Road Rage FAQs

The National Highway Traffic Safety Administration (NHTSA) defines road rage as when a driver “commits traffic offenses so as to endanger other persons or property; an assault with a motor vehicle or other dangerous weapon by the operator or passenger of one motor vehicle on the operator or passengers of another motor vehicle.” Incidents of road rage can be frightening and escalate to very aggressive and dangerous acts. America’s Consumer Lawyer is here every step of the way to ensure that your rights are protected and you are fully compensated for your injuries and losses, and this includes working with the insurance companies on your behalf to ensure a favorable settlement.

The NHTSA has found that 66% of traffic fatalities are a result of road rage. Even more concerning, 37% of those fatalities were as a result of a firearm, not a consequent accident. Clearly, road rage is a major issue on the roads and can end in unfortunate death for some.

Laws regarding road rage vary by state, but some states consider road rage to be a form of assault or battery since it is an intentional, reckless, and violent act. The severity of the punishment of an aggressive act of road rage depends on the incident and state’s laws, however, it could mean years of jail time for some. We at America’s Consumer Lawyer are proud to serve our fellow citizens, especially when you or a loved one has been injured in an incident of road rage. We will fight to the very end to ensure that you are fully compensated for all of your injuries, losses resulting from the accident, including medical expenses, property damages, lost wages, and pain and suffering, and you won’t owe us a dime for our services.

What causes road rage?

It is important to assess how you drive to ensure that you can do all that you can to avoid a potential incident. There are a variety of precursors to road rage, including but not limited to:

  • Distractions affecting your driving
  • Switching lanes without signaling, thus cutting off another driver
  • Heavy traffic
  • Tailgating the driver ahead of you
  • Ignoring another driver’s right of way at an intersection
  • Stressors rooted in the aggressor’s personal life

All of these actions could result in a driver and/or passengers of another car becoming exceedingly frustrated and potentially lash out in an aggressive manner. Though however, their response may be difficult to control, it is helpful to know possible precursors to a road rage incident.

How should I respond to an aggressive driver?

When faced with a driver with road rage, it is essential to try and keep calm by not reacting or retaliating in any way. Their hostile behavior may be upsetting and angering, but in order to not escalate the situation into something increasingly dangerous, you should never engage and respond with their same inflammatory behavior.
