Exceptional Experience

Mike Bertucci handled my case professionally and successfully. Lakisha Joshua took time to understand my case with the utmost patience. Both Mike and Lakisha, in my opinion, are true assets to America’s Consumer Lawyer.

On April 26, 2025, I borrowed $1,000 from Check Mart of Florida, Inc., with a repayment schedule of $268.75 due on the following dates: • May 23, 2025 • June 6, 2025 • June 20, 2025 • July 5, 2025 • July 18, 2025 On May 8, 2025, I made an early payment of $335 over the phone, which was accepted on May 12, to cover the May 23 payment and a portion of the next one. I have never agreed to automatic payments and have always submitted payments by calling the company directly. Despite this, on May 26, 2025, Check Mart debited $268.75 from my account without authorization, causing my account to overdraft by –$268.75. I filed a dispute with Wells Fargo on May 28, citing the original $335 payment. Wells Fargo refunded only $71 after deducting the overdraft, which still left my account in the negative. Because I was on medical leave after surgery and receiving no income, my financial hardship worsened. The company continued to charge me as if no payment had been made. On June 6, they debited another $268.69, even though I had already disputed the previous charge and explained my medical and financial situation. To make matters worse, the company used two different merchant names to process transactions, making it extremely difficult for my bank to stop or block the debits. Wells Fargo informed me they could not block future payments due to the use of multiple processing entities. On July 9, 2025, Check Mart finally emailed me confirming that they are no longer authorized to debit my account. They acknowledged multiple failed withdrawal attempts and confirmed that they are now legally restricted from doing so again. Despite my early payment and documented hardship, this company’s actions have caused my account to overdraft more than once. They continued to process unauthorized debits and ignored my communication and disputes. I now have over –$657 in negative balance, and since June 20, I’ve only received $83 from my employer, worsening my situation.
