The Fair Debt Collection Practices Act (FDCPA) is a federal law that applies to everyone in the United States. In other words, everyone is protected under the FDCPA, and this Act is a laundry list of what debt collectors can and cannot do while collecting a debt, as well as things they must do while collecting a debt. If Ray Klein Inc. is harassing you over a debt, you have rights under the FDCPA.

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. Can Ray Klein Inc. Sue Me?

Although anyone can sue anyone for any reason, we have not seen Ray Klein Inc. sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. Can Ray Klein Inc. Garnish my Wages?

No, unless they have a judgment. If Ray Klein Inc. has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above.   5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. Original creditors, such as banks and credit card companies, are not bound by the FDCPA.

  6. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. Received a letter from olsen Daines attorneys showing that ray kline filed lawsuit against me in Lincoln county Court on 3/12-2024 for the amount of $57. I have not been notified. I have no idea what it is from. I haven\'t lived in Lincoln county in well over a year and if I had a legitimate debt to pay I would have paid it but I\'ve been given no notice until now

Ray Klein filed small claims court case against me for unpaid medical debts. When I called them to figure out a payment plan 7 days after being handed the lawsuit papers they said I would need to pay a down payment first then set up monthly payment plan. I requested this in writing but they refuse to do so. I’ve heard of so many issues with Ray Klein debt collections taking more pay than agreed, etc. so how do I get them to agree to send a written contract? What is the best and safest way to even make the payments with them so they don’t take out unauthorized payments? How can I make them send confirmations on payments and when the entire debt is paid? I’ve heard they add on undisclosed interest throughout the process to make it so you still owe in the long run and can be sued again.

I don’t know where the debt came from or if it’s even mine. I received a letter stating Ray Klein is trying to sue me and garnish my wages from something from 2018. $19,000 being garnished - Please Help... I have had a rough go with medical bills ever since I was old enough to receive them. In September of 2012 I did file bankruptcy and by 2013 Ray Klein Ink. (Professional Credit Services) had a judgment in place for $11,000, at that point I think I just gave up on trying to keep track. Side note, I also have ADD and was diagnosed slightly dyslectic as a child to put into perspective my ability to process and understand the severity of the situation. My wages were garnished but I was never given information on what the payments went towards or any updates on the balance. In April my HUSBAND was served papers for me at our home for a small claims court order for $1,000. I figured that I owed that money anyway and could not afford to take time off of work so I let the judgment file. A couple of weeks later, my manager at work advises of an $18,000 garnishment. I called to find out what was going on, they could not give me ANY information on accounts that were already in the court system but that the garnishment they received was from 2013 with interest AND the $1,000 was just another one. Plus they have 3-4 other accounts that have not been submitted into the legal system. I am so beyond lost with no end in sight. I am not sure what to do or where to start...
