Parents purchase toys every day for their children and assume that these toys will be safe. Unfortunately, just like any other product on the market, toys can be defective and dangerous and put children at risk for serious injuries that were preventable if the toys had been designed and manufactured properly.

Defective toys are recalled frequently due to loose pieces, faulty features, or because they pose a risk for choking. Some of these recalls occur before children are injured, while some only occur after a child is injured or killed.

If your child has been injured due to a toy, contact Mike Agruss Law for a free consultation. Legal Liability in Toy Injuries

Toy recalls can be tremendously expensive for manufacturers and unfortunately, they are often delayed. When toy recalls are not completed in a timely manner, children are injured, sometimes seriously. The Consumer Product Safety Commission (CPSC) will typically order a toy recall after reports of injuries or life-threatening situations have occurred.

Following a toy recall, lawsuits are often filed against the manufacturer or other party in the chain of distribution of the defective of dangerous toy. For a product liability case to be successful, the plaintiff must show beyond a preponderance of the evidence that the toy had a defect and that the defect was the direct cause of the child’s injuries or death.

Unfortunately, toy recall cases are often complex, but not impossible. If your child was injured by a defective or dangerous toy, an experienced personal injury lawyer can wade through the complexities of product liability law and they can review your claim and determine who may be liable for their injuries and what compensation they may be entitled to.

We at Mike Agruss Law are proud to serve our fellow citizens in personal injury cases, especially when you or a loved one has been injured, and we are fully committed to protecting your rights and ensuring that the other party is held legally accountable when negligence occurs.
