Since June of 2020, HMFUSA has been receiving my payment, but failing to apply my payment to my account, despite it showing as received and posted on my Hyundai account it was just not allocated to my payment. I spent countless hours, days, weeks, and months trying to get this addressed, it’s been insanity. I’ve written them via all avenues, aside from a legal Avenue which I’m now fully pursuing, on 03/21/21-03/22/21 my account showed approximately 46-47 past due, despite this being entirely inaccurate. For months I’ve been subjected to them taking my payments, marking me as late, and calling me to unlawfully collect money I don’t owe them, sending me letters, even going as far to send me a letter just days before they cleared my account to current, their letter sent stated my account was in risk of repossession or negative credit reporting etc. mind you, the company has failed to report my payments made on time each month for over a year, to the credit agencies, this has resulted in my being denied credit and credit increases because and I quote, “unable to retrieve recent payment history.” Making it look as if I’ve had a car and haven’t paid it, mind you, the balances reported are inaccurate, and even after taking the company to the CFPB twice and them agreeing to the mistake and correcting it, it was only limited to those instances. There was no permanent fix, nor has the company acknowledged the continuous violation of my consumer rights, collection laws, and in violation of my Retail Vehicle installment contract. I’m almost confident, that when I process this months payment, I’ll get another instance where I’m notified I’m past due. Despite proof that they’ve never not been paid, but have instead manipulated consumers and taken advantage of them. Myself included, and damaging my ability to secure credit I’d otherwise be eligible for, and could’ve used during a pandemic, but couldn’t because of this companies egregious activities. They should even have the calls (if they have integrity in that dept.) of me informing the collections team that their attempts to collect anything from me was in violation of federal and state law and exposes them to civil and regulatory penalties, fines, or civil awards, despite multiple attempts to educate them. They continued this practice. I asked for them to provide me all of the written correspondence between myself and them, as they make you use a secure mimecast server to speak to customer care, I was told I’d need a subpoena for a copy of conversations I had. I’m desperate. This company is destroying my credit, destroying my ability to secure better credit terms, a mortgage, and in terms unabridged by their illegal and unethical behavior.
