Billing Inaccuracies

A recurring issue against Comenity Bank is with their billing problems. Numerous clients reported paying off their accounts in full. Weeks or months later, some clients have received billing statements from Comenity while others, notices from collection agencies about missed payments. Comenity Bank’s flawed system had gravely affected many of its consumers’ credit status, resulting in lower scores and even closed credit accounts.

Excessive Late Charges

Another issue consumers found against Comenity Bank is with their incredulous late charges. Many of said charges, reportedly, were paid off but had grown exponentially. According to complaints, Comenity Bank did not send emails to the consumers despite them asking for paperless notices. Others did not receive anything entirely until the interests piled and the bank had sent warnings.

Premature Credit Reporting

Despite errors on their end, Comenity Bank had routinely reported consumers to credit bureaus prematurely. It’s no surprise that many of the bank’s clients have lamented about their credit scores lowering or credit accounts closing.

Identity Theft

Others’ cautionary tale with Comenity Bank is with non-consumers being falsely charged for debts under their names. According to one account, it’s been years of working with proper authorities including Comenity to prove that identity theft had occurred.

Poor Customer Service

Comenity Bank consistently fails its consumers with its sore billing practices and consequent poor customer relations. Many of its consumers had to go back-and-forth weeks, months, and even years to clear up falsely charged debts, clear paid off credit accounts, and clarify interests. Even with their responses to BBB complaints are generically-tailored messages claiming to respond to the issue within 30 days.

Unfortunately, billing inconsistencies, late charges, premature credit reporting, identity theft, and lousy service complaints are just the beginning for Comenity Bank. The bank’s customers are left wondering what options they have regarding their consumer rights.

We Fix Complaints When Customer Service Won’t

Has Comenity Bank used misleading sales tactics? Have you received poor service? Do you have complaints with billing? Do you want customer service at Comenity Bank to listen?

A lot of Comenity Bank Corporation customers aren’t happy with their service and the Better Business Bureau lists 2,651 customer complaints against the company in the past three years, including complaints for billing and collections practices, problems with a service/product, advertising and sales, among others.

If your complaints haven’t been heard, we can help. At Agruss Law Firm, LLC we help customers who have been mistreated by big companies--much like Comenity Bank--and we turn your complaints into resolutions!

We’ll not only file your legal demands with Comenity Bank, we’ll negotiate with the company. If your claim isn’t resolved through these negotiations, we’ll work through the legal process that is outlined in your Comenity Bank contract, which is typically arbitration.

Agruss Law Firm, LLC gets results--including zero balances, refunds, and other compensation.

Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling Comenity Bank to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like Comenity Bank have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. Comenity Bank will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with Comenity Bank is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

 • The process is fundamentally fair - All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
 • You get access to all relevant information - This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
 • Transparency - AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
 • Just process - Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
 • Alternative to arbitration - Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When Comenity Bank is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If Comenity Bank doesn’t meet those demands and you have a real complaint, Agruss Law Firm, LLC can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like Comenity Bank don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on Comenity Bank is to formally raise your complaint. The lawyers at Agruss Law Firm, LLC can help you to do so. We will send a letter of demands to the corporate offices of Comenity Bank, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with Comenity Bank.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if Comenity Bank doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. Agruss Law Firm, LLC will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at Agruss Law Firm, LLC understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with Comenity Bank, you might try filing a complaint with the BBB or the customer service team with Comenity Bank. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and Agruss Law Firm, LLC can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

How Do I File a Complaint Against Comenity Bank?

We will use your state’s UDAAP law to file a complaint in Arbitration on your behalf at no cost to you. UDAAP laws include misrepresentation, deception, false advertising, or false promises. Under your state’s UDAAP law, you are likely entitled to money damages for your actual damages. Plus, the other side will pay our fees and costs. You will not pay us a penny.

Deferred interest rate scam

Michael Agruss Headshot

Hi Malika. I would like to speak with you about the issues you're having with Comenity Bank and your interest rate. Give me a call at 888 572 0176. Thanks, Mike

We have been paying $50 on this account each month and it is in arrears. They are threatening to sue us for nonpayment. We would like the account closed and to continue paying $50 a month to pay it off.

Michael Agruss Headshot

Hi Michael and Susan. I am going to give you a call to discuss your account and what you can do to resolve the issue you're having with Comenity Bank. Thanks, Mike

Comenity held our payment for one day in June to allow them to charge a late fee. We paid our merchandise total, not he late fees, and cancelled both accounts. They continue to send statements on closed accounts adding additional late fees on the late fees. We get multiple daily phone calls harrassing and threatening us. They have been told to stop and continue to ignore us. They are damaging our credit by reporting late payments every month.

Michael Agruss Headshot

Hi Ted. I'm sure its frustrating to be continuously contacted for an account that is closed and then dealing with damaging reports against your credit. I can help you with this, give me a call. Thanks, Mike

I would like to fight Commneity bank for harrassing phone calls. threats,

Michael Agruss Headshot

Hi Tijwana. I would like to discuss the harassment and threats you're receiving. Please contact my office so we can discuss this and determine if you have a case against Comenity Bank. Thanks, Mike

I called for assistance due to covid and they refused to waive late fees after I paid off the balance. Now the late fees are over 200 and took them from April to June to respond to my bbb complaint. Worst company ever not paying a penny. They also called my job 3 times which got me introuble as well as calling my phone harassing me

Michael Agruss Headshot

Hi K.A. I'm sorry to hear that you're dealing with issues during the pandemic. As if it wasn't already difficult, now Comenity isn't doing their best to keep consumers from even worse issues. I would like to discuss the harassment you've dealt with, please give me a call at my office. Thanks, Mike

Michael Agruss Headshot

Hello Myeesha. I can understand your frustration with Comenity Bank, they are a company that gets frequent complaints against them. My law firm has dealt with them before we are experienced in getting results. Please give me a call at 312-224-4695 so we can discuss your options. Thanks, Mike

I don’t know if these are scam calls because I get calls from an “ Unknown “ caller that says they’re calling from comenity bank, But I see here, they have actual numbers to call from. I have a victoria secret credit card, which is honestly a stupid idea to get it because I didn’t think they would accept me. It was a stupid mistake. I can’t pay off the money at all, and they keep calling me from this unknown number, and they don’t even leave voicemails, or a number to call them back from.

Michael Agruss Headshot

Hi Nadia. Robocalls are annoying and frustrating, that's for sure. You can deal with them legally, though. I would be happy to discuss this with you and work with you to get this taken care of. Please give me a call at 312-224-4695. Thanks, Mike

Where do I submit story.

Michael Agruss Headshot

Hi Sims. You can submit your story with Comenity Bank right here or if you need assistance with dealing with them, you can contact my office. I would be happy to review the specifics of your case and determine what help I may be able to offer. Please give me a call at 312-224-4695. Thanks, Mike

I have an overdue balance with comenity bank and they keep calling me all day and night all week long and now they are starting to harass my mother who has nothing to do with my credit card. I want the constant calling of me and my mother and possibly anyone else related to me to stop.

Michael Agruss Headshot

Hi Allison. What times are they calling you? Can you send over a call log to my office at [email protected]? I want to review it and see if they are violating the law. Thanks, Mike

Comenity Bank has started to call my family about my Debt. They also failed to take payments off my account like agreed upon. When I called them they said that they don’t do that. They also contacted me at all hrs which I wished I saved now but I had to free up my voice mail but I’m sure I will get more soon

Michael Agruss Headshot

Hi Virginia. Let's talk more about this. It sounds like you have a few things going on and I'd like to help get it fixed. I will reach out to you. Thanks, Mike

My case with this Comenity Bank is a little different. I held a Helzberg diamonds credit card for many years. They were formally with capital one bank I believe, and I had a direct draft set up every month with them to take payments out of my account to remain in good standing until it was paid off. I received a notice on my credit about a month ago that I was 120 days past due on my payments for that credit card. To my surprise, when I called I found out that they had switched to Comenity bank, and that my direct draft was never continued and my information was never stored with this new transition. I never check my billing statements in the mail because I haven’t for years I just would occasionally check my statements to make sure my balance looked depleted. This messed my credit score up in a horrible way, dropping almost 100 points. I cannot afford for that to happen to me right now, I was in the process of looking at houses with my new wife and there’s no way possible that I can finance a house right now with the credit score that I have and it’s negative report on my credit. I called the company and asked him why they did not call me or send me an email or get in touch with me or contact me, and their response was that they sent out a letter in the mail when the transition was made. I never got that letter because I would’ve opened it if it was something different looking. I never received a letter, never got an email or a phone call which they said they did not do anyway. They did not make direct contact with their customers. I have noticed on many websites that they have over 3 million complaints about purposely messing up peoples credit and putting them in bad standing and issuing them fees and late fees and messing their credit scores up, almost seems to be on purpose so they can make more money. I don’t even know how this bank still operates legally. I need help getting my credit score fixed immediately and I would really really Appreciate it in more ways than you can imagine. This was not fair and not justified and not morally right. Credit scores are all people have in life sometimes to make things happen and get by. And this bank seems to just want to mess peoples credit scores up and scam them and make as much money as possible.

Michael Agruss Headshot

Hi Terrill. I can certainly understand why you'd be upset, it sounds like Comenity Bank and Helzberg Diamonds dropped the ball. And now that you're trying to get a home, it is very important that your credit score is in good standing. I can call you to discuss your situation in more detail and we can determine what options you may have. Thanks, Mike

I have a NY & Co account. Due to pandemic, I'm unable to keep up with payments. Commenity Bank calls repeatedly several times a day. I'm being harassed. It's so bad that I had to install an app my phone to block their calls... but they just call from different numbers

Michael Agruss Headshot

Hi Tracye. Debt collectors often have multiple numbers at their disposal. Fortunately, you do not have to keep taking these calls. I can discuss how to make them stop and I will give you a call to speak about how. Thanks, Mike

At a loss- Recent Death My partner's mentally deteriorating mother, passed abruptly in June. We'd been helping her out monetarily, though just scraping by ourselves, for years since the death of her husband. The old lady got a letter from comenity collection agency to the tune of $560.+ for catalog clothing she never even took out of the packages. These are long since been donated to Goodwill, since she left the place in squalor no one knew about (she wouldn't let anyone access her apartment). Despite my efforts to get her out of the exorbitant mausoleum, she resisted moving to healthier, more affordable quarters. Everything went to the rent. She would not leave the place where her husband died. Now her daughter has the letter of estate to recoup a fraction ($2000-$2300?) of what we spent to help the old lady. No land, no car, no house; nothing but the stipend she received from her deceased husband's social security. The notice is dated Aug 24th, and we don't know how to handle this. We're poor, my partner's a vet with slipped discs, and I'm a struggling small business owner with infirmities. We're in Baltimore, Maryland. "Advice, please?" THANKS!

Michael Agruss Headshot

Hello J.R. As this is a unique situation, I would like to speak with you over the phone to determine what options your partner may have. I will reach out to you to discuss this and we can figure out what your next course of action should be. Thanks, Mike

dispute charge

Michael Agruss Headshot

Hi Filiz. What did Comenity Bank charge you that you would like to dispute? Let's talk more about this through a free, no-obligation consultation. I will give you a call or you can reach my office at 888-572-0176. Thanks, Mike

Hi I’d like to get some information On verifying debt, the collection agency will only send statements from 2018, it doesn’t show any payments or charges. The account was opened in 2011, stopped paying in 2018, it had a $0.00 balance in 2015.

Michael Agruss Headshot

Hi Nour. If you can, send over the documentation you have regarding your Comenity Bank accounts so I can look them over and I will then contact you about your options. My email address is [email protected] Thanks, Mike

I have several charged off accounts with Comenity, and want to settle them in exchange for removal from my credit report. Is this something Agruss Law can do? I cannot find their executive office email or address to attempt this myself.

Michael Agruss Headshot

Hi David. I will give you a call or you can reach me at Phone: 312-224-4695 Email: [email protected] Thanks, Mike

My ex wife has a debt to them and they have now taken money from my account. My ex has not had access to my account in 3 years and I'm not on the credit card with the debt I'm not okay with the money being taken

Michael Agruss Headshot

Hi Brook. Typically a debt collector can only take money from your bank account if there is a court order to do so. Have you contacted Comenity and shown them your divorce papers? Contact my office and we can discuss this and I can review your case to see what options you have. Thanks, Mike.

They have called twice asking for someone who does not live in this household. . Last call was 8:0AM this morning

Michael Agruss Headshot

Hi Olene. Unfortunately, many debt collectors do this same thing and it can be hard to get them to stop. I can help, though. I will reach out to you or you can contact my office at a time that works well for you. 312-224-4695 Thanks, Mike.

I’m 90% sure my identity was stolen from this website. A credit card for a different company was ordered in my name and to my address. What was peculiar about it was that the information on it was just slightly weird. And that’s how I was able to track where from My name on it wasn’t my full legal name. And my address containined an error that appeared in only one account Comenity. I’d made the error during signup and just never corrected it. And my comenity is the only “bank” that has my common First name (the name everyone calls me) rather than my legal name. Furthermore the debit card I linked to make payments on the site? Someone tried to withdraw money from it using my card information. And opened a cash app account. They either had a data breach or do not care about my information and let employees have access to it. I’m not sure what worse.

Michael Agruss Headshot

Hi Otas. I'm sorry that this happened to you. I have had clients in the past who complained of identity theft with Comenity as well. We can help you resolve this. Please give our office a call so that we can discuss your rights and options in handling this together. Thanks, Mike.

Comenity is grifting me in addition to 2 robocalls every day

Michael Agruss Headshot

Hi Stephanie. That sounds very frustrating and harassing. Comenity is pretty aggressive when it comes to contacting consumers, so this is not much of a surprise from my standpoint. Robocalls violate the Telephone Consumer Protection Act (TCPA) and you can receive $500 in damages per call. We can help you to stop the calls. Give us a call if you are interested and have any questions. Thanks, Mike.

I have 2 accounts with comenity bank, the first account Upon trying to make the final payment to pay off the balance and close it immediately after I had made arrangements with the main representative or whoever claimed to be her. I authorized a deduction from my bank for them to take it out on a certain date. I assumed I would be clear of them after that. Next thing I know I’m getting emailed by them that I have a balance with interest due and late fees. At this point I’m LIVID. I’ve made several attempts to log on to my accounts to see what is going on and contact somebody but I’ve been “Locked out” of logging into an online portal and the accounts have been closed supposedly or under review. I refuse to pay any extra amount of interest. I don’t know if it’s be best to get in touch with a financial advisor, I’m just seeking any help or advice I can get at this point. They even called my cousin today and that has angered me even more. Please advise

Michael Agruss Headshot

Hi Marika. I would be livid in the same situation. Comenity has caused many similar issues to consumers just like you, but we can help you figure this out and get it resolved. I would be more than happy to speak on the phone with you to talk about your experience and how we can help you put an end to this. Give us a call. Thanks, Mike.

I have several cards with Comenity Bank. I am looking to pay them off as they are a terrible company. They have lowered my credit limits on my cards during the pandemic and it has hurt my credit rating. They say its because my credit score has dropped and I know that is not true. I have two different credit bureau apps on my phone and my credit rating was going up. They have to be checking my credit score to lower its rating and then lowering my credit limits. They also have sent me emails changing the minimum amounts do to them twice since i have had the card. Is any of this legal? I will pay off the balances and then will never do business with this POS company again.

Michael Agruss Headshot

Hi Sherry. Comenity is not a very consumer-friendly bank based on my experiences helping other consumers like you. We can help you. I would like to get to know more details about your situation so that we can figure out how to best help, though. Give us a call and we can discuss. Thanks, Mike.

This bank keeps phoning me looking for someone name Olivia T I got 2 phone calls today one at 11:56 am and 11:52 am mr latham he left this number and extension 1-800-695-2912 ex1236466 I have no affiliation with this bank never even heard of this bank and do not want any affiliation with this bank. I would appreciate it if they would check their records for the correct phone number because I am not her and she is not me.

Michael Agruss Headshot

Hi Shonda. Did you tell Comenity that this debt doesn't belong to you? After that, they cannot call you anymore. They would be violating the Fair Debt Collection Practices Act (FDCPA), and you would be entitled to compensation. Please give us a call. We can make them leave you alone. Thanks, Mike.

I am being harassed daily 1 have told several comments operators that the 1st bill l received had two months of late charges on it I was able to pay the bill but I did not to pay late charges on the 1st bill I had gotten he asked me if I had called the post office to see why they did send the 1st and second bill.He was very aggressive telling me to pay or maybe go to jail I will be eighty in one month I do not run to phone to answer calls anymore I do know I will not go to jail for 41.00 bill but this bank is causing me much stress my cardiologist tells me to try to stay calm it is hard to hear the phone to ring 20x day

Michael Agruss Headshot

Hi LaNora. It sounds like you are going through a tough time, but we can relieve some of that stress for you. It is highly likely that these are empty threats meant to make you pay immediately, as I haven't seen Comenity actually take legal action against consumers that I help. If you give us a call, we can figure out where to go from here and talk about your options and rights to end this harassment. Comenity is very aggressive. Thanks, Mike.

Sometimes up to ten robocalls a day from Comenity Bank, starting from the moment I wake up. But when I try to call them to set up a payment plan, I can never get through.

Michael Agruss Headshot

Hi Megan. These robocalls violate the Telephone Consumer Protection Act (TCPA), and you can receive $500 per call as compensation. Also, if they are calling beyond normal hours, they would be violating the Fair Debt Collection Practices Act (FDCPA) and you can be compensated for that, as well. It sounds like we can definitely help you to resolve this in short order. Please give me a call so that we can discuss your rights and get this figured out. Thanks, Mike.

I don't have the money to make the full payments right now and I'm going to be paying the card off soon but they call me non-stop and I don't answer but they leave voicemails and now they've somehow gotten my sister's number and called her.

Michael Agruss Headshot

Hi Breeana. Comenity is definitely a very aggressive bank. This sounds like harassment and sounds like they have violated the Fair Debt Collection Practices Act (FDCPA) on multiple occasions. We will help you to get this harassment to stop for you and your sister. Please give us a call and we can discuss where we go from here. Thanks, Mike.

Comenity bank keep harassing me and and the process of suing me. Do you have any good advice. Thank you

Michael Agruss Headshot

Hi Connie. Are they harassing you over a debt that you owe? And did they just threaten to sue you? Often times, these threats of legal action that Comenity makes are simply empty threats to scare you into paying a debt. They may be violating the Fair Debt Collection Practices Act (FDCPA) and you can be compensated for their violations. Please let us know if you are interested in our help. Thanks, Mike.

I have a credit card from Comenity Bank. My card was stolen and used fraudulently. I filed a police report community refuse to work with the police and law-enforcement agencies. Despite this using the transactions to police obtained video Of the criminals who used my card after stealing it. Community refused to assist so these people could be prosecuted. Community is now saying I’m responsible for the fraudulent charges even though the people who stole my card were strangers and Comenity had an opportunity to prosecute. I asked him what about law saying I’m not responsible for credit card fraud and they said that only applies if the bank agrees it’s not fraud. Apparently Comenity Bank does not count the absolute stranger stealing your credit card and then using it without your permission and you reporting it immediately to them so they can have that card canceled And issue a new one. Apparently reporting this to the police and the police catching the criminals is not enough for comenity to consider this fraud.

Michael Agruss Headshot

Hi Daniel. I'm sorry that you went through that. We help consumers with their issues with Comenity if Comenity is harassing them - whether that be by constant calls, robocalls, or false credit reports. Has Comenity harassed you over a debt? If so, we would be more than happy to help you get that resolved. Give us a call if you have any questions. Thanks, Mike.

Pet land. They sold me a dog for 4,500$ with an interest rate of 120%!!!!!!!! from american first finance.

Michael Agruss Headshot

Hi Anthony. This page is for Comenity Bank. We have been taking many cases associated with American First Finance, though, and we can likely help you. Please let us know if you are interested in our help. Thanks, Mike.

I sent a payment total remaining balance) from my bank on. 2/20/2020. The payment was due 3/2. They posted it 3/3, charged me. Late fee and 2.00 interest. They only agreed to give me a 15 credit. I make bank payments regularly. They never take 10 days to post. They are fraud!

Michael Agruss Headshot

Hi Ann. Comenity is a legitimate business, however they have violated some federal laws in communicating with other customers in the past. We have been able to resolve countless cases for consumers in the past, and we can help you, too. I would like to get to hear more about your experience with Comenity so that our office has a better idea of specifically how to help you. Please give us a call if you would like to speak in more detail. Thanks, Mike.

I call them to pay the amount that o own by setting up payment plan and they keep increasing it so I close the acc now they increasing it again on my credit and with a ton of call

Michael Agruss Headshot

Hi Oluwaniyi. Have you told Comenity to stop calling you during any calls? After you say this, they have to stop, otherwise they would be violating the Fair Debt Collection Practices Act (FDCPA). Unfortunately, they have violated federal laws regarding debt collection harassment for many consumers in the past. But, we have been able to help them resolve their issues. Give us a call so that we can speak in more detail about your experience and help answer any questions you may have. Thanks, Mike.

I was getting calls and threatening voicemails from Comenity Bank. They were calling me at least 6 times a day and leaving voicemails saying I needed a attorney because they were “coming after me”. I reached out to a debt consolation company and learned that I did not have enough debt for them to help me. She advised that the best thing I could do was ask them to stop calling me. I planned on doing so and within a few days of talking to the debt consolidation agent, I received a call from my mother saying that Victoria’s Secret was calling her. She was not aware of my debt and I was wanting to keep it that way. It has been 3 days since my mom was contacting and after harassing her multiple times daily, she finally answered their calls. She had no idea about the amount they were asking me to pay. They proceeded to disclose the amount to her and instead of asking her how to get ahold of me they threatened her to pay my debt. She followed their threats and paid them. I was under the impression that they can call relatives a few times but have to stop and I did not appreciate that they disclosed my information and made my mom feel like I was going to be in significant trouble if she did not pay them right then.

Hi Kelly. They certainly should not be calling third parties and disclosing your debt to them, no matter the relationship. That would violate the Fair Debt Collection Practices Act (FDCPA), as well as if they called you after you told them to stop calling. Please give us a call so that we can get started on helping you and learning your experience. Thanks, Mike.

Hi Luxeenne. If National Credot Adjusters is harassing you over an alleged debt, please give us a call so we can discuss your experience. You could receive compensation for their violations of the Fair Debt Collection Practices Act (FDCPA). Give us a call if you have any questions about our help. Thanks, Mike.

My husband and I both have Kay Jewelers cards through Comenity. My husband made an almost $10,000 purchase at Kay Jewelers in November 2018. He put 20% of the purchase price down in order to revive a 0% financing offer for 12 months with Comenity. Even though my husband put down the 20% to qualify for the interest rate, Comenity did not place the account in that program. We discovered this in Jan 2019 and called Comenity to correct it. They then put us into that program with the correct interest rate, but failed to refund us the approximately $150 in interest they added on to the account in Dec 2018 and Jan 2019–even though we paid as agreed and the interest was added due to their own error. My husband paid as agreed every month. Then, in Nov 2019, my husband used my USAA account to pay his bill to Comenity. I did not recognize the charge so I disputed it with USAA. USAA refunded the funds to my account. We then realized that it was a charge by my husband and initiated two different payments to Comenity—one for my Kay Jewelers Card and one for my husband’s card. Even though the funds were in the account and available, Comenity reversed the transactions. I did not realize that the accounts were not paid as initiated until they started calling us both about our “delinquent” accounts. I then set up two other payments on the accounts, and they both were reversed by Comenity. I called them and explained that I kept trying to pay for our accounts with my checking account, but due to the previous disputed charge, they were immediately reversed. They said that didn’t make sense and there was nothing that they could do—even though there was a record of all of my attempted payments with a daily balance (to show that funds were available) through USAA. They then started escalating the calls to my husband and demanding payment. They then said that all of the remaining balance was due on the account immediately, even though we had an introductory 0% interest rate until July 2020. They then reported both of our accounts to the credit bureaus as delinquent, even though I kept trying to pay them repeatedly and their customer service rep provided no assistance with fixing the automatic reversal from of payments. My credit score dropped from an 830 down to 750. My husband’s plummeted from 770 down to 580 because they said the entire balance was delinquent. They then had a collection agency start calling my husband. At that point, he had started going in to Kay Jewelers store to pay for his account with cash (and keeping his receipt) because we could not make payments with my Checking account. The person from the Collection Agency said that he could not pay like that, and demanded that he establish a monthly debit withdrawal from his checking account to them. Comenity then added over $1,000 in interest to my husband’s Kay Jewelers Account. The bottom line is they created a mess, they refused to correct the problems or assist us with making electronic payments. They used the problems to their benefit to charge us more in interest. And, they improperly reported us to the credit bureaus, sent us to collections, and called my husband repeatedly.

Michael Agruss Headshot

Hi Lindy, I'm sorry that Comenity put you through this. The Fair Debt Collection Practices Act (FDCPA) protects consumers from harassing debt collector practices, and it sounds like they may fall under violating this federal law. Also, the Fair Credit Reporting Act (FCRA) is meant to ensure that your credit report is a fair and accurate representation of your credit history. You may be able to collect monetary damages due to their violations. Please give us a call so that we can see how we can help you recover from this. Thanks, Mike.

I have had repeated phone calls from this company. During work hours early morning and at night and on weekends and on Sundays! I have spoken with them repeatedly! I just made a payment and while I was in the process of making a payment I received two calls from two different Representatives during this transaction. Wanting more transactions! After my payment was made and filed I received another call and the woman started asking me to make more payments to cover late fees. Mind you this was no more than 3 minutes after I got off the phone making a $78 payment! Which I agreed to for the next 3 months to get caught up. But even though I keep making payment agreements with these people and actually making a payment they call me three minutes later wanting more payments! It's getting absolutely out of hand ridiculous!

Michael Agruss Headshot

Hi Shalena. Generally debt collectors shouldn't call at a place they know is inconvenient for you or before 8am or after 9pm. What times are they calling you? It does sound like they are doing some frustrating things but making repeated calls even while you are paying them. Why don't I give you a call and we can discuss this further. In the meantime, feel free to contact my office at Phone: 312-224-4695 Email: [email protected] I look forward to speaking with you. Thanks, Mike.

They call Excessively throughout they day and multiple call back to back. Very disruptive during my work hours

Michael Agruss Headshot

Hi Sarah. Have you told them to stop calling you? If they continue to do so after you tell them to stop, they would be violating the Fair Debt Collection Practices Act (FDCPA). As the consumer, you should be protected from their harassing collection practices. Please give us a call if you have any further questions for us. Thanks, Mike.

I have a hot topic and a Victoria Secret card with comenity bank I had gotten behind on minimum payments due to not working for a few months they began to call but also called my family members and even my in law who lives in another state they left messages about it being a serious legal matter and was harassing my family members as well as myself. Made payment arrangements only to be called and harassed again and my family stating the payment arrangements would not work and something else needed to be done they lied and said they never sent me letters with the agreement and I received 2 letters with the agreement they are constantly harassing my family and I never gave them permission nor their numbers for them to call them.

Michael Agruss Headshot

Hi Rita. In the past, Comenity has used some of the same harassing practices that they have used with you. The Fair Debt Collection Practices Act (FDCPA) protects consumers from these harassing collectors. Things like calling family members or other third parties about a debt of yours. You could get compensated for violations like these. Please give us a call if you have any further questions about how we can help you. Thanks, Mike.

June 8 2019 I purchased 2 blouses from Old Pueblo Traders for $39.98. They were returned in three days and got confirmation of return receipt. In August I got a bill from Comenity for $47.00 with a payment due of $27.00. I immediately called the bank and explained that the merchandise was returned in June. I was told that I missed July payment . I told the agent there was no payment due because the merchandise was returned. He tried negotiating by telling me to pay just the $27.00 they are asking for and we will cancel the rest I refused. Later I got another call and spoke with a female agent to told me That I have to pay the shipping, that she would transfer me to Old Pueblo, they will tell me how much is due and will transfer me back to then bank. I was transferred and told that the shipping would be $2.98 for the original and $9.99 for the return because I used their return label for a total of $12.98 which I did and the bank received. Since then I have been receiving a bill with late payment every month for something I do not owe. How could I be late on something I do not owe? It's now up to $178.00 and I don't have the merchandise. They have messed up my credit report. Help Please.

Michael Agruss Headshot

Hi Amanda. Unfortunately, Comenity has harassed customers similar to this situation in the past. But luckily, we have helped resolve their issues. Please give us a call if you are interested in our help or have any more questions. Thanks, Mike.

I have victory secrt acc and they charge me for there mistake it not fair and inblavebal it is shame who this bank operate

Michael Agruss Headshot

Hi Najiyah, this sounds like a common complaint that we receive regarding Comenity Bank. Luckily, you came to the right place. We have resolved countless other consumers' issues with Comenity and we can resolve yours too. But first, I would like to get some more information from you to see if we can help. Please let me know if you would like to speak on the phone or if you have any further questions. Thanks, Mike.

They obtained a default judgement without serving me. Found out when the sheriff came to collect on a writ of execution. I have minimum social security so they have nothing. However I own my home that is valued under the homestead. I don't want to go bankrupt if possible, so I am preparing to file a motion to dismiss. I find they have served my daughterinlaw. They claim to have served her twice but did so only once, which was rejected because my son had an attorney let them know they had the wrong Joe. I have seen the court record online and will get the full thing when I go to town. I believe it makes it clear they are in the wrong and may have violated my sons rights and mine! Sorry about the lengthy story. Thank you Joe

Michael Agruss Headshot

Hi Joe, this must be stressful for you. I would like to speak with you about your situation to get more details on this judgement. Comenity has troubled many consumers in the past so we may be able to help you. Please give me a call if you are interested or have any questions. Thanks, Mike.

Got a letter from Comenity stating Full Beauty credit card refused because of credit freeze. Did not apply for credit card with Full Beauty.

Michael Agruss Headshot

Hi Dean, Comenity has sent this type of erroneous letter to other consumer that we have helped in the past. Have you told them that you do not have a credit card with that company? Please call me if you have any questions, we can help. Thanks, Mike.

My wife and I qualified for a $ 16000 credit line with Comenity at Tile Shop in Tampa, FL and made an initial purchase of $ 2459.48 on 2/23/2019 from Tile Shop Tampa, through Tyler. We selected the Interest free promotion for 18 months. We received our first statement of the purchase from Comenity in mid March with a due date of 4/20/19 for the purchase. We made the payment and after making the payment, also made some smaller purchases from Tile Shop, all under 18 month interest free program through Comenity. We received our April Statement in mid April with a due date of 5/20/19. On the second statement, Comenity had charged us interest on the initial purchase of $ 2459.48 at a rate of 29.9 %. The interest had not been deferred on the larger purchase only on the two smaller purchases we had made. We called both Tyler at Tile Shop and a Comenity representative, and explained the situation. We saw that our smaller purchases of $ 200 and $ 300 had been put on interest deferred for 18 months, but not the very large initial purchase. Comenity opened "an investigation". We received a letter from Comenity in May indicating that it could take up to 3 months. I just now called today, 7/23 to ask about the status of said investigation, spoke with a supervisor who wouldn't identify herself and was told our appeal was denied. I asked why and was told it was because "the back office" indicated that the dispute took place after 70 days from the initial purchase on 2/23/2019. My wife and I weren't aware that that the purchase had been miscoded and didn't reflect the 18 months, no interest program until we received our April statement, due 5/20/19, showing interest had been charged, in error and that's when we immediately brought it to Comenity's attention 70 days after the purchase occurred. This company, Comenity, is deceptive, fraudulent and unethical. What person in their right mind does interest deferred on small purchases of $ 200 and $ 300, but not on the largest purchase of almost $ 2500? Now, I'm stuck because they have the ability to ruin my credit rating, I have to pay the whole amount of $ 2459.48 with interest, before they'll even accept payments toward the interest deferred amounts of only $ 200 and $ 300, not doing so damages my credit rating and credibility and I am not a thief. What company hides behind a 70 day window to correct an error that we, my wife and myself, didn't make because it took us longer than 70 days to discover an error had been made by Comenity in how they coded the initial purchase. It's shameful that a credit card company would be so shallow and such a bottom dweller that they would sucker customers in like that. Right is right, to this point I've been patient, I'll be patient no longer. I've already sent, tonight, written complaints to the FDIC and our own State Attorney's office. I've cancelled every store credit card underwritten by Comenity, just because of Comenity. Did you realize that they have an "F" rating from the Better Business Bureau?? I didn't think that was possible. I'm not the type of individual that will simply accept this from a company and look the other way while a company puts the screw to me. I'd like to explore the opportunity to sue Comenity for deceptive business practices and punitive damages. This is fraud, pure and simple and the fact that they wouldn't correct the matter when I have the original paperwork from Tile Shop showing they put the $ 2500 in as the promotion, is an intentional tort on their behalf to better their bottom line by charging interest when the promotion clearly indicates it should be deferred.

Michael Agruss Headshot

Hi Gerard, I would certainly be frustrated with what is going on if I were you. Luckily, you came to the right place. Comenity has harassed many consumers in the past. We have resolved dozens of cases against Comenity for other consumers, and we can help you, too. Please give us a call so we can see how we can help you. Thanks, Mike.

Comenity offered a payment arrangement on my smile generation card because i had been laid off from my job. I have had these payments taken automatically from my account every month and have never missed one. I did tell them not to call me, then started receiving calls from family members that Comenity is calling them to get me to call. They have decided that their payment arrangement is no longer acceptable and charged off my account and will turn it over to collections unless i make a new arrangement changing the amount from $40-$220 a month. this is crazy!! and how can they legally harass my family when they are not on this account?

Michael Agruss Headshot

Hi Amy, this definitely sounds like debt collection harassment to me. Comenity should not be calling your family nor should they be calling if you told them not to do so. These violations are due to the Fair Debt Collection Practices Act and you can be compensated for this harassment. Please give us a call if you have any questions and are interested in our help. Thanks, Mike.

Hi, I owe Comenity bank (LOVELOFT Mastercard) they call me repeatedly all day long. They have called my place of work, they have called my sister, and my parents twice. I called and asked them to stop calling my family. I also sent a secure message on their site asking them to stop and they called my parents again. They have my correct phone number and address - there is no need for them to reach out to anyone else.

Michael Agruss Headshot

Hi Laura, you are right, they should not be reaching out to your contacts. Comenity should not be calling third parties according to the Fair Debt Collection Practices Act. Also, they should have stopped after you told them to stop. Did you call telling them to stop as well? Please give us a call with any questions you may have. Thanks, Mike.

I have a credit card through them thrust I got at Victoria’s Secret and I’ve been trying to pay it off but with my car and having a job that doesn’t pay much I don’t get paid much but they keep harassing me and calling multiple times a day.

Michael Agruss Headshot

Hi Emily. Have you called them to tell them to stop calling you? This may be harassment under the Fair Debt Collection Practices Act, but I want to get more information from you to learn more about your situation. Give us a call and we can help you. Thanks, Mike.

Comenity Bank offers a joke of a heartship program that I am in so much need , they threw me out of the program while I was paying faithfully just cause I was late on a payment for few days . I tried working with them an they still reported me to the credit bereau even after paying them , the credit an payments they kept it an never put it back in my account , they call me every day harrasing me even private calls an spoof calls. They don’t want to help me at all even after I explained my situation , the heartship program is a huge joke there isn’t any heartship at all , if they don’t get there money they throw you out of program and harass you with calls and the payments for the hardship program is still high don’t know why they even do a program is down right cruel there conditions

Michael Agruss Headshot

Hi Stephania, I'm sorry about what you are going through. Have you told them to stop calling you? And do you know if there is a live person speaking when they call you or if it is an automated voice message? For you, they may be violating the Fair Debt Collection Practices Act and/or the Telephone Consumer Protection Act, but I would like to hear more about the details of this harassment. Please let me know if you have any questions and I can see if we can put an end to this. Thanks, Mike.

I was very deceived by this company once they told me my payment was paid in full they continue to Bill me

Michael Agruss Headshot

Hi Janotta, that would definitely be an unfair collection practice. Was the payment reported paid in full or did you actually pay in full? Also, have they called you about this debt? I would like to get some more information from you. Please give us a call if you are interested in our help or if you have any questions. Thanks, Mike.

I am having the same numbers call me over an over within minutes of each other. Isn't that harassment? 9133125191 that is just one of the numbers that I'm getting calls from!

Michael Agruss Headshot

Hi Courtney, it may be harassment. Are they calling you about a debt of yours? And have you told them to stop calling you? If you told them to stop, they should have stopped - otherwise that would violate the Fair Debt Collection Practices Act. I would also like to know what they say in these calls so that I can see if we can help you. Please let me know if you have any questions. Thanks, Mike.

New dentist hooked me up with commenity. commenity bank gave dentist the whole $5000 before any treatments occured....I thought I could sue dentist....wrong dentists cannot be sued......Now I want to sue commenity for releasing all $5000 to dentist before treatment. I paid $2500 then I realize I need to sue commenity... dentist work was horrible/teeth were to big and some to small I could not close my mouth. dentist would not fix his work....had to go elsewhere

Michael Agruss Headshot

Hi Karen, I'm sorry to hear that. I do want to get more details to see if this qualifies as harassment. Please give us a call with any questions you have and to see if we can help you. Thanks, Mike.

Got a Letter from comenity capital bank PayPal saying I had applied and rejected. I did not apply for credit!

Michael Agruss Headshot

Hi Gerald. Are they harassing you repeatedly? Also, have you notified them that this was an error and to not contact you again? If they are continuously sending you letters, we may be able to help you. Please let me know if you have any questions. Thanks, Mike.

Debt Collectors From Comenity Capital Bank HealthiPlan has been calling me and leaving voice mails. I asked them to stop the calls twice. They have violated the Fair Debt Collection Practices Act and the Federal Trade Commission. They call at inconvenient times before 8 a.m. and after 9 p.m. They call all the time back to back calls. I've saved these people calls and voice mails. They have broken every law. They said the information can be put on my credit report and advised me to get a lawyer. This has been going on for months. I get calls from all these numbers: 800-675-5685 855-506-2495 720-356-3688 732-806-3199 609-400-7010 614-754-4136 614-729-9025 614-729-9031 913-312-9488 800-305-1215 Even though I block the numbers the calls still come through as restricted. This has caused me to miss many important calls like from my doctors because I turn my phone's volume off. Thank you

Michael Agruss Headshot

Hi Sandra, you are right. If they are still calling you after you explicitly told them to stop calling, they would be violating the Fair Debt Collection Practices Act. What do they say during these calls? There may also be a Telephone Consumer Protection Act violation if these calls are automated messages or systems. Please let me know if you have any questions. Thanks, Mike.

So I have a total of about 5 cards with Comenity Bank. I got a new Chase Sapphire Card and was all happy with my $15,000 limit. I've paid my cards on time every single month without any problems. Well suddenly Comenity starts dropping my limits on my cards and gets rid of Lane Bryant and HSN completely just closing the accounts that had ZERO balance on them!!!! Can you believe it??? I call them and they tell me too bad.

Michael Agruss Headshot

Hi Brandi, it sounds like a stressful situation. I would like to know more details about the situation to see if we can help you. We have resolved dozens of cases against Comenity in the past, and we can resolve yours too if I can understand it better. Please let me know if you have any questions. Thanks, Mike.

Comenity Bank has been harrasing us for a Credit Card payment of about $6,900, that we never lended from them. As a matter of fact, we have never opened any account with this bank. Somehow they reported this on the credit agencies, Equifax and Transunion. I just want to sue this fraud bank for $1M for harassment to me and my family over a credit card account that we never opened.

Michael Agruss Headshot

Hi Rahul, that would definitely be very unfair to you and your family. The Fair Credit Reporting Act allows you to dispute inaccuracies on your credit report, which sounds like the case here. It also could fall under the Fair Debt Collection Practices Act, but I would like to get to know more about your situation in terms of what they are doing and saying in harassing you. Please let me know if you have any questions. Thanks, Mike.

Comenity Bank is continuously harrassing me all day long. Telephone calls to me home and cell phone continuously. I block the calls and they call me on another number or comes in as unknown caller. They text me, send me letters. My accounts where paid. I mailed my payments out on time and they charge me late fees. I cancelled my cards and they still call over and over and over. It is completely stressing me out. I work in a critical care area of a pediatric hospital and I have to contend with this bullying and harrassment all day. Please help!

Michael Agruss Headshot

Hi Kathleen, I would also be very stressed in your position. Have you told them to stop calling? They may be violating the Fair Debt Collection Practices Act, and certainly if you told them to stop calling and they still do this. Please let me know if you have questions and would like to speak about your case in more detail. Thanks, Mike.

I have a client who has had her identiy stolen using comenity credit cards - 2x - we feel they hav enot had ade

Michael Agruss Headshot

Hi Andersen. Have they contacted this person about a debt? I would like to know more about what they have experienced in harassment so I can see if I can help. Please give us a call to discuss this further. Thanks, Mike.

I opened 2 accts. 12-16 and 12-17. I talked to the comenity rep on the phone and she gave me a due date. I inturn set my payments to draft and at $150 ove the payment for each acct. Ive been working in tx the last 2 yrs and yest my mother forwarded somemother forwarded my maill and when i opened i discovered comenity has been charging each acct a late fee since it was opened. $38.00 each acct each month since 12-16 and 12-17!

Michael Agruss Headshot

Hi Robert, that sounds very frustrating. Comenity should have communicated that to you somehow that they would charge that fee. Please give us a call if you have any questions and we can see how we can help. Thanks, Mike.

In december of 2018;and jan 2019 i paid off the respect months purchases to victoria secrets ;in full ;in cash; in the store. I had been having problems with them straight accross the board, Victoria's secrets, store and their customer service; in mid feb 2019 i returned everything i had purchased online, for delivery promised by deccomplaints24,2018. after filing a several series of complaints by phone, and email and chat? on March 05,2019 i had a credit of 250 plus like a 75 dollar credit from customer service from feb 15, and on March 14th while at the store; my card wouldnt work, and i had checked it a week before and there was 395 dollars available of the 450 dollar revolving credit; and they lowered my available credit to 100 dollars, claiming that the credit bureas reached out to them and submitted to them that my credit had dropped drastically which was the basis for them taking my credit line down, and thereby taking the credits that were applied to my card, for purchases when the purchases were paid in full, at the end of each billing cycle. Victoria Secrets will not do anything nor will comenity bank. The only way the credit bureas claim that they reach out is in response to a credit limit increase(which i had not asked for nor did i authorize them to run my credit for any reason) as i had just purchased a new vehicle and new that my credit limits ration would be high until the other car was paid off(trade in)!

Comenity Bank/Victorias Secret is trying to collect on a fraudulent account. They allowed a cc in a VS store states way in a deceased name and ss#. They were sent the death certificate which showed the death more than a year prior to this cc they authorized and allowed to be maxed in the store. They refuse to drop this, after 6 months are only just now saying they will investigate the fraud but if they cant find fraud, will pursue the estate!

This bank is harassing my son. My name is Veronica. My sons name is Steven. My son has been threatened by these people. He’s a wreck. They were calling me everyday for months until I put a stop to the calls. Make them Stop harassing my son!

Michael Agruss Headshot

Hi Veronica, I'm sorry you and your son are going through this. Are these calls about a debt belonging to your son? Comenity should not be calling you about a debt that he owes since that violates the Fair Debt Collection Practices Act. This stressful outcome is what we try to prevent. Please give us a call and we can help you. Thanks, Mike.

I have three credit card with Comenity bank. They have messed me up so many times. The first they put me on a payment plan and didn't actually set it up in the system so I was having automatic payemts taken out that were not covering the minimum payment. They have also stated several times that the payment they set up was the wrong amount so I was penalized for this. They told me I could make a payment later in the month when I was low on funds and that everything would be okay then called and told me they didn't know why someone told me that but I was now kicked off the program and would have to pay a deposit to get back on. Also with the contracts being invalid they are still taking money out of my account which I don't think they can legally do!

Michael Agruss Headshot

Hi Jessica. That sounds very frustrating and it is definitely something I can look into further. We have a lot of experience with Comenity Bank and I would be happy to see what I can do for you. Please give our office a call at your earliest convenience. Thanks, Mike.

I'm looking into you guys for my husband. Comenity bank keeps treating him and we want to know what are rights are. Is is on ssi and we only get one check a month so we try and pay as many bills as we can but insteand of trying to work with us they are threating him to take all his money out his account!

Michael Agruss Headshot

Hello Crystal. I would love to discuss your husband's case. Under the Fair Debt Collections Practices Act (FDCPA), you do have rights. Typically, debt collectors cannot garnish bank accounts or wages without a court order and certain exemptions apply to what they can garnish. I invite you to give my office a call and we can discuss the specifics of your case or I can contact you at a time that works for you. I look forward to talking with you soon. Thanks, Mike.

Jan 2018 I tried to leave a review on HSN for a lousy phone. The phone was not listed anywhere but my account. The phone was not in the HSN inventory. I called to report the missing item. The rep told me it is sold out, that's why it isn't listed. I told her sold out items remain in inventory. Later, the item appears back in HSN inventory. But, I cannot leave a review because HSN states I left a review. There is no review on my account for the phone. I checked my card account after I had made my payment. I called HSN Comenity Bank to report I couldn't log into my account. Feb 2018 I cannot log in to my account to make a payment. I called 4 times before a rep helped me get into my account. I missed the payment. Phone harassment starts, all day every 2 to 3 hours whether I make a payment or not. In 2019 Comenity Bank contacted two of my sons more than once. My sons have nothing to do with my account other than gifts sent to them, and, I believe at least one of them has an unlisted phone number. Note, regular payments are being made on my Woman Within Comenity Bank credit card during this time, as in Comenity Bank knows my location. I am sometimes locked out of my Woman Within account as well. I filed a complaint with the consumer dot gov website.

Hi May. That sounds super frustrating, especially with multiple calls and playing phone tag when you just want answers. When you say they call all day, every 2-3 hours, what times are they calling you? Have you attempted to send a cease and desist letter to Comenity Bank to stop the phone calls? You do have rights under the FDCPA, which you can find here. Please reach out to me at my office or I can contact you. Thanks, Mike.

Hello Linda. I'm sorry to hear about the problems you're having. I would like to offer my assistance and see if I can be of help. I invite you to contact my office at Phone: 312-224-4695.

I keep getting calls from Comenity Bank asking for a name I haven't used for 40 years concerning a debt I supposedly owe Victoria Secret. The number they are calling me on has never been associated with the name they are asking for, and I have never done business with Victoria Secret. What can I do? They want to verify information, but I will not give then any fearing phishing!

Michael Agruss Headshot

Hi Kathy. I can understand your reluctance to sharing information. I will reach out to you, if you don't hear from me, please contact my office and I will see what I can do for you. Thanks, Mike.

Can u talk on phone? It is about a CC Acct w Stage (Comenity Bank). Tell them to leave message if I dont answer and make sure they mention Arguss law firm concerning Stage acct!

Michael Agruss Headshot

Hi Jeff, I can talk on the phone and I would be happy to discuss your case with Comenity Bank. I have experience working with consumers who are struggling with debt collectors and I would be happy to discuss what I may be able to do for you. I will reach out to you, or in the meantime, feel free to contact my office at Phone: 312-224-4695. Thanks, Mike.

I'm constantly called by Comenity Bank for a debt that is not mine on my cell phone. They call looking for a Victoria Vickers. I have no relations and do not know a Victoria Vickers. They call my cell phone with harassing messages. I have called them back on several occasions to let them know I don't know this individual and to remove my number from their call list. I have filed a complaint with the CFPB and they have responded on 1.3.2019 advising my number was tagged do not call. None of my attempts to get the calls to stop have worked. They have also started calling my sister in law, harassing her!

Michael Agruss Headshot

Hi Chris. I'm sorry to hear that Comenity Bank isn't letting up, especially when you've done everything correctly in regards to a debt that isn't yours and you don't even know who they are looking for. You can also contact the FTC and attorney general alerting them to what the debt collectors are doing. We can also help. Please contact my office at your earliest convenience or I can reach out to you. Thanks, Mike.

I NEVER opened an account from any company relating to comenity. Moreover, the person they are leaving the message for have never used my telephone number. I receive approximately four calls every day. My telephone is on permanent Do Not Disturb because I simply can't take it.

Michael Agruss Headshot

Hi Bob. Unfortunately, you're not the first one dealing with this kind of situation and it is common with many debt collectors. Have you talked to Comenity Bank and alerted them to the fact that you do not have an account with them and that they have the wrong number? If they don't stop calling, you can also file a report with the FTC and the attorney general. My office can also help, we deal with these types of situations on a consistent basis. You can contact me at 312-224-4695 when you’re free and we can work on this. Thanks, Mike.

I opened an account at Ulta to get the “deal” of multiple points. First, it’s impossible to figure out how to pay these people! Anyway, my credit limit was raised from 750 to 1100. I was in a shop one day, without my card and had to try to identify my account with my ID (I wanted those points!). Next thing I know my account is cancelled, not for lack of payment but for “other reasons. Okay. So then the phone calls start. Literally every hour. I do everything online. It’s difficult to figure out what one’s account number is (blacked out on the bill). The website is a joke etc. As of today my bill is paid in full. This company is spurious at best and just plain ridiculous at worst. I’ll use my old fashioned debit and forgo the points bonus. Shame on you Ulta for being in bed with such a sleazy operation!

Hello Carolina. Have you gotten your issue with Comenity Bank resolved or are they continuing to call you? If they are, I can help. Please reach out if you need our assistance. Thanks, Mike.

Never open a credit card account with Comenity Bank. If you ever fall behind they will constantly put fees and charges on your account...even after it's closed. They tell you to call them and arrange payments but will not negotiate any payment arrangements. I tried several times to change a payment date. They would not budge. Plus be aware they report to the credit bureaus before the end of each even if your caught up they will report you being behind. They have a license to steal and the FCC and the banking institution allows them to do it!!!! They must be owned by a group of greedy scam artists!!!

Michael Agruss Headshot

Hi Laura. It is unfortunate that debt collectors do these sorts of things, but they're common. I am experienced in dealing with all the "tricks of the trade" and can help with your issues with Comenity Bank. Please give my office a call and we can get the ball rolling. Thanks, Mike.

I am always getting calls that I'm behind on my payment. I make a one time payment and set up and auto payment for the due date... But somehow one always gets missed and I'm get all these charges in late fees and this is been going on for months. I have a few pictures and was wondering if this a a problem for other people!

Michael Agruss Headshot

Hi Kristy. This is, unfortunately, a common issue with debt collectors. I would love to see the pictures you have regarding your late fees and discussing your case to determine how I can help. Feel free to contact my office at 312-224-4695 when you’re free. I look forward to hearing from you, Mike.

I had HSN credit cards with credit limit $3000 (issued by Comenity bank ) for years , I always paid more than minimum on time , recently they sent me a letter said that they decide to drop my credit limit to $500 , so I was angry and decide to pay off the full balance to avoid to pay that high interest charge 28.99% . I just went to Comenity web again and found out my balance is $ -0- , and they again drop my credit limit to $100 , What a joke , Do not deal with this bank

Michael Agruss Headshot

Hi Andy. This is common practice for credit card companies to partake in, typically for a few reasons. First, banks lower credit limits during times of economic uncertainty. Second, there may be a mix-up between your credit and someone else's who may have bad credit. Or third, you are seen as a higher risk to the credit card company. Just as credit card companies can raise your limit, they can decrease it any time. If you are still having issues with Comenity Bank, please reach out to my office and we can review your case. Thanks, Mike.

I keep getting multiple calls from comenity bank multiple times a day. I owe the company only 170 dollars and they keep harrasing me with multiple calls daily!

Michael Agruss Headshot

Hi Kenneth. It can be very frustrating when you receive multiple calls a day from a debt collector. Are they calling you at "off" hours (before 8am or after 9pm) or after you've informed them to stop calling? Under the FDCPA you have rights. Please give my office a call and we can help. Thanks, Mike.

This Commenity Bank is contacting my husband via his cell phone. They've called him three times in one day. Then they claim it's an urgent or seriouus matter. I do have a debt with them but don't him to be called. I don't need him to be called three times in a day saying it's urgent. This comapny has contacted me while I'm sick with the flu. I'm doing the best I can to pay them!

Michael Agruss Headshot

Hello Caroline. Under the FDCPA a debt collector may only call friends or family to locate the person with the debt. Once that person is located, they are no longer allowed to contact a relative or friend unless they are the cosigner. They should also not discuss the details of the debt with anyone. Please feel free to contact my office at 312-224-4695 when you’re free and we can discuss what my office can do to help. Thanks, Mike.

If you can avoid using Comenity Bank for anything I'd suggest you do so. Paid off a store card on autopay making double payments throughout the term of contract. Had a minimum payment of $27 and was paying $200.00 each month through individual $100.00 payments. Based on a technicality around where the bill cycle fell they'd been hitting me with late fees throughout the 8 months I was making payments. Customer Service hung up on me the first time I called and when I called back Account Supervisor told me there was nothing he could do. Absolute criminals. Robbed me of ~$180.00 in late fees.

Michael Agruss Headshot

Hi Frank. Have you looked at the agreement you have with Comenity Bank? Under the FDCPA, a debt collector can only apply late fees or charge interest if it was outlined in the original contract. If you contact my office, I can review your contract and we can discuss what help I may be able to offer. I hope to hear from you soon. Thanks, Mike.

Comenity bank charged an abusive sum of $1139 and other two charges of 200 and more at the same time over my 400 debt. They don't care, there is nothing you can do...!

Michael Agruss Headshot

Hello Alfredo. You do have rights under the FDCPA. I would be happy to review your contract with Comenity Bank and the rest of your case to determine what help I may be able to offer. Please call me at 312-224-4695 when you’re free. Thanks, Mike.

I have paid for an item from Woman Within. I thought I had paid at the time I ordered in Sept. When I realized I had not, I paid the full amount ($23.49). They are charging me $100.00 in late fees. I do not have a credit card with them as I never received one!

Michael Agruss Headshot

Hi JoAnn. That sounds very frustrating. Please call me at 312-224-4695 when you’re free and we can discuss your case. Thanks, Mike.

I have been being harassed by commenity bank, They are calling and threatening me, calling people in my family that i don't even talk to telling them my business and how they got the phone number i have no clue. They are calling my job it has become a nu sense.

Michael Agruss Headshot

Hi Toya. Unfortunately, debt collectors use these tactics all the time. Under the FDCPA, they are only permitted to call your friends and family in an attempt to locate you and they are not permitted to discuss the nature of your debt. Have you informed Comenity Bank that you cannot receive phone calls at work? Please call me at 312-224-4695 when you’re free and we can discuss your rights. Thanks, Mike.

I received two letters in the mail inquiring about opening a credit card account, I have not applied and would like to look into this as I have had my identity stolen in the past, my application number is 0002002290683397310!

Michael Agruss Headshot

Hello Jose Luis. I'm sorry to hear about your identity being stolen in the past, that is definitely a frustrating situation. I hope things have improved since then. If you haven't applied for a credit card account with Comenity Bank but you're receiving applications, I would be leery as well. Please call me at 312-224-4695 and we can look into this for you. Thanks, Mike.

I'm having issues with comenity bank with a gamestop card I got. Well the issue is me and my wife paid the card off and a few months later were getting calls saying we are passed do and card was maxed out which is not the case we paid it off and putnin our safe just in case we had issues or something. Well they sent us a letter saying we need to send them a later saying basically its not ours which we did and havent heard from them in 6months and not we get a letter saying I'm getting sued and not once did I receive a call or letter so I don't know what to do!

Michael Agruss Headshot

Hi Steven. Can you please send me all communications with Comenity Bank that you have, your original contract, and the paperwork for the payoff? My email address is [email protected] In the meantime I can contact you and we can discuss this matter. Thanks, Mike.

I am getting repeated phone calls from 614-729-6083 on both my smart phone and home landline. Whenever I answer, there is no one at the other end. As far as I'm aware, I'm not behind on any of my charge accounts, nor have I received anything in the mail indicating missed payments or notifications from collection agencies. Therefore I have no clue what these calls are about.

Michael Agruss Headshot

Hi Ron. Do you have an account with Comenity Bank? That is a phone number they commonly use when attempting to collect a debt. If you give my office a call I may be able to help. Thanks, Mike.

Receiving several calls a day from Comenity bank, I never had an account with them but they are trying to get my niece that has never lived with me, I told them that and to stop calling me but the calls keep coming.

Michael Agruss Headshot

Hello Daniel. Unfortunately, debt collectors are known to continue calling even when a debt isn't yours. They are only permitted to call to locate the person they are searching for, they are not to discuss the debt with you. If you have told them to stop but they continue, you do have options, including contacting the FTC, the state attorney general, or a consumer law attorney. My office is experienced in dealing with this type of behavior and would be happy to review your case and tell them to leave you alone. Please reach out at 312-224-4695. Thanks, Mike.

I have been receiving calls daily from comenity bank for the last 4 months. I tried blocking their calls, but they keep coming up with new numbers. I do not have a debt with them. I've told them twice in the past to stop calling here. They are asking for someone who lived here over 30 years ago. I repeatily told them, they don't live here!

Michael Agruss Headshot

Hi Arnold. Unfortunately, this is common with many debt collectors. You do have options under the FDCPA, including contacting the FTC, the state attorney general, and a consumer law attorney. I would be happy to review your case and see if we can get those phone calls to stop. Please contact me at your earliest convenience. Thanks, Mike.

I do have a debt with community, how ever the calls are excessive, they are even calling family members and leaving messages on their phones that I need to call them by a certain day or time regarding a debt, this is a personal matter and this should not be left on a phone that has not been verified to be mine or a family member.. I am totally exhausted with the excessive calls and now its starting with my family!

Michael Agruss Headshot

Hi Chinet. Under the FDCPA, debt collectors are only permitted to call friends or family in an attempt to locate the debtor. They are not permitted to make excessive calls, give out personal/private information regarding your debt, or continue to call once they have been informed that they are to stop. Please contact my office at 312-224-4695 or have your family members contact me. I want to help stop the annoying phone calls. Thanks, Mike.

Robo calls. I do not answer but back in Sept I did and they were calling me trying to collect the entire amount due saying I was late etc when I was just one day late. I made a payment on Sept. 5. Next payment was due on Oct. 4, today is 10/15, I can not pay them until Friday but it is not even 30days. I have not checked my credit report. The calls however are crazy and average 3 - 4 per day from various Ohio and Kansas phone numbers. Started on the 11th and has been daily. Their fees are insane as well. Prior to September my last payment was a payoff in July. Then I made a purchase with Overstock total was $175.08. Aug/Sept (pmt)/Oct (late) and my total is $282.78, that is $107.70 in fees! Statement is asking for a $80 minimum. I have asked them before if I can change my due date to a Friday (payday) but they refuse. Statement due dates are all showing the 4th of the month but finance charges all post on the 4th!

Michael Agruss Headshot

Hi Deborah. Phone calls and fees are extremely frustrating. Have you told Comenity Bank representatives to stop calling? You have the right to do so under the FDCPA, including sending a certified letter, which I can help you with. I will reach out to you, in the meantime, feel free to contact my office at 312-224-4695 and we can get the ball rolling. Thanks, Mike.

I only answered their phone call one time by accident, Comminity Bank. At that time I did ask what the collection was for and they told me an amount and date but could not give me purchase place. I told them I have no such Gold Violen Account. She told me she would make note and transfer my call then hung up on me. I get a call at a minimum every 95 minutes EVERY single day of the week starting at 8:00 am. I have purchased two robo call blockers and they have helped but the calls continue and they have a way of sensing because they hang up on the apps. If nothing else I think I should be able to sue for mental duress. I pay for my phone and should be able to choose its use and not be harassed by people I have never even done business with. I am not a sue type person however this is ridiculous, it is interfering with my profession, my life and my mental health. I have read reviews and in my opinion these people need to go to prison for what they are doing to others. now that I gave you my phone number do not become another Commenity Bank and call me relentlessly, just help me. I guard my cell number like crazy!

Michael Agruss Headshot

Hello Connie. Comenity Bank, like many other debt collectors, do make excessive phone calls which can be very annoying at minimum, and life-altering when it is extreme. If you do not have a debt with Comenity Bank and they continue to call, you have options. I do have your number and will reach out to you, otherwise feel free to contact me at my office at 312-224-4695. We are a law firm experienced in dealing with excessive debt collection calls. Thanks, Mike.

my bill has been paid off but i was late at times and this has happened over three years. i was in torrid store once and charged 120,00 and they keep charging interest over interest, at one time i made monthly payment that was fine and they cancelled after three months and said they can only do automatic payments for three months. i need help i am 78 years old on fixed income and i am now a nervous wreck over this and all the phone calls from comenity anonymous & etc over 8 per day ffrom each andnumbers i ner heard of. i hope you can help me!

Michael Agruss Headshot

Hi Christina. I would be happy to help you get this straightened out. Contacting my office is no obligation and we can then discuss your case in better detail. Please give me a call when you have a few extra minutes. Thanks, Mike.

Many robo calls to my divorced wife, who has not used this phone # for 30 + years. You can find Karen Feezell on Google. She states that she does not owe any $ to Victoria Secret, & does not have their credit card.

Michael Agruss Headshot

Hi Weldon. If your ex-wife doesn't have an account with Victoria Secret or Comenity Bank and they have been told so, they should stop calling. There are options to get the calls to stop and I would be happy to help her, or you, to get this taken care of. Please contact my office at 312-224-4695 and we can discuss this matter further. Thanks, Mike.

Information on Comenity Bank and Comenity Capital Bank owned by Alliance Data Systems. The card services section is or was operated by Abby Kritikois and Melisa Miller--who intentionally violated the laws, collection fees, not taking fraud. CONTACT ME, I AM A VALUABLE ALLY to holding them liable, accountable and paying UP!

In June 2018 I received a bill from Blair Department store in the amount of $695.00. I have never heard of Blair Dept Store nor opened an account nor purchased anything from them, ever in my life. I filed a fraud claim with Comenity Bank. Today I received a letter from Transunion to report the investigation is complete and Comenity is sticking to the story of this being my account!

My deceased mother had a Talbots card with a $240.59 credit. On Nov. 5, 2017 I sent a letter to you requesting the credit be sent to me. I did not hear any response from you and would like to follow up. Thank you!

I have made payment arrangements regarding my past due accounts and have set up automatic payments which have been made successfully. I continue to get multiple calls daily regarding my balance anyway and have asked for them to stop calling and harassing me and they hang up on me when I ask them to stop calling

I have an account with commodity bank, I had a tough time paying back and they kept charging late fees and interest that have doubled my original debt. they call me like 10 times a day on different phone numbers, I block them because when I talk to them they harass me. They started calling my husband, and calling him on different number. Calling my mom now, and my aunt and giving them information about my debt. I do not know what to do, but this is seriously driving me crazy. I don’t answer numbers I do not know because I do not like the harassment from them. I have the extension of the lady who called my mom and aunt giving out my personal information and name!

Comenity bank and Citibank continues to call several times a day from 8am-9pm. They use different numbers and Unknow numbers as well robot calls. I’ve told them to stop calling. They won’t. Anything I can do?!

I have gotten 6 phone calls since June 20th that I refuse to answer. I let my voice mail transcribe and find they are from banks wanting me to call. They say It’s “in my best interest” to return the call. I block each call afterward but they just keep coming. I filed bankruptcy in 2013. Since then, I have had no issues. I divorced in 2015 and my ex has since passed on. I do not know if any of this involves him but I am not liable for any of his bills. All co-owned bills were dissolved in the bankruptcy. I never got any co-owned credit cards after bankruptcy. My credit report even shows that I owe nothing past due. I looked up the phone numbers on the web and see you are involved with stopping the harassment of some if not all of them. They are: 614-754-4060 614-754-4059 614-212-5292 303-255-5354 303-255-5354 614-729-5000 I am on the no call registry and have been for years. I re-registered a couple years ago to be double certain that my number was there. I have photos of the voice mail transcripts of the first 3 calls but I shut the last ones down before they could leave a message. I will let them leave messages from now on so that I can get the transcriptions. One feature of my phone that I do love. I also screen shot the pages where the phone calls show in recent calls to prove that I received them. I’m tired of them. I’m 64 years old. I got rid of a deadbeat ex and I’m trying to repair my life. My credit was excellent before he messed it up. That is why it’s not in the dumpster now. I don’t need this type of garbage to have to overcome next. I have life-lock to help keep my identity safe and several sites say they will notify if anyone uses my social security number. I’m just tired of all the negative in the world and want to retire quietly. Please help me get this stopped before I do in the next few months if possible!

They gave me a 3 month autopsy payment plan, then rescinded it after 2nd n time payment with no explanation, now calling and sent 4 threatening voicemails. I talked to them and the guy wouldn’t answer my questions hen hung up on me. Now they claim it’s 4 payments behind and they sent a settlement letter when account isn’t closed. I emailed them for answers and got automated, canned response to call them.

We are just a number these days and nothing more than a number to a bank or any company as a matter of fact. Last month I made a payment to this bank in error. I contacted them the same day the payment was electronically transferred to have the transaction reversed. They said they didn't have my bank information to do that, I worked at a bank and I think you can reverse a electronic submission without the receiving party have your bank information it just simply goes back to where it originated. Nevertheless I was left with 3 options lose the payment, have the amount return to me or use the charge card to absorb the credit amount. So I left the decision up to the bank and how they want to handle it. I told them I didn't have their credit card any longer so they would have to re-issued me a card or they could return the amount by check so they say they would send me a check. They told me it would take around 14 days to issue the check. I checked my credit card account and the return was issued on 6/5 as of today I haven't receive the refund. I have contacted this bank a couple of times and the only information I have been give is the most famous line in the world. "THE CHECK IS IN THE MAIL." I realize this was my error but if I owed this bank a payment and I was late I don't think it would take them almost a month to access me a penalty for non-payment. We are nothing more than a number for these bank, no one is held accountable for there actions anymore so they do as they please.

I've been receiving robocalls from Comenity 614-729-6086. I recently also found out that they have been calling my father's office, which they probably found the number online since we have the same name (I have never provided any number other than my personal cell). They also gave information to my sister about the purpose of the call and and the amount they were trying to collect which I am pretty sure is against the FDCPA here in Florida. They frequently also call through an unknown number. How can we stop the harrasment and get compensated?!

I owe comenity on several accounts and have worked out a repayment plan with them using their hardship program. There were some accounts they could not put on the hardship program. They have been calling my son, my daughter in law and just the other day called my 85 year old Mother in Law telling her that I gave them her number as a backup number which is totally false. I don't even know her phone number. I have told them not to call my friends or my relatives and have provided them with a number to call me at and told them it is to be the ONLY number they should call me on. What can I do? How can they continually call my relatives? I thought that was illegal unless they didn't know where I was but I have told them how to contact me. Oh and they call my home and cell phone probably 30-50 times a day. Lilli Anderson

I live in SC and I am getting numerous calls from Comenity Bank saying I need lawyer, harassing me, and just called my 70 year old mother. I don't know how they got her #. Can I get any help living in SC?!

I'm having massive issues with Comenity Bank. I've had several accounts with them, all of which I've fallen behind on due to different circumstances and they're calling me from multiple numbers up to 40 times a day. Yesterday I had a voicemail saying my situation with them was going to change severely if I didn't call them back by 6:30, unfortunately I was working and was unable to call them back. I'm not sure what to do about it all!

I constantly get calls from this Comenity person. they keep calling my business number even though i have nothing to do with them and have a great credit score of over 800!

Issues with Comenity Bank dba Smile Generations Credit Card are as follow: Every monthly payment due I try to make the payment on or before the due date of the 16th of the month. The Smile Generations Credit Card site locks me out every time I try to make a payment. The site will not allow back in until after the due date, in which I have contacted customer service to unlock the site and they simply tell me I'm using the wrong username and they cannot unlock the site until one hour after a lock out, thus giving me a $45.00 a month late fee. I have told customer service I will be seeking legal counsel on the matter and they simply state, "Comenity Bank encourages its customers to seek legal help and bring forth legal action, as it is welcomed". All in all they are adding unnecessary late fees to my account, when I prefer to pay via the web for convenience. I'm seeking all legal avenues against Comenity!

Yes this bank is harassing my son. My son has been threatened by these people he’s a wreck. They were calling me everyday for months until I put a stop to the calls. Make them Stop harassing my son!

Comenity bank is calling me 6-20 times a day and it’s harrassing. I’ll pay off the credit card when I can. I have proof it’s them, they left a recorded voicemail on my phone by the number that calls up to 20 times a day!

Michael Agruss Headshot

Hi Lori, if you have evidence of numerous phone calls, I invite you to send it to my office at Email: [email protected] You do have options and rights under federal law, which we can discuss further. Feel free to contact my office at your earliest convenience. Thanks, Mike.

I have an account with Torrid which is serviced by Comenity Bank. I make my payments when I log into Torrid to pay the bill..It registers and says thank you for your payment. When I check my bank a week later the payment is not there and Comenity says i made no payment and charges a late fee and interest . This happens fairly consistently .the payment registers and then vanishes . they say I closed the browser after paying too soon so it can't go through which is crap. My balance won't go down even after making payments.

So comenity shows up on the caller id they call aggressively and when answered they dont reaspond it scares the heck out of my kids they think its a burglar seeing if someone is home, i try to explain to them but there children they dont understand if you can help thankyou very much 6 times an hour is Harassment and very unnerving!

Comenity Bank refuses to remove a hard credit inquiry from my credit report. The inquiry was completed online and not by me, for apparently what I was told was a Meijer credit card. Thus far, I have been told on three different occassions, since October 2016, that this would be removed from my credit report. Today, I was told that I would, once again, have to contact each credit agency to dispute the item on my credit report. I have done this twice, and each time, they say the information they report is correct. I've had this problem ongoing and other companies have gladly removed the information once they see the misinformation in the application, including that the person many times uses his own address. I was allowed to speak with a supervisor, who stated he would send the information to all three credit bureaus, today and that it would take 45 days to be removed. If it isn't removed, what can I do?

I have been getting harassing calls from comenity bank about a debt that I owe. They call me multiple times a day from different numbers, and "unknown" numbers. I cannot stop "unknown" numbers from ringing on my phone, so my phone has been ringing while I am at work and it's causing me stress. I have no proof that they are the ones calling since they are calling from an unknown number. I have answered to them before though so I do know it is them I have spoken with them about my financial hardships right now, and now they are threatening me with a lawsuit and telling me that I need to get a lawyer. I'm not sure what to do I would appreciate contact on this issue. Thank you!

comenity bank, rude and harassing me over a bill thats 4 days late. I live in NC and im interested in the comments that said tey can be penalized for harassment- plus im on the Do not call list!

I am receiving threatening and harassing calls from Comenity Bank regarding my three credit cards. They said they won't stop calling until I settle my debt, and they won't accept my proposed payments!

I am constantly being harassed by Comenity Bank regarding my three credit card accounts. They will not work out a payment plan with me, and they have threatened me with lawsuits.

I have been receiving phone calls from comenity about a bill that is late. Yesterday, I got a few strange numbers. I didn't answer and they didn't leave a message. Today, I got 6 calls from a blocked number. When I finally answered, they declared themselves to be comenity. He even said my bill is over a month late. This is a fallacy and deceptive. My bill was due on 11/12 and today is 11/22. They have been calling me for at least 3 days. The total for today being 8 times.... for a measly 10 days late! When I told the man that I was displeased with the amount of calls I had received in one day, he tried to say he was with debt collections and didn't have to take customer service issues.

Michael Agruss Headshot

Hi Nicole, You are protected under federal laws, and possible state laws (depending on where you live), when it comes to Comenity. I bet the 6 calls from the blocked number was Comenity. Comenity Bank is one of the most highest calling companies I've ever seen. They've called my clients over 8 times in a single day. I can help you stop the calls. I can also see if you have a case under various debt collection harassment laws. Thanks, Mike [email protected]

I have a couple of credit cards with comenity bank. I was paying them on time and for some reason never received a bill at my address so I must have missed payment. they added these unbelievable fees. I am having a difficult time right now with medical bills and I explained and said I can pay part of it but am having a difficult time agent said you owe it and after I made a payment they start calling all day from 9: am until 8:00pm. Using different phone numbers so I had to turn off answering machine it jammed my voicemail. I am senor lady and its making me ill. Don't know what to do. I appreciate anyway you could help me. Thanks, Janie!

Michael Agruss Headshot

Hi Janie, I'm sorry to hear about your medical issue. I bet Comenity could care less and that's why they are blowing up your phone. Does Comenity call you on your cell phone? If so, and if you've told them to stop calling, you could have a case under the Telephone Consumer Protection Act (TCPA). The TCPA deals with robocalls to cell phones. If you live in a state that protects you from original creditors, then you may have a case for excessive calls. For example, if you live in California, Texas, Florida, North Carolina, Wisconsin, Michigan, Montana, or Pennsylvania you may be able to tack on a state-law claim with your federal law claim above. North Carolina, for example, has one of the most consumer-friendly statutes in the country. If you live in NC, and you’re harassed over a debt, you may get $500.00 – $4,000.00 in damages per violation. I'll call you so we can discuss your rights and options under the law. Thanks, Mike.

I had a small account at Victorias secret I used to buy about $250 worth of items..yet every month i made payments they had some new "Fee" or interest change and the amount never went down. Then I made a large payment ( to a $200 balance as it NEVER went down much despite $50 and $60 payments ) and right after the large payment it went right back to $250...I then became very ill and explained to them if I was late it was due to treatment and recovering etc but that I had made a payment and actually made more...then the aggressive calls started ..and continued even after i explained I always made payments and would catch up in few weeks.then no more a company called Portfolio recovery keeps calling and writing saying i owe $620+ ?? But they will do a SIF for a 1 time Offer of $430. I told them good luck as I had paid most of it when they stopped taking my calls and my account disappeared from the over a year later they call with acrued interest when there was no Way to pay or get info... They need to be brought down and every penny i paid over the $250 given back...They are Scum buckets!

Michael Agruss Headshot

Hi Martin, it sounds like Comenity Bank, which backs Victoria's Secret, either hired Portfolio Recovery Associates or sold your debt to Portfolio Recovery Associates. I'm familiar with Comenity and PRA. Let's discuss your rights and options under the law. Even if Comenity and PRA did not violate the law, I can help you try to settle this debt for a reasonable amount. Thanks, Mike.

I got behind on my Woman Within & Full Beauty accounts because I am unemployed but looking for work. They start calling me before 9AM every day on their unavailable line then they call me on an Ohio number, Colorado, etc numbers. I have asked them to close my accounts but they won't do it so the late charges can keep adding up. I owe them approximately $400 on one and $500 on one!

Michael Agruss Headshot

Hi Lucille, I can help you stop the calls. You should send Comenity Bank (the bank that backs your Woman Within and Full Beauty credit cards) a letter asking them to close your accounts, enter into a payment plan (even if it's a nominal amount), and ask them to stop calling you. I can help you send this letter. I can also discuss your rights under the law with you on the phone. You may be able to pursue a case against Comenity for robocalls or excessive calls. Thanks, Mike.

I have been receiving about 7 to 10 phone calls a day from comenity bank. Yes i know i owe on my credit cards with them but i also am a single mom of 3 kids. Their needs come before anything else. It is to the point that when i can afford to pay i will make arrangements by phone but as soon as i miss the next one or any other reason they are calling daily now. As early as 8am till after 9pm... I am to point i want to shut off my phone for good because of the calls. However i dont due to if my kids need me. Any help or advice would help!

Michael Agruss Headshot

Hi Melanie, I am not surprise Comenity is calling you 7-10 times per day. I've helped dozens of consumers who've complained about similar collection tactics by Comenity. I can help you stop the calls. I can also see if Comenity violated any state or federal laws in its attempt to collect this debt from you. Let's discuss your rights and options on the phone. I'll call you. If I do not connect with you when I call, please call me at 888-572-0176 or e-mail me at [email protected] Thanks, Mike.

They keep calling and harassing. I am one payment behind! They call all hours early morning and late at night. They threaten for me to get a laywer! It's insane!

Michael Agruss Headshot

Hi Deborah, I'm sorry to hear you are going through this type of harassment from Comenity. Calling is one thing, but threatening for you to get a lawyer is another thing. I can help you stop the calls once and for all. Let's go over your options on the phone. Thanks, Mike.

January 2017 I had my identity stolen. So I spoke to community bank because I have three credit cards for them explain to them that my knee was stolen I was trying to work on it. I have not got that accomplished yet so therefore I can’t pay nothing on the bill getting 30 calls a day for these three bills I told them I would talk to them as soon as I can get something straightened out and are they just keep calling over and over and over. Please let me know what has been to do to get them stopI explained I would pay them as soon as I got the money!

Michael Agruss Headshot

Hi Amanda, I can certainly help you stop these calls. I can also help you with the identity theft issue you're going through. If these bills collectors are robocalling you on your cell phone, you may be able to get $500 in damages per call under the Telephone Consumer Protection Act. If any of these debts are on your credit report, I can hep you dispute the and get them removed under the Fair Credit Reporting Act. Let's further discuss your situation on the phone. I'll call you. Thanks, Mike.

I am getting about 10 calls a day from the comenity bank for bill that has been paid. Anyway to stop these calls. If I give you my number you wont call it like the comenity bank? 10 timesa day. Have them send me an email and then I give them my phone number Spanish Fork, Utah I can provide the details in the morning, but comenity is actually harrasing my 85 yr old mother. I made a mistake and included phone number on a letter we sent them showing her bank statement that shows she paid the bill. The company was the Togg Shop. Sorry I am typing on my phone!

Michael Agruss Headshot

Hi Gordon, I can stop the calls to you and your mother. That's terrible Comenity Bank is harassing your 85-year-old mother. Comenity Bank does back Tog Shop credit cards. I'll stop the calls ASAP. When we talk on the phone, or through e-mail, just let me know the numbers that Comenity calls you from. That will help me. Thanks, Mike.

Hi there, I am having massive issues with Comenity Bank. I owe them a little bit of money, but they have been constantly harassing me now for over a month. Several unknown and OH area calls a day on my cell phone, and the final straw was when they contacted my parents and were harassing them. Is there anything I can do to make these calls stop?? The money I owe is not enough to be harassed over. Not like I am thousands of dollars in debt to them. I think Total between my 2 cards I owe maybe $400. It's not that I don't want to pay, but life happens and I have been unable to pay for a couple months. I don't want to keep being harassed and I don't want them calling my family! Please help!!!'

Michael Agruss Headshot

Hi Megan, I'll let you know how to get Comenity to stop calling you and your parents. Once you tell Comenity to stop calling, under the law, the calls should stop. If they do not, then you and your parents may have a case under various state and federal laws. I handle debt collection harassment cases and robocall cases on a fee-shift provision and/or contingency fee. Either way, I do not get paid unless you get paid. So, you have nothing to risk. I'll call you to further discuss your rights and options on the phone. Thanks, Mike.

I hate them so much. If I happen to be a day late I've already received 5 calls from them. They have taken payments from my account that never got authorized. I used to mail in payments until they kept charging me late fee because my mail would some how always show up the day after my payment was due even tho I sent it a couple weeks before. I can't wait until this debt is paid off and never ever again will I deal with them.

Michael Agruss Headshot

Hello Brontee. If you or a court decision have never authorized Comenity Bank to take money from your account, they are not permitted to do so. Contact my office so we can discuss this further, you have rights under the FDCPA. Thanks, Mike.

I have 3 clothing apparel credit cards through Commenity. I haven't been able to make payments in awhile since I am disabled and I know I owe the money. However they call 100+ times a day from "unknown number" since I blocked all the other numbers they kept calling me from. It's non stop. Today my boyfriend's parents got a message from them trying to get ahold of me! How the hell do they even get that information? I am afraid they are going to start harassing them now as well. Are they legally allowed to call random people in my life about MY debt!? This crazy.

Michael Agruss Headshot

Hi Adriana. Debt collectors can find that type of information online, it is actually very easy to do. They are permitted to call friends and family in an attempt to reach you and get your contact information, however they are not permitted to call excessively, continue calling once told to cease, or disclose information about your debt to others. They are also not permitted to call you excessively or before 8am or after 9pm. If they are continuing to do these things, you have rights. Please reach out to me at 312-224-4695 and we can go over your case in better detail. Thanks, Mike.

I have multiple Comenity Bank cards and due to job loss last year I fell behind. The calls are NON STOP and from a hundred different numbers!!

Michael Agruss Headshot

Hi Sandra. Debt collectors are known to call from many different numbers, this is common practice. Have you informed them the calls need to stop or have you sent a cease and desist letter? Please reach out to me at 312-224-4695 and I can help you to get the calls to stop. Thanks, Mike.

I Lost My Baby in September and was unable to go back to work for awhile. I called to try to work with my credit card companies before the bills were even due and let them know of my hardship and they couldn't do anything for me and they have been nothing but harassing ever since. I just received a threatening phone call today from one of the women that works there telling me that she would take an action that would directly affect me if I didn't call her immediately and they also call numerous times a day even from an unavailable phone number as well as a OH phone number. I don't deserve to be harassed I can't do anything about the debt right now and they refuse to work with me.

Michael Agruss Headshot

Hi Kristina. You have my condolences and I understand how frustrating this must be during such a difficult time. While debt collectors are permitted to contact you in regard to your debt, they are not permitted to harass or threaten you. Can you contact me at 312-224-4695 and we can discuss what was said? My firm has the experience to get the calls to stop and help get things righted for you. I look forward to hearing from you. Thanks, Mike.

I have 2 accounts that are covered by comenity and I did get behind because "life happens" but not by very much. Try call at lease twice a day AND on sundays! They call my cell phone and my home phone. They even have it blocked so is shows up Private so I answer. Very sneaky.

Michael Agruss Headshot

Hi Melodie. This is common practice among debt collectors. Feel free to reach out to me at 312-224-4695 and we can discuss this further. Thanks, Mike.

I have 2 accounts with Comenity bank, VS and Lane Bryant. I have got behind on my payments as Winter bills are much higher than summer. It is Sunday, January 8th, so far I have received 13 calls today and it's only 3:35pm. They start at 9 am and don't stop until 9 pm. I thought there were laws in place as to how many times a day they can call you?

Michael Agruss Headshot

Hi Crystal. Federal law does not give an exact number as to how many times they can call you, although they may not call you repeatedly or continuously in an attempt to harass, abuse, or annoy you. You do have the right to tell the debt collector to stop calling you and you have the option of sending a cease and desist letter informing them of this. I can help you with that. Please feel free to contact my office at Phone: 312-224-4695 or I will reach out to you. Thanks, Mike.

This number calls at least once a day and very often more than that, they never leave a message. My friends and family combined don't call as much as this number does and its been going on for months. My wife and I are here along with my service dog and its becoming very uncomfortable.

Comenity Bank and Victoria Secret. I am receiving non stop calls from them and now getting private caller calls about Victoria Secret and Comenity. I closed my account with a $0 and now they are saying my balance that I owe them is 1,500 and I know that is not true cause I closed my account after I paid them the balance. I am now in a pickle on what to do to get them off my back because I never opened another account with Victoria Secret and I don't want to send/pay them anything that I don't owe them. I feel like its a fraudently company that owns the company that issues the charge card. Please give me some suggestions on what I should do. It sounds like I am not the only person that is having issues with this company.

I currently have 3 cards with Comenity Bank. They call non-stop. I make monthly payments but they continue to call me. Lately they have been calling my husband and mother non-stop too. They aren't listed on the accounts neither is their phone numbers but some how they got them. I get text messages. They keep pulling my credit report. This month they reported that I fell behind on all accounts even though all payments went thru on their due date.

I opened a Loft Store credit card for a purchase of $7+. I already had the MasterCard, but was told in store if I down graded to the store card I could merge the two accounts and pay off my bill in store. When I found out this wasn't actually the case, I spoke with a comentiy respesentative who cancelled my store card and transferred the balance to the already opened MasterCard balance. A month past, and I got a call saying that my Loft store card was past due. I called Loft to straighten this out and was informed the card was never cancelled, but they would happily do it now, and removed the now late fee associated with my account. Which seemed fine until the next month when I received more phone calls saying my account was now 2 months past due, and now I owe over $50 in late fees. I called, yet again, and was told again that for some reason the card was never cancelled and that they would process that now and remove the late fees and I even PAID the $7 that was supposed to be transferred to the MasterCard. I was assured by the respresentative that she documented everything and that this absolutely would not happen again. And yet, it keeps happening! 5 months in a row now I've received calls telling me I'm past due and that I owe $100 in late fees and I have no idea how to handle this situation. The stress alone of going through each individual call and having to explain everything from the beginning is so frustrating! ! Is this something you've encountered before?

i have had a change in professions and my family has went down to one income i have been unable to make my payments on time or in some cases at all to Comenity Bank so for the last month or so they call me every couple hours seven days a week I understand i have a debt with them but to me this is right

I have an outstanding debt that I have recently made payment, and yet they call me all day sometimes 2x in an 1/2 hour! I am annoyed!!

I never wanted to open a case with Comenity Bank but they talked me into it via Victorias Secret. My first and only purchase was in February 2014 in Panama City Florida, the day I opened my card. It was for $85. They told me that making payments would be easy, that I could make them in store, online, cheque, etc even with me being Canadian. That wasn't the case at all. I waited and waited for my card, which had my account number on it so that I could pay my bill. They harassed me with high amounts of calls daily, every time I picked up I would say the same thing: Sent me a card in the mail or figure out a way to get my account number to me (they cant tell me it over the phone) and I will make a payment today. It was 85 dollars that's nothing, I had no reason to not pay it. One day they called and I spoke to a supervisor, she realized instantly that this was an issue on the banks side and offered to waive any interest (obviously since it was their fault) and gave me a 25 dollar voucher. The day I got my card was the day I sent in a payment for $60.(85-25= 60) Now fast forward to 2016 they are saying the voucher doesnt exist and they have closed my account and sold is to a debt collector. The balance? $600. I have no idea how on earth that is allowed and what to do. I filed a dispute and didn't hear back. I followed up and they said there was nothing that they could do since they sold the account and closed it.

Michael Agruss Headshot

Hi Shruti, You are not the first person I've heard this story from regarding Comenity. Comenity banks over 100 retail stores' credit cards. It seems like consumers frequently have problems with Victoria's Secret credit cards. It's nuts that after spending $85 dollars Comenity claims you owe now owe $600 when the issue was all Comenity's fault. I can certainly help you. If Comenity is call you, I'll stop the calls. I will also help you resolve the underlying debt. We'll discuss your rights and legal options on the phone. Thanks, Mike.

I did have a Victoria secret account about 5 to 6mths ago. I lost my job and was not able to make payments I told them I would start as soon as I get back on my feet. They have been calling everyday all day since starting at 8 am even on sundays. I get at the least 10 calls per day from 2 different numbers. I just got a job my phone continue to ring through out the day into the night. I lost it one day and screamed at them I was on lunch break they just call right back. Is there anything I can do about this type of harassment? Please help

Michael Agruss Headshot

Hi Tammy, we can help you stop the calls immediately. Comenity backs your Victoria's Secret credit card. Comenity is relentless with its calls. You're not the only one on this page complaint about harassing phone calls on a Victoria's Secret credit card. But, you've come to the right place. I'll discuss your options with you on the phone. At the very least, I will get the calls to stop today. Thanks, Mike.

I had a lane Bryant credit card with comenity bank. Only $150 credit limit. Opened my account beginning of 2015. Diligently made $50 monthly payments even though my minimum payment was never more than $30something. I lost both of my jobs in June 2015. I haven't made any payments in seven months. But I never received any mail saying anything about collections. I went into a Lane Bryant Store to pay whatever I owed and the employee told me they would reopen my account within the next few days and contact me when it's open. Two days later, a guy calls my dad's cell.... never once has he called my phone, emailed me, or sent any letters to me. But he calls my dad and tells him I'm being sued and that I need to get a lawyer fast and to have him (my dad) tell me to call this guy back. The very next day, this guy calls my work's store phone 4 times to harass me saying "ms. baker, someone will be in today to collect for your lane Bryant credit card". and telling my coworke r who answered one of the four times that I am going to be sued. Still, this person has never once called my personal phone. And called my dad two more times. Moreover, from May until September I received anywhere from 6-30 calls every day from 919, 614, 720, etc. I answered maybe two calls, and both times the person calling sounded like a telemarketer so I hung up. Sounded like someone trying to steal information from me or something. It's not everyday anymore, but even up thru last month, one the few days they called from several different numbers, they would call ten times within a few hours. They are trying to scare me at my work and with my family. To the point of I'm freaking out at work because constantly worrying that any new face is going to be whomever this dude is sending to collect money and because he was so rude and treated me like shit, that they are going to humiliate me in front of my coworkers and customers. And he's harassing my dad calling him multiple times while he's at work. Over a credit card with only $150.00 limit on it. Every month they charged me $30 late fee, $2.72 interest.... they charged me up the ass every month so that even though I was paying more than the minimum balance, it never seemed to make much of a difference.

Michael Agruss Headshot

Hi Shelby, this sounds like a nightmare. I'm not sure why Comenity would threatened to sue you over some a small debt. Also, it seems counterproductive to sue you over a debt you are trying to pay. Finally, the fact that Comenity called your dad is outrageous. I've handled several cases against Comenity. I'm not surprised that they called you so may times a day. I've handled these types of cases where companies call people hundreds of times over small amounts of debt. Either way, I'll help you stop the calls, and I'll explain the law to you. You may have a case under the TCPA. Thanks, Mike.

Hi Brian, This does not surprise me that Comenity left you 30+ voicemail messages. The consumers I've helped against Comenity have received dozens of calls from Comenity. When your wife spoke with Comenity, did she tell them to stop calling? Also, if the credit card in your wife's name? If so, Comenity it's possible Comenity should not have been calling you on your cell phone in the first place. We'll discuss your rights on the phone. Thanks, Mike.

Hi Melody, When you sent Loft / Comenity a letter, did you tell them to stop calling? If so, and the calls continued on your cell phone, you have a case under the Telephone Consumer Protection Act. The TCPA allows you to recover $500 for every robocalll Comenity made to your cell phone without your permission. We can further discuss your rights on the phone. Thanks, Mike.

All the sudden 2 wks ago i started getting calls from this company. When i would answer, they would hang up and when i would call back some kid would answer

Michael Agruss Headshot

Hi Amy, do you have a credit card through Comenity? The last time I checked, Comenity issued over 150 retail store credit cards. I've actually never seen a bank so many credit cards. The calling and hanging up seems annoying. They should just tell you why they are calling you. If Comenity has the wrong number, they should remove you from their telephone system. I will help you get to the bottom of this. Thanks, Mike.

Today I checked my voicemail and had nearly 30 voicemail messages from 913 & 614 area codes which correspond to what's on my caller ID. My wife has spoken to them long ago to let them know that they will be paid on 7/22/16.

I have been getting calls from comenity nonstop today about my jjill card that is not even a month overdue, now they have slapped so many laye fees and penalties on it just since June, that my bill has doubled in the amount and I have been making the payments. The bill for this month is not even due yet but I have gotten at least 10 calls today, which I ignored they have left no messages nor have I received anything in the mail. This harrasement has to end.

Michael Agruss Headshot

Hi Laura, Comenity is aggressive when they call. I'm not surprised that Comenity called you 10 times in a single day. Comenity backs several stores' credit cards including J.Jill. I can help you stop the calls. Plus, you may be entitled to $500 per call under the Telephone Consumer Protection Act. I will discuss your rights on options with you on the phone. Thanks, Mike.

Comenity bank keeps constantly calling me. Over and over...all day and into the night. I don't know what they want, I haven't even heard of them. I have asked that they stop but it just goes on and on with no break.

Michael Agruss Headshot

Hi Mary Beth, if Comenity is calling you on your cell phone about a debt you do not owe, you can sue them for violating the Telephone Consumer Protection Act ("TCPA"). The TCPA protections consumers from robocalls to their cell phones. Under the TCPA, you could be entitled to $500 per call. Plus, we handle these cases on a contingency fee. That means, we do not get paid unless you get paid. I will call you to discuss your rights. At the very least, I will get the calls to stop. Thanks, Mike.

These random people from Comenity kept calling me over and over for collection as I'm in under debt after I already paid off a 3DS game in full and portions of a PS3 system which I was unable to finish months ago from GameStop, joining their PowerUp Rewards Credit Card program by force, and I'm annoyed by these calls showing up on my phone as I had to block them. I don't need to owe more than $200 for these items with late fees on them that they charged me, personally. Is there way to end this crazy situation?

Michael Agruss Headshot

Hi Rossi, I can help you with this crazy situation. Have you told Comenity to stop calling? If not, we will let them know you want the calls to stop. Once Comenity knows you want the calls to stop, Comenity can no longer place robocalls to your cell phone. If they do, you can sue them for damages for $500 per call. Let's further discuss your rights on the phone. Thanks, Mike.

I have been in a dispute with Loft / Comenity bank since August of 2014. They claim I charged $7.00 worth of merchandise which I did not. I paid the $27.00 in December just so they'd stop calling, but they did not. I have been charged over $220.00 in interest although I should have a zero balance. I receive about fifteen calls a day from them. I have written letters to both companies, and neither will agree to take off the late fees despite having no signature on file for the $7 purchase I never made. They did however credit me the initial $7 purchase. So how can I owe late fees for a purchase I never made...

These people keep calling over and over again, and the thing is that I myself do not owe them anything. A friend of mine used my phone number as the contact number to get just about $160 worth of items and tried to make a payment online and was told they do not accept these types of payments. I have no idea what is going on with this but they are so annoying. My phone has rang about 15 times a day everyday and it is just completely annoying. I want these people to stop calling my home. I do not personally owe them anything.

Michael Agruss Headshot

Hi Elba, If Comenity is calling you on your cell phone over a debt you do not owe, you can bring a case against Comenity based on the Telephone Consumer Protection Act ("TCPA"). Under the TCPA, Comenity cannot place robocalls to your cell phone unless you gave them your cell phone number. I see this situation often where a company blows up a consumer's cell phone over a debt not owed. I will help you stop the calls, and do my best to get you money damages for the harassment you experienced with Comenity under the TCPA. Thanks, Mike.
