from taking anymore money from my mom and stop the harassment.

I have student loans through College Assist being collected through Premiere Credit of North America as of 2018. My wages are garnished 5% bi-weekly & I entered in their rehabilitation program to avoid an income tax return offset. I made the required payments in the program before filing my taxes & still got a letter from the treasury offset dept. saying my entire $3,400 refund was being offset. After three recorded phone conversations about this with Premiere Credit of North America they agreed I had completed the requirements & should not be getting offset, however they lied and said there is nothing they can do and will not give me my return when they eventually receive it. I signed a contract with them and now they are refusing to abide by their own contract. I have spoken to the US Dept of Treasury, US Dept of Education, and College Assist who have all told me Premiere Credit of North America should be able to fix this error yet they are claiming it is out of their hands. This has to be illegal right?

Just recieved call from sheriff to serve me. Im being sued all im told and given a number 317-342-1787. Doc # 709323.us. Something about premiere and breach contract for almost 10000.00!! Ive been disabled since 2004 they tell me it from 2000!! It 2020! So im being served tomorrow I have no other details but I googled company am not lost. Can you help?

This company took my entire 3K tax return over a delinquent student loan debt that I wasn’t aware I had with them. I had a repayment plan in place with Navient and somehow this company got involved and intercepted my tax return.

This company started garnishing my wages a few years ago without notifying me. I’ve made several attempts to get them to send me necessary paper work, because I shouldn’t have owed these loans(Kaplan University took out loans for semesters I didn’t sign up for!). Long story short, they basically told me they’d send me the papers I needed to fill out but never did, on several occasions. Back in November 2019, I spoke with someone and she was trying to get me to consolidate the loan. I explained to her how I don’t owe these loans, and her company has been the worst to deal with and no help at all. Again, I was told I’d receive emails that I never received. I filed my taxes and spoke with someone in the end of February, beginning of March, and discussed them settling for the amount of my return. “We can’t do that because it’s not a ‘voluntary’ payment”. Whatever. I received a paper check from the IRS. This means that my loan is PAID, because they took $4,137.06 from my return, leaving me a whole whopping $83. Why then, is this company still garnishing $386 from my paycheck!? I have checked everyday for emails they were supposed to send me from a month ago when I spoke to someone, and have not received anything, not even about my loans being settled. I was just speaking with someone asking them these questions, and as soon as I said, so since my debt is paid, why is your company still taking almost $400 out of my paycheck? They immediately hung up on me. Now I’ve been trying to call back for nearly an hour and not getting through. I HATE this company and their shady practices!

This place has been garnishing me my wages for I don't know how long. I never got a summons to court nor do I know how much they are garnishing my wages for. I had thought that was what was going on with the Corona virus that garnishment of wages for student loans was supposed to stop however I found out today from my employer that since it's a court judgment that it will not stop. I have had a garnishment for federal student loans since 2013. What can I do to stop this. I work in the education field for Early Head start.

I just received a collection notice from Premiere Credit for over $7k for a Discover card debt they claim I owe. I have never had a Discover card. Should I dispute it in writing or ignore it? My husband thinks even just sending in the written dispute will cause them to really start harassing me. Thank you.
