Santander Consumer USA is an automotive financing company; they sell car loans nationwide, from their headquarters in Dallas, TX. Santander was founded in 1997, by a group of auto industry businessmen; the company is owned by Banco Santander. They sell new and used car loans, auto-refinancing packages (traditional and “cash-back”), and subprime loans for people with “bad credit” (this comes directly from their website).
What happens, though, if you find yourself in financial difficulty and you cannot pay your Santander bills? Well, you’re not alone. If Santander is contacting you to collect a debt, whether you owe it or not, Santander must follow the law. Santander is not accredited by the Better Business Bureau; but the BBB has received 2351 complaints about the company’s billing and collection department in the last twelve months alone.
If Santander has done anyone of the following, contact America’s Consumer Lawyer, for a free case evaluation:
• Called you after you told them to stop calling you.
• Called you about a debt you do not owe.
• Continued to call you after you have told the collector you cannot pay the debt.
• Communicated (phone or letter) with you after you filed for bankruptcy.
• Communicated (phone or letter) with you after you told the collector you have a lawyer.
• Called you before 8:00 a.m. or after 9:00 p.m.
• Called you at work after you told the collector you cannot receive such calls at work.
• Left you a voicemail message without saying the company’s name.
• Called third parties (family, friends, co-workers, or neighbors).
• Threatened legal action against you.
• Placed robocalls to you.
• Sent you unsolicited text messages.

Hello, I had that exact problem a year or so ago. The calls stopped coming, but then when I tried to go into the login and pw page to pay a bill, I could not access it. So I started sending in payments by mail, they cash them but no matter how many times I put my phone number down, or notate, that I need contact so I can find out my balance. No response what so ever. When I call the customer service number 888-222-4227. I enter the account number 1902008. They never come on the line, and I end up hanging up. I contacted my attorney that handled the case when they were harassing me, he cannot get any answers either. Maybe you can help. I would appreciate it.
Best,
Cecilia

Hi Cece, I have helped several other consumers who've had issues with Santander. How frustrating that you're paying your bill, yet Santander calls and harasses you. Let's talk about this on the phone. I'll call you. I'll help you write a letter to Santander to work out this issue. Thanks, Mike.
I have 2 car loans with Santandar and have had nothing but issues with this company. We have had my car loan for 6 years, the maturity date is up, we still owe money and the balance went up. The original amount of the car was an estimated $14,000.00...maturity date was up and it looked like we still owed estimated $3,800, the next month the balance jumped almost $1,000.00. They rhave also epossessed this car once with no notice and we had to pay $2000.00 to get it out of the repo shop. They have also called on nights, weekends, my husbands job, etc. My truck is also through Santandar and we are comin up on the maturity date and still owe a lot on this vehicle. I do not see how after 6 years paying $400 each per month that we still owe this much money on these vehicles. Granted, we have had late payments and defferred payments on both vehicles but it seems outrageous to still owe this much money on these vehicles. I requested an itemized statement on both v ehicles from the start of the loan in June or July and I can email them to you if needed. We also had to take out a small loan at a company calles EZ Money loan service. It was a $1000.00 loan, I pay $200.00 bi-weekly a month in interest...that's $400.00 a month in interest alone so of course I am not able to put anything on that actual principle so the balance stays the same. Is that high of an interest rate legal. Please let me know if there is anything that we can do about these companies. We feel helpless. Thank you.
I co-signed an auto loan with Citi Bank for my exwife several years ago. The loan was subsequently sold/transfered to Santander Consumer USA. I was informed recently that the loan had a remaining $4K+ balance due to changes that were made in the terms (this loan should have been paid off several years ago). Santander is now demanding full payment with any payments being made in less than the full amount going only to "interest charges". I contend that the changes made to the loan were not approved by me and that this constitutes a TIL or Regulation Z violation. I would like to have the loan dismissed with title to the vehicle going to me (or my ex-spouse) with a refund of any principal or interest payments made in excess of the original contract. Do I have a case. Please note, while some payments were late in being made, the note was never delinquent by current lending standards.

Santadar is contacting me pretty much daily and have been for a while, most of time is robocall, when they do leave a message they do not ID the company that they work for, They have left message for 2 or 3 different people.... I DO NOT have anything financed thru this company at all and never have, I have had my phone number for 4-5 years now.... I have requested that they remove my phone number from the system 9 times now, they refuse to do such and continue to call and harass me, for a debt that does not even belong to me.... When I called Santadar main company, they told me i need to go to a branch and request my number to be removed... really..... I don't live near a branch... I am not at all in debt to this company I DONT owe this company any money, I HAVE NEVER had a load with this company, they are making my life stressful because they call all the time.....
I received at least 20 robocalls from Santander USA.My cell phone number was provided on the credit application when they purchased my portfolio from the original lenders. Can I sue them for the calls or does it depends on if I checked a box saying I give them permission to call using the robo system?
Hello, I have a car loan with Santander and they are very annoying. They call after 8pm some days and they have even called my job and my families number after I have specifically told them to stop calling my family. I have been having a hard time paying my loan due to financial hardship and trying to help a family member financially and I have to them that and they are considerate at all. I just need help with these harrassing phone calls. And the phone number they use to call my job is a 401 number which is very strange. I hope you can help with this. Thank you
I believe Santander has harassed me with their collection practice s. Up until a month ago, Santander would call me at least 3 or 4 times a day. My car loan is currently 40 days past due. I'm no longer eligible for deferments and have trouble making monthly payments. Yes and at this time I'd prefer to type if you don't mind. I will seek another option. I'm not totally comfortable giving you my information!
I have an autoloan with santander usa, at 24%intetest.what would be an option to get the interest rate decreased? If possible. I've been a Santander customer for a year now,and i fall two months behind and the interest keep piling!
I need some info.. santander consumer is harassing us about our auto loan. Sure. We bought our 2010 honda civic here in hawaii in 2012 with financing through santander. Our payments were set at 396.34 each month and we paid it on time every time until my fiance got injured on the job in early 2014... for 2 years we have had difficulty paying the entire amount due but ALWAYS notified them if we were paying less or requesting help. They did lower our payments to 200 a Month for 6 months but that ended last august. They call every single day. I made 2 payments in march. Even though they were partial payments. I got a call last week and told the person when I would be abless to make a payment. . They called yesterday... I had to repeat the whole thing again... she just called again. Not even 24 hours later and not even close to the date I told them I'd make a payment. My fiance ended up having a breakdown and now they call me. I think they still try to call his phone but he won't answer it. I was nice to them until I started getting calls everyday despite already having answered their questions incessantly!
I was checking a number that keeps calling me and found your site. I get calls from debt collectors several times a day, almost every day, and I was curious to see whether or not this law firm is legitimate I'm ending the harassment!
As a poor business decision, I accepted a car loan offer from Santander. I've barely had the car for a year and in that time Santander has contacted no less than 3 family members of mine most of them not even being references so likely they used skip tracing to find people associated with me. The problem being that during none of these times in which they called my family members were I actually late on a payment. These calls all come as a result of Santander not having refreshed their system. So every time this happens I have to tell them to manually refresh their system but their go to seems to immediately contact my family members despite having a working number and e-mail for me. All I wanted to know was if this happens again whether or not I have any legal recourse because it feels as if my family members are needlessly being harassed!
Bought a 2007 ford fusion in 2013 for 13000. Contract up, paid every payment, late in some payments, but still owe over 8000 on loan. Rip off. Manager told me I would have to let my payments go delinquent for 60 days before I could get end of loan remod. Affected my credit. After numerous calls, they have offered me a contract to pay the remainder over 24 months at 4% interest and took off 3000 on balance. I havent signed anything. Yes they called my family over the years after I told them not to.
Hello, my name is Theresa Pritchett. I'm contacting you on behalf of my father Paul. My father is 71 years old. We live in North Carolina. In January 2020 my father received a marketing notice in the mail from a car dealership stating he could be a winner, he scratched off one of the boxes on the notice and of course, it stated he was a winner and he had to come to the dealership to get his prize. My father went to the dealership to see what he won. The car salesman showed my father a $33,000.00 truck. My father is on a fixed income, his social security check is $879 monthly. We tried to give the truck back but the dealer wouldn't take it. My father's pastor tried talking to the car salesman but nobody would help. It's no way my father should have been approved for that vehicle. They didn't request proof of income. They had to have falsified his application to get it approved. I called and asked for the paperwork but they would give it to me. I had my father call the finance company and request copies of the paperwork but they wouldn't agree to send him copies. I've since learned that a settlement had been reached regarding this illegal practice was my father had been a victim. I would like to know is it too late for my father to be apart of this settlement? He still has the truck.
I purchased a 2014 Toyota Camry from Carmax a little over a year ago. Santander financed it. This was a big mistake. I realized that after 72 months, I would have been paying double what the asking price was for the car. I started nursing school and had to choose between school and a high interest car note. Well, I did a voluntary repossession but Santander is still calling and coming after me for a $7000 balance. It's on my credit. I don't feel like I should owe anything after I voluntarily have them the car back
Please help me they have Harassed me and Wayover charge me for a car that was only $15,000 and I ended up paying over 27,000
They keep calling me even though they repossessed my car back in November
Corona virus inflicted great financial hardship on me and I was unable to make my Santander payment for my vehicle and they showed up at 9pm it so and repossessed it, which I rely on for work and school and babysitters for me and my 3 daughters.
Santander has been coming after me for debt owed to a title loan company. They have reported to my credit and unbeknownst to me have a judgment for money. They sent a service processor to my door. He gave me a summons to appear in court. I have to bring pay stubs (I’m a disabled vet who receives service connected compensation)

Hello! I purchased my car through CarMax. I have had this car for 6 years. I have reached my maturity date with an outstanding balance of almost $7000. I am not perfect and have had late payments over the years but even when I paid extra to try and catch back up it never made a dent in the interest. Now the minimum payment I can make is 2900 dollars. I feel like I have MORE than paid this car off. It has ruined my credit because of all the late payments they have reported over the years and I have tried and tried to trade it in for something else with no such luck. This car is ruining my life!

Hi LaToya. A debt collector cannot threaten you with legal action unless they plan on taking that step. These tactics are a violation of your rights (if they do not follow through). I would be happy to speak with you about the law and your rights--give me a call at 888 572 0176. Thanks, Mike

I got a car loan with Santander! I flew home for my dads memorial was gone for 5 days! When I returned my husband of 15years was gone! Took my 11yr old son! All of our expensive items and left a house full of memories behind. He had been having an affair and took off to another state.I had to take time off of my job that I had for 5 yrs to move out of my home In which I resided for 10 yrs! My new boss fired me saying he had been more than accommodating to my breakup! I just started another job! Santander calls me multiple times a day! They have not been willing to help with deferred payments or lower interest in any way. I’m still currently the spouse of 100% disabled Veteran if that will make any difference? They told me today that my vehicle is going to be repossessed if I don’t pay the $4000 balance in payments that I couldn’t pay while being out of work. I explained to them that as soon as I get a check I will pay them. They told me it will not make a difference unless the back payments are made. I asked if I could get my payment of $816 lowered by any chance? They didn’t even pause! Just a flat out no! I’m really in need of some help.

I\'ve been receiving calls twice a day for the past year regardless whether or not I\'ve been paid up to date on my auto loan. It\'s always robo calls with only half a message about hours of operation being left on my voicemail. They call on weekends as well, even after hours. My call log is filled with nothing but Santander Consumer robo calls. What are my options and am I entitled to any compensation if I file suit?
We have been paying on our car loan since 2016. Monthly payments $509. The car was $20,000. Our Maturity date is up. They say we owe them roughly $5,000. Our interest rate we have been paying is 17.85. I don\'t see how they can charge this interest legally and still try to get money out of us when our maturity date is up.
Maturity date with Santander. After 7 yrs this company is stating over $6000 is due. Since their past $550mil settlement And additionally a $14mil settlement for illegal repossessions one would think they\'d defer some contracts, but no. How can I get these pirates out of my hair without paying the ridiculos remaining amount? Thanks...
I want to pay off my loan and they are giving me a hard time. what can I do.
Santander continues fraudulent practices of excess charges, claiming double the amount on principal, not applying payments to principal, reporting erroneous information to credit agencies. I had a contract of 72 months paying $675/month since 2015. The car was $22,009. I have paid over $50,000! The maturity date was up October 2023 and santander claims I still owe $18,000. How is that even possible. They offered a new contract with 50 clauses about. not suing! They never checked my w-2’s, had co-signer review ( original contract had one)…Every single payment for 7 years has gone to interest? That was /should have been paid off years ago. If I continuing this route and continue paying until the new maturity date of May 2026, the $22,000 car would cost me over $90,000.
How can any company get away with these practices. I will not stop until I get resolution of both my money in interest back, the title to my car and knowing others get resolution, too. They are violating consumer rights in countless ways/laws.
I am a disabled senior citizen whom is having financial hardship and Santander is sending me threatening msgs saying they are going to get a court order to take my vehicle.I had sent the CEO of Santander a letter stating my financial hardship which they disregarded. My friend and also my POA looked at the loan contract and told me this is a predatory loan and falls under almost all definitions of predatory lending I am trying to get back on my feet by way of selling a portion of my home equity but the whole process takes time I need my vehicle I have health issues and need to have transportation can you help? Thank you for your time, Darrell Penner
Hi, in 2016 I got a loan from Santander. I couldn’t afford payments anymore so I gave them the car back. My loan amount was around 9,000 left to pay. They’ve been harassing me for years and will not negotiate. They called today and said they are threatening to sue because I now owe them 19,000. I do not have that kind of money. I seen you on Google while searching Santander. That’s why I am sending this message. Thank you.
Santander served me with attempt to reopen/revive a closed loan
I am a Missouri resident seeking representation for a complex consumer protection case involving fraud in a vehicle purchase, breach of warranties, defamation, unlawful repossession, and related statutory violations in Kansas and Missouri. The matter centers on a 2020 used BMW sedan I purchased in January 2023, with total estimated damages exceeding $100,000 (including financial losses, emotional distress, and punitive awards). I am prepared to pursue claims in Missouri or Kansas courts.
**Key Timeline of Events:**
- **January 20, 2023 (Purchase in Merriam, KS):** I traveled from Missouri to Baron BMW dealership with an insurance payout from a prior accident and $8,000 in personal funds to buy a specific vehicle. Upon arrival, the intended vehicle had been sold out from under me during my visit, pressuring me into an immediate upsell of a 2020 BMW 3 Series, which was deceptively marketed as a \"new, one-owner\" car. In reality, it had multiple prior owners and a rental history from other states, which was not disclosed—violating Kansas Consumer Protection Act (K.S.A. 50-626) and Missouri Merchandising Practices Act (RSMo 407.020). The financing through Santander Consumer USA involved fraudulent practices, including a hidden APR switch, use of an electronic pen pad for signature without displaying the full contract (breaching TILA, 15 U.S.C. § 1638), and no opportunity for review. Immediately after driving it home, dashboard warning lights appeared, revealing undisclosed defects that made it unfit for ordinary use, breaching implied and express warranties (K.S.A. 84-2-314/2-313; RSMo 400.2-314/2-313). Defects included brake sensor failures, electrical issues, headlight problems, transmission malfunctions, O2 sensor errors, iDrive display failures, faulty controls (volume knobs, seat adjustments, sunroof, power windows), forward collision assist system failures, cruise control issues, and remote software update errors.
- **Early 2023 (Initial Repairs):** I contacted the dealership promptly, and they took the vehicle for service but denied several confirmed issues verified by an independent service center. They returned it after negligent repairs with the same defects unresolved, and provided a brand-new rental during the process, which I perceived as another upsell tactic under K.S.A. 50-626 and RSMo 407.020.
- **Mid-2023 (Escalation and Parking):** I experienced a near-accident due to the forward collision system failure, endangering my safety and causing significant stress. To avoid further risks, I parked the vehicle on an associates private property in Missouri until I could secure legal representation. I engaged in extensive email communications (original thread available as PDF) with Clay Shafer, the dealership\'s General Manager, addressing the defects, misconduct, and my filing of Google reviews about the issues. In response, Shafer posted defamatory Google review responses making false accusations and blatantly defamatory claims against myself personally. He also made repeated threats to involve the Merriam Police Department, leading to a 45-minute call where officers confirmed no record of any complaint made towards me and asked if I wanted to pursue charges against him for false reporting (which I declined, preferring civil remedies). This constitutes libel/slander (K.S.A. 60-1001; RSMo 537.525), intentional infliction of emotional distress, and potential lemon law violations (K.S.A. 50-645; RSMo 407.560–579).
- **2023–May 2025 (Lender Issues):** Throughout this period, Santander lost multiple payments I made despite active arrangements, refused to verify the debt, denied access to account details and documents (interfering with my lemon law efforts), failed to accommodate my disability-related needs for fluent English-speaking support, and reported unverified negatives to credit bureaus, damaging my score (violating FDCPA, 15 U.S.C. § 1692; FCRA, 15 U.S.C. § 1681; and MMPA, RSMo 407.020).
- **May 22, 2025 (Repossession):** Despite ongoing payment arrangements and prior notifications of legal implications, Santander directed United Auto Recovery to repossess the vehicle from non-debtor private property in Missouri at approximately 1 AM without any prior notice or Cobb notice (per _Cobb v. Midwest Recovery Bureau Co._, 295 N.W.2d 232 (Minn. 1980), adopted in Missouri law). This involved unauthorized trespass (RSMo 569.140; RSMo 537.340), damaging the gate and land, and disabling both GPS trackers without notification—making it resemble theft. No note was left, and local police declined to assist in locating it, treating it as a civil matter. I immediately demanded its return, but it was released to ADESA Belton auction house.
- **May–August 2025 (Post-Repossession Chain):** ADESA held the vehicle unsold for over 90 days, allowing deterioration (e.g., battery drain, weather damage) in violation of commercially reasonable disposition and notice requirements (RSMo 400.9-610/611). Despite my repeated demands, they ignored my claims, refused storage logs/status updates, and failed to accommodate language/disability needs. On August 18, it was transferred to Carport Enterprises in Kansas City, MO, and then to America’s Auto Auction on August 22—both without due diligence on the disputed title, perpetuating fraud and conversion (RSMo 537.340; K.S.A. 50-626; RSMo 407.020). In June 2025, I visited the dealership with my father as a witness for VIN-related records (repair orders, service history, sales contract), but was denied full access and offered only screenshots, followed by renewed police threats from Shafer.
**Quantified Damages:** Financial: $8,000 down payment + $4,000 repairs + $3,250 lost wages + $250 travel + $2,000 credit repair + $22,000 debt. Loss of use: $10,000–$15,000 (90+ days). Emotional distress: $30,000–$150,000. Property damage: $2,000–$5,000 (gate/land). Statutory/punitive: $10,000–$250,000+ (FDCPA, FCRA, MMPA, etc.). Total: $100,000–$448,500+, plus attorney fees (K.S.A. 50-634; RSMo 407.025). The case aligns with a Kansas City PD investigation into predatory towing practices.
This case has significant overlap in areas I have not yet addressed, which often align with other cases against the lender,
\"Issuing loans to subprime borrowers who were unlikely to afford them
Failing to monitor dealerships who misrepresented loan terms
Overcharging for fees not included in contracts, such as convenience fees or processing fees
Harassing consumers with unsolicited, automated robocalls, violating federal collection laws
Providing inaccurate information to credit reporting agencies, negatively impacting consumer credit scores
Santander\'s dealership partners have been accused of pushing borrowers into overpriced vehicles and then inflating their income - misrepresenting the borrower\'s ability to repay the auto loan in order to secure loan approvals.
Borrowers have said that they were required to purchase costly add-on products like GAP insurance and extended warranties in order to get their Santander loan approved. And worse, some borrowers stated the dealerships added these products without their knowledge and informed consent.
I recently received a bill from Santander Communications USA for $40,062.37. Not sure what this bill is all about, I requested information from Santander Communications, but all I received was another bill. What are my options going forward?
