Who is Capital One?

Capital One is a banking and financial corporation which also offers mortgages and credit cards and is based in Richmond, Virginia. It is the nation’s 10th-largest bank by total assets and also a top auto lender, though about 62% of its revenue derives from credit cards and 26% from consumer banking.Founded in 1995 – originally as a corporate spinoff of Signet, which is now owned by Wells Fargo – Capital One has been accredited with the Better Business Bureau since its founding, but has received over 4,500 consumer complaints via the BBB in the past three years, most of which are for product/service problems (2,200+) and billing/collection problems (2,000+).

Capital One Lawsuits

If you want to know just how unhappy consumers are with Capital One, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. Capital One Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Capital One violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Capital One took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Capital One, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Capital One continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Capital One is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide its citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have leverage to obtain a great settlement.

We will use state and federal laws to immediately stop Capital One’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if Capital One violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. Capital One closed both of my accounts that same week due to excessive returned payments. Two is not excessive. Why close both of my accounts? Only one had a problem. Customer service was rude and repeatedly hung up on me. None of their agents could tell me where in Capital One’s credit card agreement it states that two payments returned would close both of my accounts. Had I known this I may have never opened the card in the first place. Capital One is the only credit card so having it cancelled has a major effect on my credit rating, not to mention my ability to live in this day and age.”
  3. “DO NOT OPEN ANY ACCOUNTS WITH THIS COMPANY!!!!!!!! Just got off the phone with my 7th time calling in to resolve a technical issue, had 1 man tell me I don’t have an account, 1 man hung up on me, and other countless calls. I am very patient and kind, but I will not tolerate being hung up on. Every human I spoke to sounded like they had broken English and didn’t understand anything. Really disappointed.”

  3. “Capital One provides horrible customer service. Recourse on grievances is non-existent. My bank made an error in administering overpayment to a capital one card that I had paid off and cancelled. Capital One refunded a portion of the overpayment funds – but claimed they could not confirm receipt of the entire overpayment because they don’t track payments on cards that have been cancelled. Though amazingly they were able to send me a statement indicating that I owed them money as a payment adjustment on the cancelled card – which was wrong…Administratively, communication is horrible between departments. I gave Capital one the benefit of the doubt repeatedly. Just say NO. Don’t bother with this inept company that will leave you wishing you never signed up for one of their cards.”

Capital One – In December 2017, Peter of Ada County, Idaho, pursued a claim against Capital One for violations of the Telephone Consumer Protection Act (TCPA), including harassing phone calls and robocalls to the plaintiff’s cell phone. The case was resolved in February 2018 and Peter was happy with the result.
  2. Robert R. v. Capital One – In October 2017, Robert of Hillsborough County, Florida, pursued a claim against Capital One for violations of the Telephone Consumer Protection Act (TCPA) and Florida Consumer Collection Practices Act (FCCPA). Complaints included harassing phone calls to the plaintiff’s cell phone – over 100 within a few months – including after the plaintiff requested in writing that the calls stop. The case was resolved in December 2017 and Robert was pleased with the outcome.
  3. Abel V. v. Capital One – In November 2012, Abel of Hamilton County, Florida, pursued a claim against Capital One for violations of the Florida Consumer Collection Practices Act (FCCPA). Complaints included harassing phone calls and unlawfully attempting to enforce an illegitimate/uncollectible debt. The case was resolved in December 2012 and Abel was happy with the outcome.

Can Capital One Sue Me?

Yes, Capital One can sue you. Capital One can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. I DO NOT HAVE AN ACCOUNT WITH CAPITOL ONE BANK.THEY HAVE CALLED MY CELL IN ONE DAY ALMOST 15 TIMES AND THEN IT STARTS OVER THE NEXT DAY.CONTINOUS CALLS.I SPOKE WITH A PERSON THERE AND SHE TOLD ME I WOULD BE TAKEN OFF THEIR CALLING LIST.I AM STILL RECEIVING CALLS.THIS IS REALLY OUT OF THE RANGE OF NORMAL...CAN THIS BE STOPPED

They have been calling my phone 5-7 times a day. I have them blocked yet they still tend to call. And when they can't get me on my cell minutes/seconds later the house phone is ringing. It 98% of the time it says private caller. I've answered a few times and told them to stop harassing me. I'm paying little by little. I work part time and don't make much. So I pay what I can every month. Yet they still harass me. I've asked them to stop calling. I've even answered and said this is harassment stop calling and within minutes they call again. How do I get them stop calling my home, my cell... they won't even leave a message!

forgot to mention they start at 8:30am and stop calling around 8pm. And they call EVERYDAY including 8am on Saturday mornings... Hello.. only day off and I can't even sleep in!! And wakes up the kids. This has got to stop!!!!

Hello, I live in Canada. And I get these calls. From 8am to 9pm. Non stop. Can't even check email on my cell because of this. But they don't leave any messages. Is there anything I can do?

I got a new cell phone a few weeks ago and have gotten several calls from 1-800-482-4258 I have explained to them several times that I must have gotten the persons old cell # and I'm not the person their looking for and to please stop calling me but yet they continue to harass me. I'm sick of it!

My husband and I were having trouble paying our bills so we consolidated our 4 credit cards with a consolidation lawyer. They were able to help us with 3 cards saving us a lot of money, but the 4th (Capital One in my husband's name only) is suing us for $6,300 with their lawyers Zakheim & LaVrar. The original debt was around $4,500. We stopped paying the card around 1 1/2 years ago. They filed a summons in civil court in Sept 2014. Our lawyers helped us write and answer to the summons and we filed it in the courthouse within 10 days. We never got anymore papers until May 8, 2015. They filed a motion for summary judgement in court. We received this in the regular snail mail unregistered. The law firm calls me at least 3-4 times per day. Sometimes Zakheim & LaVrar themselves and sometimes it is an "unknown" caller. I do not answer these calls and I have never spoken to anyone from their law firm. Our consolidation lawyers say that we will probably have t o go to court with them. Can you help us? My husband and I are financially not able to pay these bills. That is why we consolidated our cards.

capital one has been calling me repeatedly for money i owe before 8 am. i've been getting calls from a number and just looked it up now and it was a capital one number and they've been calling me about 3 times a day and sometimes before 8 am!

Capital one is constant in calling in regards to a debt that we can not pay. can u explain what u do so I know if this ins worth looking into. 1st they call six times a day leave no message or name. 2nd we almost $500 that includes interest!

How do i know if i have a case. Should I tell my story? I had a capital one credit card i got in 08. So i was without a job shortly afterward and had a balance. Flash forward to 2010, I call to ask about using my card. I was instructed to pay it fully off and it would be reactivated. I pay it off and it doesmt work. So i call to see why. They then tell me it will never be able to be used again!

i think capital one is calling third parties. like family members and friends. well, i think they are trying to collect on debt but i'm not sure about it. i just know they are calling family members. i haven't had the time to call them back yet and request that they stop!

My son received a postcard claim form stating that he is part of a class action suit against Capital One. How do I get a claim form to be included as Capital One has been harassing me for years! My son is not available for me to get more info from him, but I have the postcard that arrived yesterday . It states that "if you rec'd one or more emergency calls on your cell between 1/18/2008 & 6/30/2014 or rec'd auto dial call between 2/28/2009 & 6/30/2014 in an attempt to collect a debt you may be entitled to a settlement. A $75,455,095 has been reached. Deadline to return form is 11/26/2014. Well, I generally don't answer calls because of harassing collectors . Do you know what number they will be calling from!

No matter which third parties they are calling and disclosing your debt, it violates the Fair Debt Collection Practices Act (FDCPA) to disclose your debt(s) to any third parties such as friends or family. Hi Robert. When they call your phone, is it a live person on the line or is it an automated voice speaking to you? It is certainly frustrating enough to be calling that often, but if they are using an automated system then they would likely be violating the Telephone Consumer Protection Act (TCPA). Capital One is suing me for a charged off credit card from a year ago. I fell behind when Covid 19 shutdown occurred, I was furloughed for 4 months from work. I went through my savings rather quickly and I had to make some tough choices. My pymt with them was over $300.00 so I had to stop paying that bill to ensure I could pay my rent and eat. I tried to make payments arrangements with what I could afford (50-75.00 a month) but it was not enough for them. They wanted full payments plus arrears. They told me once the account was charged off they could provide me with more options. I am currently in a bad financial state and can't afford to pay them. I have been served and need to respond to a 20 day letter and need some advice. I have no assets (No home) and recently had a car accident and no longer have a vehicle.

My employer received a call from 877-791-4054. They told my employer that they were calling from Capital One. They informed my employer I had unpaid debt with them that could affect my drivers license when they file a judgment against me. My employer is quite concerned as I drive a company truck. Mind you, I have never had a Capital One account. I called the number to see what was going on. They did identify themselves as calling from Capital One. They gave me a case number of 2022456347. They told me I had unpaid debt that resulted in 2004. I informed them, I have never had an account with them. They said I owed over $4000 and they would cut it in half if I paid now. I told them no. They said they were filing a case with my local county and that I could loose my license. I’m not sure if this is a scam call or if they have invalid information. They did have my current address and my previous address. I need some help figuring this out. Needless to say, my employer is concerned. I also thought it was illegal for a creditor to give out information to anyone other than the client. This is another reason why I’m not sure if this is a scam. I look forward to talking with you.

Hi Todd. It could be a scam that you're dealing with, or it could be that Capital One has the wrong information, or someone opened an account in your name. I have been paying Capital One as agreed upon, yet they wrongfully charged my account off. I had it investigated (they reviewed the phone calls I made with reps, heard how I was misinformed, and saw my payment etc) and they ruled in my favor. The account was supposed to be reactivated and chargeoff removed, but now they are saying that was also misinformation. I am paying them as I should be. I am in poor financial shape and health due to covid, and I am still trying to honor my financial responsibilities, but Capita One is harrassing me, lying to me, and have now closed this account without my consent when they are supposed to have reactivated it. I have thorough notes with agent names, IDs, dates, etc. I would like to see what options I may have for potentially suing them due to the time lost from work (on the phone with them), mental and physical distress, and the effect on my credit of this wrongful chargeoff. Thank you.
