Weather-Related Pedestrian Accidents

Just as weather can be a factor in traffic accidents between vehicles, it can also contribute to accidents involving a vehicle and pedestrian, especially via decreased visibility. In the fall and winter months, the sun sets earlier and we experience much more darkness during the daytime; heavy rain or fog can significantly reduce visibility for both short and long distances; and too little caution while driving in a snowstorm can quickly result in lost control and a preventable accident.

Despite the effects of inclement weather on our roadways, drivers are still responsible for driving safely in accordance with present weather conditions. Drivers are obligated to move slower and more carefully in heavy rain or snow, for example, because it is necessary so that drivers may not lose control of their vehicles or strike something in the road that they did not see in time. This is where pedestrians come in: even if a driver did not see you because of poor weather conditions, they may still be legally liable for the accident, provided that you had the right-of-way as the pedestrian.

We are proud to serve our fellow citizens in personal injury cases, including when you or a loved one has been injured in a pedestrian accident.
