Nations Recovery Center Services Harassment
The Fair Debt Collection Practices Act (“FDCPA”) is a federal law that applies to everyone in the United States. In other words, everyone is protected under the FDCPA. The FDCPA is a laundry list of what Nations Recovery Center can and cannot do while collecting a debt, as well as things debt collectors must do while collecting a debt. The Telephone Consumer Protection Act (“TCPA”) protects you from robocalls. Robocalls are those annoying, automated, recorded calls that a computer makes to you all day long. You can tell it’s a robocall because either no one is on the other end of the line or there’s a delay when you pick up the phone before a live person comes on the line. You can get $500 per call if Nations Recovery Center violates the TCPA. Have you received a message from Nations Recovery Center that sounds pre-recorded? Several states also have laws that provide its citizens an additional layer of protection. For example, if you live in California, Texas, Florida, North Carolina, Wisconsin, Michigan, Montana, or Pennsylvania you may be able to tack on a state-law claim with your federal law claim above. North Carolina, for example, has one of the most consumer-friendly statutes in the country. Threats and harassment by collection agencies can be pretty intimidating. - Angela C. v. Nations Recovery Center. In this case, Nations Recovery Center called our client on her cell phone home telephone and work telephone in an attempt to collect on a loan. Angela C. eventually requested that Nations Recovery cease calling her at her place of employment. Despite her request, the calls continued. Nations Recovery Center also threatened our client with legal action if a payment was not made on the debt. Relying on Nations Recovery Center’s threats, our client entered into a verbal agreement with Nations Recovery Center. Our client did not provide any written authorization for the payment to be removed from her account. Prior to the first payment being removed, Angela contacted Nations Recovery Center to ask them to stop the payment. Despite Plaintiff’s request, Nations Recovery Center brazenly went ahead and withdrew a payment for $36.00 from Plaintiff’s checking account. In this case, we alleged Nations Recovery Center violated the Fair Debt Collection Practices Act and the Electronic Fund Transfer Act.
- Larry and Linda H. v. Nations Recovery Center. Larry lives in Arkansas, and Nations Recovery Center was attempting to collect on a Best Buy account from our client. Nations Recovery Center called our client on his cell phone. Nations Recovery Center called from 800-935-1139, which is one of Nations Recovery Center’s phone numbers. On or around May 2, 2016, Larry received a phone call from Defendant who explained that his wife’s wages would be garnished if they did not make a payment. During this aforementioned conversation Nations Recovery Center did not state the call was from Nations Recovery Center. On or around May 3, 2016 Linda received a voice message on her work line from Nations Recovery Center that if she did not call back, they would garnish her wages. The debt in question originated in 2007. The statute of limitations in Arkansas is 5 years. Nations Recovery Center is attempting to collect on a debt for which the statute of limitations has expired. We alleged that Nations Recovery Center violated multiple sections of the Fair Debt Collection Practices Act.
- John M. v. Nations Recovery Center. Our client lives in Texas. Not only is he protected by the Fair Debt Collection Practices Act, but she’s also protected by the state Texas Debt Collection Act. Here, Nations Recovery Center was attempting to collect on a debt that our client did not owe. Defendant continued to place collection calls to our client’s cell phone in an attempt to speak with “Priscilla.” Nations Recovery Center calls our client from 866-361-4567 and 770-234-0101. These are both Nations Recovery Center telephone numbers. On more than one occasion, John notified Nations Recovery Center that they had the wrong phone number and requested to be removed from their list. Despite his request, Nations Recovery Center continued to place collection call to our client in an attempt to collect a debt for Priscilla. Nations Recovery Center violated the Fair Debt Collection Practices Act and the Texas Debt Collection Act.

Can Nations Recovery Center Sue You?
Although anyone can sue anyone for any reason, we have never seen Nations Recovery Center sue consumers. It’s likely Nations Recovery Center does not sue because they do not always own the debt they are collecting on. Also, Nations Recovery Center would have to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s likely Nations Recovery Center collects debts through the entire country. Therefore, it would be very difficult to have lawyers, or a law firm, licensed in every state. There are collection agencies that do sue consumers. For example, Midland Credit Management is one of the largest junk-debt buyers. Midland Credit Management collects on debt and also sues on debt. The opposite is true with Nations Recovery Center. Therefore, it would be very unusual if Nations Recovery Center sued you. The original creditor, on the other hand, may hire a collection firm, or lawyer, to sue you. Can Nations Recovery Center Garnish Your Wages?
No, not unless they have a judgment. If Nations Recovery Center has not sued you, then Nations Recovery Center cannot get a judgment. If Nations Recovery Center does not have a judgment, then Nations Recovery Center cannot garnish your wages. Minus limited situations (usually dealing with debts owed to the government for student loans, taxes, etc.), in order to garnish someone’s wages, you need a judgment first. In short, we have not seen Nations Recovery Center file a lawsuit against a consumer. So, Nations Recovery Center cannot garnish your wages, minus the exceptions listed above.
