You can receive $500 per call if SmartPay Leasing LLC violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

I got a call from a number, they left a voicemail said they have case on me and I needed to call them, they didn’t tell me who they were or what company they worked for. After calling the number and being left on hold for 30min and while being at work i learned that it was a smart pay collections agent. I opened an account at Walmart want in 2015 for an iPhone 6 on Straight Talk and it turns out the phone really didn’t work good and the service was not great so I ended up returning the phone to Walmart. The agent on the phone said that even though I returned the phone I still have a contract with the company and that I now owe them $600. They said if I don’t pay it will be a fraud case and I believe that in Virginia it would be a felony. I need advice on what to do and how to go about this case as I don’t have the money to settle it nor do I have the funds for them to put a wage garnishment on me. I have been contacted numerous times from SmartPay Leasing, claiming I defaulted on my contract. It has been 3 or 4 years since I even had the phone. They have threatened to serve me papers at my place of work. I agreed to pay the $300 to a company called Global Asset Agency who I have now googled and realized could be a possible scam company. They have since contacted numerous people in my family in trying to contact me. They call from unknown numbers and I can not return the phone call. They gave me a number to call but when I do it says the call can not be completed. I would like to know what I can do to solve this issue.

Smart pay leasing is on my credit report and I've never done business with them, I've owned the same LG4 Android phone for 6 years through Metro so I'm really curious why they claim I owe them over 500$ of compensation.

To whom it may concern, I Jadell Thomas haven’t payed my payment due to intense family situations and being unemployed from the time of the halted payments. I recently have been able to obtain a consistent well paying job to where the smart pay lease will be payed in a short time frame. I understand I have been notified for the insufficient funds but now I have accessibility to do so. I was wondering how do I pay my dues.

I purchased a cell phone at my local cellphone company and the seller informed me I could go through smartpay to receive a discount on the phone I wanted. I agreed to go through smartpay to receive the discount, the seller never told me I was agreeing to a leasing with this company. Next thing I know I\'m getting calls from smartpay asking for contracted funds. They told me I agreed to pay $1,100 in total for the year. I told them that is absurd I would have never agreed to lease a phone and besides I never signed a contract in the store. Now I have a debt with smartpay that I never signed a contract for, I was told by MetroPCS I would only need to worry about making monthly payments for the phone service. I feel like I\'ve been scammed possibly by MetroPCS and smartpay. Why am I under a contract I wasn\'t properly informed about? I never signed anything in the store the whole thing is a nightmare. Can someone please assist me with legal advice. Thank You.

On jun 2023 purchase a phone from MetroPCS I was under the impression that the phone was free with the contract there was no talk about paying for the phone but later on I noticed on my bank account that $31 was being withdrawal from security credit service I had to bank stop all payments to them cuz I did not know why they were trying for my account now SmartPay leasing company has has it under collections on my credit report which is affecting any credit I apply for I had no idea of this payment until I noticed it on my bank statements which I did not offer raise anybody at Metro or same papers at Metro saying that any one of these two companies can remove moneyfrom my bank account I have no kind of paperwork this company smart pay no account number no balance number nothing I do not know anything about this company other than they were taking money out of my account and now it\'s reported on my credit report so if we can guide me in a direction to clear this up I will appreciate it thank you sincerely Josephordunez

Smart Pay Leasing has been sending letters to me saying I owe them $1459.00 . This is a fraud, it is phone leasing company, and I don\'t and never have leased a phone .
