Who is NCB Management Services, Inc.?

NCB Management Services is a third-party collection agency, headquartered in Trevose, PA, and started its business in 1994.  NCB Management is a limited liability company.  According to the Better Business Bureau (“BBB”), NCB is categorized as a corporation and a collection agency.  According to NCB Management Services’ website, NCB focuses on receivable management services solutions, call center solutions, and portfolio acquisitions.   It appears that NCB Management Services collects on debts owed to third parties and collects on debts that it purchases.  Therefore, in some situations, NCB may be a junk-debt buyer.  For example, some collection agencies buy debt for pennies on the dollar, and then collect on it.  NCB collects on various debts.  We’ve helped a lot of consumers deal with NCB when NCB is collecting on payday loans; debt owed to major financial institutions, such as credit cards, installment loans, auto loans; retail store credit cards; student loans; insurance claims; and healthcare debt.

NCB Management Services Lawsuits

If you want to know just how unhappy consumers are with NCB, take a look at the number of lawsuits filed against NCB Management Services on the Public Access to Court Electronic Records (“PACER”).  PACER is the federal docket throughout the country that lists federal complaints filed against NCB.  When you do a search for NCB Management Services, there are over 200 lawsuits filed against NCB.  Most of these lawsuits involve consumer rights’ violations.

NCB Management Services Harassment

The Fair Debt Collection Practices Act (“FDCPA”) is a federal law that applies to everyone in the United States.  In other words, everyone is protected under the FDCPA.  The FDCPA is a laundry list of what NCB can and cannot do while collecting a debt, as well as things debt collectors must do while collecting a debt.  If NCB is harassing you over a debt, you have rights under the Fair Debt Collection Practices Act.The Telephone Consumer Protection Act (“TCPA”) protects you from robocalls.  Robocalls are those annoying, automated, recorded calls that a computer makes to you all day long.  You can tell it’s a robocall because either no one is on the other end of the line or there’s a delay when you pick up the phone before a live person comes on the line.  You can get $500 per call if NCB violates the TCPA.  Have you received a message from NCB that sounds pre-recorded?  Or, maybe the message you received from NCB is cutoff at the beginning or the end?  These are tell-tale signs that the message is pre-recorded.  If you have these messages on your cell phone, you may have a TCPA case against NCB Management Services.The Electronic Fund Transfer Act (“EFTA”) protects electronic payments that are deducted from bank accounts.  If NCB Management Services took unauthorized deductions from your bank account, you may have an EFTA claim.  NCB, like most collection agencies, wants to set up reoccurring payments from consumers.  Imagine how much money NCB gets if hundreds, if not thousands, of consumers electronically pay them $50-$100, or more, per month.  If you agreed to this type of reoccurring payment, NCB must follow certain steps to comply with the EFTA.  Did NCB continue to take electronic payments after you said stop?  Did NCB take more money from your checking account than you agreed to?  If so, let’s talk about your rights under the EFTA.The Fair Credit Reporting Act (“FCRA”) works to ensure that no information reported to your credit report is false.  In essence, it gives you the right to dispute those inaccuracies that you find on your credit report.  We handled a lot of cases recently where NCB Management Services reported debt on a consumer’s credit report.  NCB likely reports on credit reports to obtain greater leverage over the consumer.  If NCB is on your credit report, they may tell you if you pay the debt, they’ll remove it from your credit report.  This is commonly known as pay for delete.  You pay NCB, and they delete the debt from your credit report.  Even if NCB is not on your credit report, maybe the original creditor is.  If you pay off the debt to NCB, then the original creditor, and NCB, should accurately report this on your credit report.  Several states also have laws that provide its citizens an additional layer of protection.  For example, if you live in California, Texas, Florida, North Carolina, Wisconsin, Michigan, Montana, or Pennsylvania you may be able to tack on a state-law claim with your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country.  If you live in NC, and you’re harassed over a debt, you may get $500.00 – $4,000.00 in damages per violation.  We work with a local counsel in NC.  Our NC clients have received some great results in debt collection harassment cases.  If you live in NC, and NCB Management Services is harassing you, you have tons of leverage to get a great settlement.

What If NCB Management Services Is On My Credit Report?

Based on our experience, NCB does credit report.  That means, NCB will mark your credit report with the debt they are trying to collect on.  In addition to NCB Management Services, the original creditor may be on your credit report.  For example, if you owe Republic Bank and Trust on an elastic line of credit, and NCB is collecting on it, both Republic Bank and Trust and NCB may have separate entries on your credit report.  This is important because you will want both parties to update your credit report if you pay off the debt.  THE GOOD NEWS IS…If NCB is on your credit report, we can help you dispute it.  Mistakes on your credit report can be very costly.  Along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes.  Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or maybe you were a victim of identity theft. Complaints against NCB Management Services

If you’re on this page, chances are you are just like the hundreds of consumers out there being harassed by NCB Management Services.  The complaints on the Better Business Bureau (“BBB”), various consumer websites, including on Pissed Consumer, and even the complaints on this page (below) are endless.  NCB is accredited by the BBB.  The BBB gives NCB an “A” rating.  Despite its “A” rating, here are nearly 80 customer complaints on the BBB. Here are some of the many BBB complaints regarding NCB Management Services:

  1. “Calling I’ve been receiving calls from NCB Management claiming to be regarding a debt. I do not have any outstanding debts, certainly no debts that have entered collections. I simply wish to be left alone and for the calls to cease.”
  2. “I have been constantly harnessed by [NCB] over 25 times since October of this year.  He even called my elderly mother (who is 95) about my account.  Have received calls on Sundays also.  He leaves threatening messages on my cell phone voice mail.”
  3. “Last year I noticed that this company was reporting an unsubstantiated collection account on my credit reports.  i disputed it several times with the credit bureaus and each time it came back “verified”.  On June 15, 2016 I sent them a letter requesting validation and they completely ignored this… letter.”

Reviews and complaints on Pissed Consumer do not get any better for NCB Management Services.  NCB has an average of 1.3 stars on Pissed Consumer.  Here’s what people on Pissed Consumer have to say about NCB:

  1. “I started with them 2013 a guy called from their office and they said my debt would be paid after 14 months.  I made arrangements to pay from my account directly on a monthly basis.  Here it is 2016 and I’m still paying for a debt I could have paid my debt directly instead of going thru them because it seems they are charging fee so I’m paying double for a debt, something I could do myself instead of them being the middle man.”
  2. “Again today, they called me at work and this time left a message. I looked it up. According to the FTC, it is against the law to call me at my place of work if I have asked you to stop.”
  3. “They call your Job and tell all kind of Personal Information to coworkers when they answer the phone. Not Professional at all.”

Although there are only two reviews on Google, they are just as bad.  Both reviews give NCB Management only one star.  Here’s a snippet of the reviews on Google:

  1. “I keep getting sensitive information on a collection that isn’t mine. But then when you contact these people they act like the collection is mine. I was threatened, asked how I knew the person in question, and then asked to pay the debt, and suddenly my name was magically on it.”
  2. “An employee attempted to collect an uncollectable debt, a debt surprise to him was paid. I had the cancelled check and all information.”

Cases We Have Handled Against NCB Management Services

I THINK YOU’LL AGREE WITH ME WHEN I SAY…Threats and harassment by collection agencies can be pretty intimidating.  Well, it turns out we can stop the harassment, attempt to get you money damages under the law, and the collection agency will have to pay us our fees and costs.  Here are some of the cases we’ve handled against NCB:

  1. Sara B. v. NCB Management Services.  In this case, NCB called our client on her cell phone.  NCB Management called from 800-828-1110, which is one of NCB Management’s phone numbers.  Sara entered into a monthly payment plan with NCB where she paid $61.00 per month.  NCB automatically deducted these payments from our client’s checking account.  On or about April 3, 2017, Plaintiff received a call from one of NCB Management’s collectors, wherein the collector offered Plaintiff to settle the balance of the remaining debt by authorizing a payment of $500.  During the above-referenced collection call, Plaintiff clearly informed NCB’s collector that NCB Management was not authorized to withdraw a $500 payment from her checking account. In or around late April 2017, despite Plaintiff not providing authorization and/or revoking prior authorization, NCB brazenly went ahead and withdrew a payment for $500 from Plaintiff’s checking account.  In this case, we alleged NCB Management violated the Fair Debt Collection Practices Act and the Electronic Fund Transfer Act.
  2. Ginger P. v. NCB Management Services.  Ginger lives in Texas, and NCB Management was attempting to collect a payday loan from our client.  NCB called our client on her cell phone, her home phone, and at her work.  NCB Management called from 806-259-5910, which is one of NCB’s phone numbers.  Our client told NCB to stop calling her at work as her employer forbids these type of calls.  Despite Plaintiff’s request that the calls stop, NCB Management continued to call our client at work.  In fact, our client alleged NCB called her over 5 times at work despite Plaintiff’s multiple requests to stop calling.  We alleged that NCB Management violated multiple sections of the Fair Debt Collection Practices Act.
  3. Jennifer S. v. NCB Management Services.  Our client lives in Florida.  Not only is she protected by the Fair Debt Collection Practices Act, but she’s also protected by the state Florida Consumer Collection Practices Act.  Here, NCB was attempting to collect on a debt allegedly owed to Elastic Republic Bank and Trust. In this case, our client alleged NCB Management Services violated the Fair Debt Collection Practices Act (“FDCPA”) by disclosing our client’s debt to a third party, Plaintiff’s fiancé.  NCB Management left the following message for our client’s fiancé: “This is NCB Management Services, Inc.  I am calling regarding your Elastic account. I am here to help transition you through this difficult time. Please call me back 1-800-828-1110. My extension is 1194. This call is from a debt collector.”  Under the FDCPA, debt collectors cannot disclose debt to third parties, like our client alleges NCB Management did in this case.”

Can NCB Management Services Sue You?

Although anyone can sue anyone for any reason, we have never seen NCB Management sue consumers.  It’s likely NCB does not sue because they do not always own the debt they are collecting on.  Also, NCB would have to hire a lawyer, or use in-house counsel, to file a lawsuit.  It’s likely NCB Management collects debts through the entire country.  Therefore, it would be very difficult to have lawyers, or a law firm, licensed in every state.  There are collection agencies that do sue consumers.  For example, Midland Credit Management is one of the largest junk-debt buyers.  Midland Credit Management collects on debt and also sues on debt.  The opposite is true with NCB Management.  Therefore, it would be very unusual if NCB sued you.  The original creditor, on the other hand, may hire a collection firm, or lawyer, to sue you.  If NCB Management has threatened to sue you, call us.  We can help.

Can NCB Management Services Garnish Your Wages?

No, not unless they have a judgment.  If NCB Management has not sued you, then NCB cannot get a judgment.  If NCB Management does not have a judgment, then NCB cannot garnish your wages.  Minus limited situations (usually dealing with debts owed to the government for student loans, taxes, etc.), in order to garnish someone’s wages, you need a judgment first.  In short, we have not seen NCB Management file a lawsuit against a consumer.  So, NCB cannot garnish your wages, minus the exceptions listed above.  If NCB has threatened to garnish your wages, contact our office right away.

If you want to settle a debt with NCB Management, ask yourself these questions first:

  1. Do I really owe this debt?
  2. Is this debt within the statute of limitations?
  3. Is this debt on my credit report?
  4. If I pay this debt, will NCB Management remove it from my credit report?
  5. If I pay this debt, will the original creditor remove it from my credit report?
  6. If I pay this debt, will I get something in writing from NCB Management confirming the payment and settlement terms?
