What are the dangers of using defective farm equipment?

Working with heavy equipment and machinery on a farm is a daily occurrence, but it is not without risk. Most farmers understand that agriculture is dangerous. However, many farmers and agricultural workers are injured, and in some cases it is beyond their control, such as accidents involving defective farm equipment.
When a company designs equipment without proper safeguards, protective enclosures, and/or shut-off switches workers can be injured. The most commonly seen design defects include:

  • Pinch points-points where two objects on the machine make contact, with at least one of them moving in a circular motion.
  • Wrap points-any exposed, rotating machine component attached at one end to a piece of equipment. These areas can pull clothing or limbs into the machine.
  • Spring points-released springs.
  • Freewheeling points-farm equipment parts, such as rotary motor blades and baler flywheels, that continue to rotate even after the equipment is turned off.
  • Hydraulic lifts and hoses-hydraulic lifts raise and support heavy objects and assist in steering and braking. When these systems fail they can crush a worker, eject high-pressure blasts of oil, and emit toxic fluids that can cause irritation and burns.
Defective farm equipment injuries are on the rise, with scores of people injured every year due to defective mowers, tractors, plows, hoes, planters, balers, sprayers, harvesters, and shredders, to name a few. Injuries from defective farm equipment are often serious, debilitating, and life-long, including:

  • Electrocution
  • Burns
  • Crushing injuries
  • Fractures
  • Amputation
  • Traumatic brain injuries
  • Spine injuries
  • Death
Holding defective farm equipment manufacturers accountable not only helps the injured party but also prevents the manufacturer from continuing to create defective products. Product liability claims are complex—with confusing paperwork, strict deadlines, and insurance issues. Don’t go it alone.
