Creditors like TitleMax cannot harass you over a debt. You have rights under the law, and we will stop the harassment once and for all.

THE BEST PART IS…

If TitleMax violated the law, you may be entitled to money damages and TitleMax will pay our fees and costs. You won’t owe us a dime for our services. Plus, some of our clients also receive debt relief and cleaned-up credit reports. You have nothing to lose!

Who is TitleMax?

TitleMax is a title-lending service based in Dallas, Texas, and Savannah, Georgia. Founded in 2000, it is not accredited by the Better Business Bureau (BBB).

TitleMax has been accused of, and paid fines for, “making false statements and/or misrepresentations regarding terms and conditions of its auto title loans, misrepresenting first payment amounts,” and “overcharging interest rates and admin fees in addition to charging borrowers third party DMV handling fees.”

TitleMax maintains over 1,000 locations in Alabama, Arizona, Georgia, Illinois, Missouri, Nevada, South Carolina, Tennessee, and Texas.

TitleMax’s Address, Phone Number, and Contact Information

TitleMax is located at 15 Bull Street, Savannah, GA 31401. The main telephone number is 888-485-3629 and the main website is www.titlemax.com/.

Phone Numbers Used by TitleMax

Like many creditors, TitleMax may use many different phone numbers to contact debtors. Here are additional numbers TitleMax may be calling you from:

  • 804-291-9245
  • 817-370-1470
  • 972-543-4744

TitleMax Lawsuits

If you want to know just how unhappy consumers are with TitleMax, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. While it can be difficult to get a fair chance in arbitration, the good news is we have filed hundreds of credit harassment cases in arbitration, and we know how to aggressively fight these cases against the big banks and businesses even when arbitration is necessary.

TitleMax Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if TitleMax violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If TitleMax took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. TitleMax, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did TitleMax continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If TitleMax is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop TitleMax’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if TitleMax violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. For example, under the FDCPA, you may receive up to $1,000 in damages plus actual damages. The FDCPA also has a fee-shift provision, which means the debt collector will pay your attorneys’ fees and costs. If you have a TCPA case against the agency, we will handle it based on a contingency fee and you won’t pay us a dime unless you win.

THAT’S NOT ALL…

We have helped thousands of consumers stop phone calls.  We know how to stop the harassment and get you money damages. Once again: you will not pay us a dime for our services. We will help you based on a fee-shift provision and/or contingency fee, and the debt collector will pay your attorneys’ fees and costs.

What if TitleMax is on My Credit Report?

Based on our experience, some debt collectors may credit-report, which means one may mark your credit report with the debt they are trying to collect. In addition to or instead of the debt collector, the original creditor may also be on your credit report in a separate entry, and it’s important to properly identify these entities because you will want both to update your credit report if or when you pay off the debt.

THE GOOD NEWS IS…

If TitleMax is on your credit report, we can help you dispute it. Mistakes on your credit report can be very costly: along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or even being a victim of identity theft. If you have a mistake on your credit report, there is a process to dispute it, and my office will help you obtain your credit report and dispute any inaccurate information.

REMEMBER…

If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (FCRA), you may be entitled to statutory damages up to $1,000, and the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision, which means the credit reporting agency will pay your attorneys’ fees and costs. You won’t owe us a dime for our services. We have helped hundreds of consumers fix inaccurate information on their credit reports, and we’re ready to help you, too.

Can TitleMax Sue Me?

Yes, TitleMax can sue you. TitleMax can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. If you’ve been sued by TitleMax, do not ignore the lawsuit; you may have defenses. If you ignore the lawsuit, the default will be entered and the agency may seek to garnish your wages. If you receive notice of a lawsuit, contact an experienced attorney as soon as possible, even if you intend to represent yourself pro se. If TitleMax has threatened to sue you, contact Mike Agruss Law as soon as possible; we’re here to help.

Can TitleMax Garnish My Wages?

Yes, if TitleMax has a judgment entered against you. If TitleMax is currently garnishing your wages or threatening to do so, contact our office as soon as possible.

TitleMax Settlement

If you want to settle a debt with TitleMax, ask yourself these questions first:

  1. Do I really owe this debt?
  2. Is this debt within the statute of limitations?
  3. Is this debt on my credit report?
  4. If I pay this debt, will TitleMax remove it from my credit report?
  5. If I pay this debt, will the third-party debt collector remove it from my credit report?
  6. If I pay this debt, will I receive written confirmation from TitleMax confirming the payment and settlement terms?

These are not the only things to consider when dealing with debt collectors. We are here to help you answer the questions above, and much more. Whether it’s harassment, settlement, pay-for-delete, or any other legal issue with TitleMax, we at Mike Agruss Law are here to help you.

Top Debt Collection Violations

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often do to violate the law.

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

Frequently Asked Questions

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery. Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.
  2. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.
  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.
  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.
  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.
  6. Are mistakes on credit reports common? Yes! Are you one of the 40 million Americans that have a mistake on their credit report? Mistakes on your credit report can be very costly. Along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or maybe you were a victim of identity theft.
  7. What do I do if I have a mistake on my credit report? If you have a mistake on your credit report, there is a process to dispute them. My office will help you pull your credit report and dispute any inaccurate information. If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (“FCRA”), you may be entitled to statutory damages up to $1,000.00, plus the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision. This means, the credit reporting agency pays your attorney’s fees and costs. Therefore, you will not pay me a penny for my time. To speed up the process, please get a free copy of your credit report at www.annualcreditreport.com. You can also learn more about the FCRA and your rights at http://www.agrussconsumerlaw.com/practices/common-credit-report-errors/.

So I had a title Max loan for $1000 after 4 months I had received a notice stating that they were trying to repossess my vehicle after I have already made payments and according to title Max they told me that they never received one single dollar from me and had a tow truck repossess my vehicle Doing so he did not toe it like a normal person he towed it from the side and it is a 4 door Ford F150 Doing so the way he towed it busted the actual cracked offender damaged the suspension the drive shaft is hanging down and I have videos and pictures to prove the person who did it the licence plate that came from with the tow truck and have videos of the police telling me that I should fight the tow truck driver so he can take both of us to jail. All of this was recorded on video and pictures of the way he damaged my truck was not the exact right way to tow a vehicle he pulled all 4 tires sideways out of the complex damaging almost every aspect of the vehicle and I am a contractor and that is the only way I am able to work by having a truck even though I have been making payments they refused to accept my payments and decided to tow away my vehicle totally in the process Causing me to have to go get more Loans to be able to support my family my way of living and rent a vehicle to actually even work they took company property that was inside of the truck and refused to give it back and the tow truck driver taunted me the entire time saying all just flip it over so you'll never have it again and all this is on video So trying to find some input on what my legal actions are

i’m very minority female in State if California around majorities that r minorities in many other part of US but not State of California. When it comes to cars, repairs, goods, apartments rental mostly is done with one same sort of Hispanic majority in California, then African-Americans r holding entry level positions and r second very systematically discriminating against minority like myself, with mixed kid and without rest of family for decades .. We been hurt many x before in State of California for over a decade and by more then few major company /agency names but we still don’t have it good that we can afford and organize going after those claims. Right now our car is taken by TitleMax in California second x. First time it happen Christmas Day and my 14 yr old only child’s B Day. Then i got it back missing even kids backpack as the moved car to N Ca & took our staff out, then they took our car past Santa Monica NW California.. I end up paying for car and extra tow as it wouldn’t start and key was changed.. I cried all hurt with daughter child. Car was damaged after that or something was done to it coz it didn’t sound great . Pandemic started and i made few payment that didn’t go towards balance. Payments I made before 1st repo didn’t go towards balance. I paid $3500 toward 4000 loan and 0 when to balance. Now during covid to me mother and child they repo car and it’s in Santa Ana, very mexi area .. Feeling so hurt thinking about car in dust and dirt with men that repo it there. When i called about it first person on phone was African-american with Titlemax beating me down with words, hitting me with accusations of no payment during covid and killing me softly.. I asked for supervisor and his Hispanic girl homie answered with same detonation from words pounding in my ear that they don’t care what i got to say and that they demand cash only one sum payment during covid when we can’t even get to school and poultry to get food without car. Yesterday i just got extension 10 days to pay $3900 during covid without job and just after stay at home order. I have no money to live. My kid has only me. Balance after my last payment in April was $4200 again .. now they even put $500 their extra fees plus $150 repo fee.. Car will prob be even more damaged. I did haveaccident 4/11 that left car with small side dent and me and kid didn’t get care yet as we should. Going to doctor or mechanic that don’t wear mask was more damage and risk so we were waiting to do it.. Without our car we cant go to doctors, school or to get food and basics because they r not close and i’m getting older. I called titlemax again trying to talk to same people again but they r downplaying same game to them, demanding cash without any more discount ( they r giving 20% of from $4900 balance , not even from $4200 what was balance again in April when i made last payment before their stores were shoot down). I was told that this male person will not be on my file when i get extension but he put his name on it so i have to talk to him( or listen to him yelling at me). I’m feeling so hurt and damaged rn and it’s 2:30 am. - JA

I paid off my loan with Title Max in Dec 2018, they gave me my title back the next month showing all liens were released. Well today I thought my car had been stolen out of my driveway so I called the police to report it & they let me know that Title Max repossessed it!!! How is that possible???!!! I got my tag renewal from the clerks office & noticed that the title # they have listed is different than the one Title Max issued me 2 years ago. They were closed before I realized my car was gone so I haven’t been able to find out what’s going on. But something is very wrong! Usually they send notices in the mail and blow up your phone but I’ve had no correspondence from them at all.

Hi Alecia. This does sound like something has gone wrong, have they ever left any messages with the calls? What did the notices in the mail state? Did they state why they sent the title if the liens weren't completed? I'd be happy to talk more about this with you and I will call you or you can contact me at your earliest convenience at 312-224-4695. Thanks, Mike

Hi Hemanth. Your story is like so many others I've heard in dealing with Titlemax. Their interest rates and the way they apply payments is often confusing. I would be happy to discuss with you how to deal with your title loan. Please contact my office when you're available to speak for a few minutes and we can discuss the specifics of your case and your possible options. Thanks, Mike

Hi Laree. Did you receive confirmation that your title loan was paid in full from Titlemax? Depending on the state you're in, Titlemax has a certain amount of time to provide you with a proof of the lien being taken care of, as well as different terms according to each state. What state are you located in? Let's talk more about this when I give you a call. We can work with you to get that car title back. Thanks, Mike

At first they seemed nice and emergency something that was out of your hands and there is nothing you can do but wait and keep in contact with people. And due to the situation that happen and now you are without a job and have been looking for a job. And u can make a payment cause you are waiting for money to come in and 2hen it doesn't. That doesn't give this company the right to disrespect me by saying go get a job, when you have been Applying. They don't know the situation that cause me to not have a job, they should be patient and continue to work with people. It is still h The pandemic. AND I was affended by this

Titlemax loaned me money on my title knowing that I was unemployed and took my friends word that she would be making the payments, but didn't make her sign anything. My friend was supposed to pay my title out when she got her income tax, $10,000. Each time the payment came due, my friend would have me go back in and nenew the loan to put the payment off for another month, due to an issue with her tax refund. Each time the TitleMax employee knew my friend was saying she would pay it out. When the loan was maxed out, my friend went in TitleMax to make a payment. She told The TitleMax employee she was paying it out as soon as she got her income tax return. Needless to say, I had to come up with the second payment because my friend finally got her tax refund and did not pay it out. Now I am late with the payment and they are calling me. My friend went in TitleMax, without me, and they gave her a print out Of the amount owed. The loan total is $10,000. Due to the monthly payment, $1000, being late, the monthly payment is almost $1800 and pay off is now over $11,000.

I received a loan from Titlemax in October and I made 4 $500 payments. I called the store because I lost my job and they said they would work with me. I got a job offer in Florida, I told them and they noted my account. They came and got my car without warning and I was told I could get it back if I paid the past due amount. I called the store and all stores in Illinois have closed and all accounts got transferred to Texas. Texas told me I have to pay the full amount due and I only have until Jun 3rd to get it paid. They said Illinois did not make any notes just my address change and basically its not their problem. I told them I have the means to pay now and they refuse to do anything.

Hi Vickie. Unfortunately, title loans are in a gray area similar to payday loans in regulations and lenders like these types of loans because they are no risk for them. I'd be happy to discuss this with you when I reach out. Thanks, Mike

Hi Cyndi. Places like Titlemax prey on consumers who have low or no credit and brag about not doing credit checks to draw people in. I'm sorry that your friend has put you in this difficult position. I would like to talk more about this to determine if any laws were violated in what they did with no actual contract with her. Please give me a call at my office at 312-224-4695 when you’re free. Titleax insisted that I install their app after receiving a $2500 loan, I used the app to refinance and now I owe over $40,000. I told them that my income varies between 1200 to 1500 a month. How am I supposed to pay them 1100 each month for 36 months. Now they took my car. When I called them they said they called and left messages but never said they were calling on behalf of titlemax.

Seriously misleading info...it borrowed 1500$...now my monthly payment is 378$. I applied of a "loan"...they are stating that i applied of a " open line of credit" because I live in the state of TN. I am on a fixed monthly

Hi Thelma. Unfortunately, lenders like this are known for toeing the line between loans and open lines of credit, making it difficult for consumers to pay back their loans. I am sure it can be frustrating, especially when you're on a fixed monthly income. I would be happy to speak to you about this and see how we can work together on getting this resolved. I will be in touch. Thanks, Mike

I had gotten a title loan at Title max and was told the interest total was $647 plus the amount I borrowed. I then asked to extend it another 30 days they said that is fine just pay off the interest so I paid the $647 in interest. They then said I could get an additional amount of money of $3000 and it would only be an additional $300 for a TOTAL of $945 in interest so I did that. I asked them two times in the store, so If I extended it and get the other $3000 then the TOTAL interest is only $945 they said yes. Now I am going to pay off the loan and I am being told that is not the case. That the $647 I already paid was not deducted from the TOTAL interest they told me but it was EACH MONTH they NEVER told me that, they never gave me anything in writting to that effect. When I signed the paperwork they did not give me a copy they said you can see it online and I asked again, so the interest total is only $945 they said yes. Not ONE time did they say its the interest EVERY MONTH. So I paid the interest in FULL for the original $4000 I got then they are now saying they actually lended me $7000 and so they are recharging the interest on $7000 as if I didnt pay anything!! I did not agree to that so they are trying to collect $1582 in interest on a loan I already paid the interest for the $4000 and they are now double charging the interest on the whole amount instead of only the $3000 addition. I did not take a loan for $7000, it was only $4000 and that was extended then $3000 so they should not be charging me twice on the $4000 that is fraud! They NEVER told me interst only payments to extend then they will start a new loan and charge interest on that amount and not credit the interest I already paid! I never agreed to that and I was NOT told that at all. Now they want to say oh well sorry I guess we misunderstood you when you asked what the total interest was!! I NEVER would have paid or agreed to pay $1582 on a $7000 loan that is insane and should be illegal. What they told me is NOT what they are charging me

I have a so called title loan with TitleMax in Tennessee and I’m just finding out that it’s a credit loan that was due the following month after I borrowed the money. I would had never agreed to that had I been explained that by the general manager that took my application. She pointed out a 374$ interest payment as if it were my monthly payment. I just paid them 1400 to recover my vehicle that they repossessed. And my account is showing that I still owe them over 2800 even after the payment I just made. Is there anything I can do to get out of this? I’m self employed and struggling financially. I just became a mobile notary and need my vehicle to take any work that comes my way but with this lingering issue I fear they will be coming for my car again.

Hi Michael. I'm sorry to hear that your wife had an anxiety attack due to what a TitleMax representative did. The law does not allow for debt collectors to threaten consumers and they certainly are not permitted to threaten legal action unless they absolutely have the intention of following through. This is a common practice within the debt collection world, unfortunately, but rarely do they follow through. This doesn't mean they won't pursue a lawsuit, but again, it depends on the situation. I would be happy to speak with you about your case and determine what we can do to get this taken care of. I will give you a call or you can contact me at my office and we can have a free, no-obligation consultation. Thanks, Mike 888 572 0176

I was making payments on time until my hours were cut at work. TitleMax literally called me 10 times a day and leaving messages. I made aware that I was in a transitioning process and couldn’t make payments. I owed $700+ For the idle month plus fees, 3,584 total loan. I decided to turn the car over and they still called me asking for money and charging me a new balance of $394 for December despite having the vehicle
Michael Agruss
Hi Marvin. Unfortunately, when a car is repossessed, either by force or voluntarily, you may still owe money if the value of the car when sold won't cover what you owe. This is called a deficiency balance and in most states the lender can attempt to collect payment for this. You have some options, which include paying the balance, negotiating a settlement, or letting the debt go--usually only an option if you are deemed "judgment proof"--meaning you have little to no assets or income that can be seized. However, before making a decision on what is your best course of action, you may want to discuss this with an attorney first. I would be happy to speak with you about the law, your case, and your options in a free, no-obligation consultation. Give me a call at 888 572 0176. Thanks, Mike

My son had a loan with titlemax. It went into default and they repossessed the vehicle. In the process of being repoed , there was a fused removed that caused the vehicle not to be able to be put into gear. i'm guessing it was done to move the vehicle by the assigned repo tow company( MVTRAC LLC). I immediately had to take it to a Nissan dealership and inquired a $268.20 repair bill. What is my avenue to be reimbursed?

Yea I have en existing titleloan with TitleMax I want to handle I am up to date with my current payments but the more payments I make the higher it goes now they want 1400 to renew loan by may 1 cause it was a period of five months I have paid over 8000 and should have the payment on may 1 of 10449.21 AFTER paying my payments but what I’m understanding most of payments went to interest and very little to principle..on contract and verbal stated if payment is made before the due date it goes to principle if payment on first of ever month is not fully paid I have ten after the due date to pay the full if not the payment after goes to Interest and I have done that my first payment before the due date was 4000 but that whole amount I paid first all of it went to interest which TitleMax decided to do and not follow contract I was supposed to be ahead with payments but no and I’ve been paying payments and when I spoke with the person. She stated I had now owed 7000 now it’s changed to 9000 HOW???they don’t explain well and I do NOT want to lose my vehicle HELP ME PLEASE!!!!

My husband took out a title loan with Titlemax in 2015 on a 2014 Chevy Spark. He made the payments on time and took out more money in 2019 and his rates when up. He ended up falling behind on his payments and took the car to the Titlemax office to surrender the car and they would not take it. They instructed him to call their corporate office and he did, but no one ever got back to him. Per the local office, he was trying to get a settlement (he has paid them over $42,000 for a $14,000 car) but no one called him back. A few months later, he reached out to them again and was left on hold so long that he had to hang up; the representative that he was to speak to was never available. My husband went out of town for a few days at the beginning of May and when he returned to his parents house (where the car was parked) the car was gone. He received a letter in the mail stating that he had 60 days to claim his belongings from the car. The letter referenced Titlemax but did not tell him where to go. After several days of trying to find the place to get his things, he went to the location and they told him that he had to make an appointment to get his stuff. When he went back for his appointment, they gave him a box of things that they collected from the car but would not let him go to the car to retrieve the rest of his things from the car. He is now concerned that since he owes Titlemax over $6000 and the car is not valued that high, he will still owe them money. Is that true? Should Titlemax have given him 30 days to cure the default after they repossessed the vehicle? Does he have grounds for a lawsuit?

I took out a loan in August 2021 for 3800.00, I was late a few times and always paid whatever late fees and penalties occurred. Endless calls of late payment even if it was a day, sometimes they would call before it was due. Finally I paid the entire loan off. In May 2022 I paid 4297.82 to get my title back. So I keep calling to see when I should except my title. Numerous excuses after excuses, finally a manager calls to tell me well there is a ghost lien on your title so we never where on it. What is that I ask why didn\'t anyone say that when you guys were harassing me for months and months. I\'m not sure is the response the manager gave me followed by well we just found out when we went to send for a lien release. So now it\'s October and still no title. What can I do?

I am trying to find out if Titlemax closes your, refuses payment, and puts a block on your name is that a clear indication that titlemax has sold your debt to a collection agency? Also, what collection agencies does titlemax use? I know they are doing something illegal due to while on the phone with a titlemax supervisor as soon as I mentioned that I had spoke with MVD and the State Attorney General the supervisor instantly hung up on me. They are trying to double dip on me and I called them out on it. A cs representative for title max all but confirmed that my debt was sold to a collection agency. Then he tried walking it back when I asked why if they sold my debt, does titlemax still have a lien on my vehicle? That I didn\'t owe them a penny and what they were doing is illegal. Yer, they refuse to remove the lien. I went to a store shortly after and the girl working there tried telling me that they will eventually find my vehicle and they will repo it. I looked at her and said it\'s already been 3 years and that they will never repo it and went to walk out. As i got to the door i turned and said that my vehicle currently is at a titlemax location parked for 4-5 hours a day and yet still no repo. Then I left.

I got a title loan from Titlemax in Kennett, Missouri for $2,060.⁸⁹ on April 21, 2021 and my payments were set up to be $353.⁸⁴/month and I made payments up until Nov. 3, 2021 and I haven\'t heard from them since July 14, 2021, MO First Notice of Default, and haven\'t had an issue until now with them wanting to repo my car after 12 months, I didn\'t give them my new phone number bc I had to get a new number due to them calling all day everyday and my ain\'t said they come looking for my car at her house yesterday afternoon around 4p and they got her address because she had made a couple payments for me and I guess they found out her address that way bc her name and phone number were listed as references on my application but not addresses and they hired someone in Arkansas to come looking for my car..

On October 1st 2022, I went into TitleMax to get a title loan as I was need of cash. When I went in there were 2 other people getting loans. There was only 1 person working. The person was trying to help all 3 of us at once so we really didn’t get individual attention. When it was my turn the representative just said sign here and here. Two signatures in total. He said everything was electronic and skipped all the information regarding the loan I didn’t get any information regarding the loan. Days later I decide to take out the remainder of the loan that was offered on to look into the loan and the interest is exorbitant. I tried to repay it but the company blocked my ability to do so in the 48 cancellation window. There is no way I could afford this loan. I should been given disclosures and interest rate sheet. Instead the agent in a haste skipped over everything to get me out. I filed a complaint with the Consumer Financial Protect Bureau, they instructed me to reach out to the director of operation which told me to reach out to legal. I reached out legal and have not received a response. I can’t afford this and the company is making me go in circles.

just had a question. I have a loan and it fell behind. I now have the money and always get the loan and pay online thru the titlemax website. conveniently I have had no calls about being behind but the kicker is now that I am behind the option to pay online is no longer there. it has disappeared altogether resulting in an additional 13 dollar fee per day. I have the money in hand/account today but their office is closed so I will now be charged another 13 dollars more tomorrow after I go directly to their office to pay or I call I guess is an option. what seems not right is after a certain time one week, two, three weeks I don\'t know but they take away the option to pay online. it literally disappeared. I feel this is a scam to get even more money out of someone that is already struggling and ultimately take their vehicle. just thought I might bring it to someone\'s attention.

I\'ve had a small HVAC service business, since 1987. I, unfortunately got in a situation, in which I couldn\'t pay the bills, soooo.... I turned to Titlemax, as I had used them once back ine2017, all went well. I set up a line of credit of $4000.00. The issue is that I have payments due, I\'m pretty much broke, yet they refuse to work with me. I put my 2018 VW Tiguan, up as collateral!!! I\'m at a loss, as I\'ve never experienced, a lender that refuses to work with their customers!!!! And, this is the 2nd time I\'ve from them!! Which is kind of astounding to me, that they simply refuse to work with their customers!!! I need help!!! PLEASE

I pawned my title with title max and was past due by one day or so when Title max called my mother in law and told her they were trying to get a payment from me. Therefore they disclosed that I owed a debt to them and for her to get in contact with me and let them know that they were trying to get in touch with about a payment owed to them. I have proof of the call and I told them my car was deemed a total loss and the insurance company even called and told them and it was notated on my account . They kept harassing me daily to pay the debt to them and that I was in collections even though they knew the check was on the way . She said they have to continue to call me because until they get paid it’s in collections. But the payment was on the way and my car was deemed total loss and they kept charging me daily even after the payment was on the way. It’s been almost 3 full weeks going on 4. I need someone to help me see if this violates my contract or terms of agreement .

Three years ago I borrowed $1500 from TitleMax. They told me they were going to mail. My phone is closer to me so I know what I’m paying him with the interest rate of being they never showed me the disclosure form she turned the computer around have you initial something turn back around gave me cash $1500 today and he put on a little credit card the next day to $500 that I had left on the card right came up missing I contacted Dave about it and asked him for a copy of my disclosure form they told me they do not give disclosure funds to customers they are after Covid started I called about to take you know I’ll take my loan somewhere else. Let me have a payoff for what I owe, they told me I owe $6875 in less than a month and they said they do. I won’t be able to get my loan sent somewhere else since then my sister who also took out a loan from TitleMax bald $3000 on a car is only worth about $800. She’s on a fixed income such as I am and they decided to repo her car today she’s handicap in using a walker. They repo her car. The tags are crossing kind of waiting for her around town, and then finally repo the car with all her merchandise, her purse, everything within a day, and when she called the Bear paw blockage, what kind of pay off she has they told me laugh better so I think it’s a very safe situation here in Arizona with TitleMax charging all these outrageous rates and then of course not. Fully disclosing the long now I am a paralegal and I do need legal help as soon as possible. Please contact me I know it’s late Friday please contact me as early as Monday so we can get started on something to basically get a cease-and-desist against him hopefully get my sisters car return to work so she can’t afford to get it all. And at this point she doesn’t want the car she doesn’t want to ruin your credit. My number is 520-365-6601. I would appreciate a call as soon as possible as soon as possible.

My phone died when they called about my payment and they repossessed my vehicle the next day. I tried to get the items left in my car and was told I had to speak with someone else that was not there. They did not send notice of auction and it\'s been a year so I am assuming it\'s been sold and I still have not received anything telling me what they did with my car or how much they got and I was told this is something they had to do by law.

title max data breach caused fraud on my accounts, then they denied me a loan refusing to give my title back, but they send me documentation stating they sent the loan to an account that is not my account

I paid off my loan with title Max, they couldn’t find my title but told me to file for a lost title and gave me a lien release. So I did just that, got a new title without them as the lien holder. 7 months later, title max comes and repos my truck saying I haven’t made a payment and they have my title ….. They are in the wrong and I want my truck back asap!!! ! I have proof of my payment, a new title without them as lien holder They have never even sent a letter stating I am late or anything, BECAUSE THE LOAN HAS ALREADY BEEN PAID OFF!! They need to release my truck to me asap

I have a title loan that I can never pay off the interest rate is 186% it is killing me they call me telling me my car is up for repo if I am late it is ridiculous I am tired of paying and all is only interest. NM has a law that passed the interest is only suppose to be 36% and when I told them this they said my agreement was before they passed the law so they cant make adjustments. please help.

In April I got a Secondary Title Loan with TM for $3800. The interest is 156%. I have paid them $3200 but lost my job and missed 3 payments. They repossessed my truck and then called the following day and said I could get it back for $1500, but the same loan would be in effect. Is this legal?

Titlemax recently unrightfully towed my vehicle last week after I paid them. I got my car back and I had to get another battery. This caused severe stress and inconvenienced my job and also my finances. In addition to that, I went to the Emergency room Saturday, Feb 24th and was stranded there because I did not have a vehicle. I would like to pursue a case against them. They did bring my car back at no additional cost but the damage that it has done to me mentally and financially has caused a great upheaval in my life. I am an engineer and I work for an aerospace company so this all has set me back at my job as well. Please advise. Thank you.
