The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if SunUp Financial, LLC violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If SunUp Financial, LLC took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation.   1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

I had done business with balance credit aka sunup financial.. but I had paid them off butnthan I had an issue with my bank I didtn recognize a charge.. it ended up being them, balance credit and my bank ended up giving them the money back back but they stater they only got some of it back..so they garnished the rest of it from my check for way more than what I owed. Left and now I get a letter in the mail saying they charged off my debt when I actually paid it off. Is there anything that can be done..t this company has screwed me to no end

I had a loan with Balance Credit end of 2017 for $2500. I was set up a payment schedule of $312 twice a month. I fell behind in payments when my Mother fell Ill. I simply couldn't keep them up. I tried to work out a affordable plan with Balance and they would not budge. Instead, the escalated my balance to almost $8000! I was trying to pay it off with what I owed in Feb of 2018 but they would not accept it. They sent it to higher up to determine a lower payoff for me and came back with well over $6000 still! I simply could not do it. I tried to pay it off. They have sold this debt I guess over and over. I have had calls from several companies. So, have my family. Not sure how they even have their number. Anyway, Forsythe Finance is I suppose taking me to court for $8600 plus a lot of fees. I received a certified letter today (which I DID NOT sign for) just left in my mailbox. Not sure what to do. I cannot afford this kind of money. $6600 in interstate? I work for the airlines and it's been a horrible year. If I could arrange a plan to pay the balance of $2500 I would gladly do that. This is absurd. They were in no way willing to help back in 2018..if they had it would have been paid in full. Thank you for any guidance in this situation. Michelle

Hi Michelle. Did Sunup Financial LLC state what the additional fees were for? You can refuse to sign for a registered letter, however the company will typically send the letter regular mail after three attempts at getting a signature and consider it delivered once it arrives at your home. Was called today by a mediation firm stating their client was going to take action at the end of the week if I did not settle the account in full by paying their settlement offer. The alleged loan was for $600, however they say that the balance is now $2200 because of interest, would like to discuss options as I believe I had told this company I could not pay the payments anymore and they continued to call

I got this loan from balance credit to pay off hospital bills. I told them I got paid once a month. They started to charge me $269.18 twice a month. Then last year in November they took out 3 payments of 269.18. Then in December they took out 5 payments of $269.18 each. I didnot know they were charging me such high interest. I have paid 2 payments a month since last December. I didnot know about the $137 extra a month. Why the different charge. I have a car paid off and a house and never paid so much for a loan. I donot have $1300 to send you. I just sent in a payment of $268.18 which you should recevie shortly.. Please try to work something out for me. I have a husband that does not pay for this loan.. he is the reason for the bills. I will not bother him because of his condition. I do not accept phone calls because there is no privitsy here.. Thank you for your time. I can send in one payment of $ 538.56 on the second Wednesday and one payment of $137.00 a month on the third Wednesday of the month. Georgine

Balance credit has been harassing my family because I was late with 2 payments. I have been in contact and even making payments but it all goes to their interest and nothing to the principle. This is outrageous. They keep trying to take out payments twice a month after I told them I get paid once due to social security. I feel like this is predatory lending at its finest. What can I do? I will never be able to pay this back at this rate and my family and credit are being affected.

I had a credit balance with Sunup Financial back in August 2021. I was paying roughly $160/month and then they started charging more and twice a month instead of once a month. I had a fraud issue come up on my bank account in November 2021 so it was closed due to fraudulent transactions. My bank send an email to Sunup to let them know my account has now been closed and to contact me to receive my new information. I was never contacted by them, by email, phone or mail the entire time when I was trying to set up my payments again. Now I’m getting phone calls saying I’m being sued for breach of contract even though this is the first time I have heard about it since last year when I tried to get into touch. Any help/advise would be greatly appreciated.

A debt from 2019 shows up on credit file in Jan 2022 as a collection, I contacted the original creditor (Balance Credit) who no longer has the debt, they advised me to call Debt Mgt. Partners @ 1-800-883-9067, I contacted them and was told that the debt collection agency handling account is (Vance & Huffman LLC) I called them to inquire about the debt, (I didn’t acknowledge it as my debt), they sent me a copy of the loan agreement with my digital signature via email that was on file with the original creditor. An $850 loan now $2022 because of fees & interest. Have they validated the debt bcuz they have the loan agreement from the original creditor? if not, what do I do next? Thank you!
