Multiple debt collectors keep calling my cell phone seeminly non-stop. Prior to the recent homeowner claim with Farmers Insurance, our credit was on the mend. Covid hit us really hard, and after a lengthy forebearance under that Covid relief program that Congress put in place, I worked with the loan servicer on my VA loan to get that back on track. My wife and I made arraingments with the companies that we owe money to, amd life was great. Then we were hit with that horrid ice storm back in Jan/Feb 2021. From the moment we filed the claim for a roof leak, the tree that fell onto our roof, so on and so forth, it was a constant fight with Farmers Insurance to get everything covered. Contractors were so swamped that it was hard to get someone out here to do anything. Long story short, that company screwed us over, refused to cover a good chunk of the claim, accused us of wrong doing, and essentially left us worse off all of the way around. Because of that claim, and that company, which went all the way to their Chief of Claims Office at their Corporate Headquarters in California, everything is screwed three ways from Sunday. Our mental health sucks, finances are screwed, I’m forced to work through loss mitigation with my new servicer, my agent backs the company 100%, my health is worse than before, and I can’t get an attorney firm to touch this at all because they are already overwhelmed with similar cases with this company.
I had to file chapter 7 bankruptcy in 2016 due to nearly $200,000 in debt, mostly medical, but also included credit debt, and other stuff. Since then, I’ve tried to use the fresh start it gave me to get back on track. Now, however, I’m right back where I started, again. Nearly all, if not all of the credit card companies are calling me, and my military star card just went to collections, and there is nothing I can do. I need help, and as it is, I have to spend this weekend drafting complaints to both the state and federal agencies that handle this, and they, Farmers Insurance ultimately decided to retain a lawyer, and extensively grill us as part of an Examination Under Oath. That attorney grilled me for nearly seven hours, and my wife for an hour, then essentially forced us to get the document notarized and have repeatedly denied us the right to do anything, including being able to correct inaccuracies with those transcrpts prior to them being notarized. Fortunately, I have most of the communications in writing via email, text messages with the adjusters that were assigned to the claim, so on and so forth. I had to invest in the full suite from Decipher Tools, for which they gave me a generous and substantial military discount, because it is the only suite of programs that can decrypt anything Apple related. Fortunately, it will take any surt of communications via text message, anything on Social Media, you name it, and export it to a pdf document in court admissable format.
Anyways, I’m not sure how much of this your attorneys can handle, but anything you all can do to help a disabled military veteran and my family is welcome, and appreciated. I can hold my own, but this insurance stuff shook my wife, my fourteen year old disabled son, my eitght year old niece, and the rest of my family up pretty bad. The final low blow from Farmers Insurance is a non-renewal letter from Farmers Insurance citing “increased fire risk” due to the materials staged away from the house, that my agent conveyed need to be gone off the property since I don’t have space in my garage as I had to put my brother out there in a room of sorts because the kids, and my family were unable to sleep with him in the main house. Both my son amd my brother are incredibly disabled with mental deficits. Both I suspect are on tge Autism Spectrum, are developmentally disabled, and act way younger than they are physically. We consistently tell my brother that we have an exotic zoo in the garage. He laughs like a hyena, and the entire house, amd the entire neighborhood can hear him. Anyways, not sure what all you all can help with, but I need help, and even at the 100% rating level for VA disability, those benefits only go so far. The only reason why things aren’t worse is because my friend who retired from working for State Farm first, amd then Allstate, and other professionals showed me great kindness, and helped out, and told me that my military service was payment enough in their eyes. So basically, I’m blessed, yet screwed, and definitely broke with a massive headache on my hands again. For the record, having to take Ativan for panic attacks that restarted after nearly two years or so without, and migraines every day, consistently due to the stress and anxiety really sucks. The Army was a cake walk compared to this.
Thank you very much for any help and assistance you all are able to provide to my family and myself. Anything, anything at all with be graciously, and humbly welcomed, and accepted with open arms. All of this stuff is incredibly overwhelming, frightening at the possibility of more fallout from that claim, and all of the other stuff that is a catastrophic shit show, for lack of a better expression. Thank you again, and I look forward to speaking with you. My phone number is my personal cell, so I am good with email and text if that would be easiest for everyone involved. The portion covering my personal stuff with that claim, alone was over $66,000 that they crucified me over, and that didn’t include nearly everything we lost. That doesn’t include the damages they either denied outright or barred recovery of depreciation fior either, just an fyi. If my agent and the attorney Farmers Insurance retained for that claim decide to answer the last email I sent them, you all should have a pretty iron clad case, if you all decide to take that on as well. I would request however, that due to my limited finances, that if your firm does decide to take the insurance issues on, that it be on a contingency basis. I am willing to do the leg work, and put it all together for you all like I did in college when I took a bunch of Business Law and other related courses, but we are incredibly strapped financially barely keeping every single thing in our life from crashing down on our collective heads. As I mentioned prior, most of the other attorneys are either collectively swamped with other cases resulting from other claims, or they require pretty extensive monetary investment to retain. Irony is signing a blank check up to and including my life for this country, then going through hell for eight years of my life, and yet my disability is too high for Legal Aid, but too low to actually pay a customary retainer with the associated attorney fees to actually retain a lawyer to go after the dousche bags who screwed me over. Straight up irony.
