What is Wrongful Death in Illinois?

Each state has different laws and statutes regarding various types of lawsuits how to proceed with one. In Illinois, a wrongful death lawsuit is defined in 740 Illinois Compiled Statutes 180 as, “Whenever the death of a person shall be caused by wrongful act, neglect or default, and the act, neglect or default is such as would if death had not ensued, have entitled the party injured to maintain an action and recover damages”. Essentially, this statute says that a family member may bring a lawsuit against and seek compensation from whomever they believe acted with negligence, causing the death of their loved one.

The statute of limitations on filing a wrongful death case is two years. This means that within two years of the date that the death occurred, the personal representative of the deceased must file their wrongful death lawsuit, otherwise, it will not be valid or accepted in a court. The personal representative can be any close family member, such as a spouse, adult child, or parent. Any damages that are awarded after the lawsuit are meant for the spouse and children of the deceased. These damages can include medical expenses, funeral and burial expenses, pain and suffering, lost wages, and more. These damages are intended to assist the family in bearing the financial responsibility that comes with an untimely and tragic death.
